They are not in compliance. They have 2 NOV's sites that are still out of compliance. You are correct that the North Slope
area of Phase 3 is not located next to any surface waters. FYI-we will not be issuing any approvals for new sediment and
erosion control projects out there until both NOV sites are back into compliance. If you have questions—please call me.

Can one of you confirm that Tryon International Equestrian Center is now in compliance with their sediment
and erosion control plans except for the North slope area? I understand that the North slope area is not
located adjacent to any surface waters, so I don't believe that it is necessary to hold up the water quality
certification for compliance related to that area.

Good morning, It is my understanding that the violations have been satisfactorily addressed everywhere on—site with the
exception of the North slope area(overlook). The area was to be hydro seeded again with hopes on establishing grass on
the slope this week.
