Will this project EVER get done and go away?
I've talked with Ian about your specific question. From what I gather, the rules could (more likely
would) require stormwater management from the entire development (including phase one) IF a 401 is
required and the impervious surface is high enough to require it. (It is)
That said, it has been our understanding all along (you, me, Bob Bennett, and Jack Carlisle), at least to
my recollection, that the road crossings into Phase 2 would be the trigger for stormwater management
requirements in the next phase. It looks like this was an error on my part. I hope Ian will take that into
consideration.
I do recall Bob Bennett considering all kinds of options to cross the stream without having to get a 401
and thereby avoid storm ponds, etc. that would be required. Is he still involved?
Given the property location, and as much as I would like to see stormwater controls for the entire site,
I will ask by copy of this e-mail that an exception be made so that the 401 certification can be issued
without the requirement for stormwater controls in Phase I.
As for the anticipated changes in the site plan, I believe the engineer would do well to at least nail
down the design of the stormwater treatment units, even if the arrangement of the apartments should
change. As long as the impervious surface remains the same, it might be easier to get a modification or
conditional approval. Can't say for sure. I'll let Ian and Annette make that call. One mistake per project
is enough.
Maybe this will come to pass before I retire.

back and start retrofitting a portion of the site that's been done, built-out, and occupied for years now.
We've said all along that we'd prepare a Stormwater Plan for the proposed development not what was
already built.
We're trying to get the stream and wetland restored as soon as possible but it seems that we can't do this
until Ian gets satisfied. At this point we all know there's a reasonable likelihood that the proposed site plans
for the undeveloped portion of the site will change. Can't DWQ make it a condition of the permit that "if
proposed site development plans change that a REVISED stormwater plan needs to be approved BEFORE
construction"?
Our immediate goal is to get the restoration work done before too much longer. At this point we've got the
404 from USACE and now we're struggling to get DWQ on board so we can get to work on the
stream/wetland work.
Can you weigh into this with Ian for me please? I'm sure he's not aware of the long illustrious history of the
site.
