Within the May 8, 2008 NOV, the following violations were listed and identified: 1. Stormwater General Permit (NCG010000) Condition Violation The remainder of this letter will respond to each item individually; the original request will be in italics followed by our response: The approved Sedimentation Control Plan must be followed. Provide a statement documenting that the approved Erosion and Sediment Control Plan is on-site and available for review. The Erosion and Sedimentation Control Plan is kept in the monitoring box at the location discussed in a previous email correspondence (May 16, 2008). The applicant has no idea why the plans were not available on the day of your site inspection. It is possible that the plans were being updated and/or reviewed by another party during the timeframe of your particular visit. 2. A rain gauge must be maintained on site as required by the permit. Provide a photograph of a working rain gauge on site and note the location. It should also be noted that there has been no activity on the Phase 2 side of the development since November of 2007. 3. Provide all rain gauge data collected to include the past four months of monitoring records through to the date of your written response to this letter. If you do not have data, explain why. Please see the attached rain gauge data for the Bluffs development. As discussed above, there has been no activity on the Phase 2 portion since November of 2007. 4. Provide inspection records to include the past four months of monitoring records through to the date of your written response to this letter. If you do not have records, explain why. As previously stated, there has been no active work on the Phase 2 portion of the Bluffs development since November of 2007 and therefore, there are no monitoring records; the applicant did not think it was necessary to monitor a site where no activity was taking place. 5. Remove the temporary erosion control measure (check dam) from the stream and restore the natural grade within 30 days of establishing permanent ground cover. This has been addressed as requested. Please see the attached pictures that demonstrate compliance with this item. We anticipate that this addresses all of the DWQ's concerns.
