PROJECT SUMMARY: The applicant proposes to construct a bulkhead waterward of existing concrete block bulkhead sections and unhardened shoreline areas, place riprap along a 404-wetland shoreline, construct a retaining wall within a 404-wetland area and construct a four-slip docking facility. Project Setting The site of the proposed development is located at 141 Foxx Lane (off of SR# 1370), Knotts Island, Currituck County, and is adjacent to Knotts Island Bay. The property is made up of two adjacent Lots that total ±431,182 ft2 (±9.9 acres) in area. The majority of the sites elevation is<_1.5' above Normal Water Level (NWL) but it does have areas of ±24 above NWL located within the northwest area of the property. Man-made features include a single-family dwelling and multiple storage sheds of varying sizes. The upland area is vegetated with yard grasses,various upland trees and shrubs.According to the USDA's Natural Resources Conservation Service's Web Soil Survey, the soil on the property is made up of Conetoe loamy sand (CnA) and Nimmo loamy sand(No). USACE 404-wetlands exist within the southern portion of the property. There is a distinct tree/brush line that separates wooded wetlands from a mowed±30'wide wetland area. Based on available information, there appears to be no archaeological sites on this property or nearby The site has±746.5' of shoreline adjacent to Knotts Island Bay and±543.5' within a canal for a total shoreline length of ±1,290'. An overgrown, shallow ditch/canal runs along the northern property line. A concrete block bulkhead that was backfilled with gravel begins at the mouth of this ditch and follows the shoreline contour southward for±446.5'where it ends at the mouth of the canal. The canal extends in a westward direction and is ±270' long x 45' wide with an unhardened shoreline. A culvert exits at the end of the canal that provides water transfer to 404-wetlands. The concrete block bulkhead begins again on the south side of the canal mouth and continues an additional ±180'. The remaining ±120' of shoreline is unhardened and adjacent to both a non-wetland area and a 404-wetland area. A±90'diameter man-made pond is located±100' north of the canal mouth adjacent to the shoreline. This pond is not connected to Knotts Island Bay, but does have wetland plants such as cattails and arrowhead growing within it. The concrete blocks have sunk into the substrate since installation (indicated as 1994) ±16" below the adjacent ground elevation and NWL is now an average of 4' landward of the blocks. An erosion escarpment that ranges from ±0.5' to Vis located an average of 8' landward of the blocks. A±6'wide area of gravel is located on the waterward side of the concrete blocks due to being displaced through wave action. The shoreline of the canal and the remaining shoreline south of the concrete block bulkhead has an erosion escarpment that is ±1 to 2' in height and NWL is located at the escarpment. The adjacent property to the north is a large tract that has a single-family dwelling, storage sheds, a bulkheaded shoreline and a 200' pier with several slips. The adjacent property to the south is undeveloped USACE 404-wetlands. Charles&Carol Holden Field Investigation Report Page 3 The waters of the Knotts Island Bay are classified as SC by the Environmental Management Commission and are not open to shellfish taking. Water depths within project area range from ±1' to 1.5' below NWL adjacent to the concrete block bulkhead and ±1.5 to 2.5' below NWL in the open waters. The bottom substrate within the project area is made up of fine sands. Submerged Aquatic Vegetation (SAV) was observed growing within the project area and include, but are not limited to, wild celery (Vallisneria Americana) and widgeon grass (Ruppia maritime). SAV coverage is estimated to be moderate up to ±125' waterward of the concrete block bulkhead at which point it became sparse. Water-milfoil (Myriophyllum spicatum)was observed growing in dense patches within the moderate area of SAV's. It should be noted that SAV's were not observed adjacent to the concrete block bulkhead due to the washed out gravel. Development Proposal The applicant proposes to stabilize the shoreline by constructing ±1,230' of wooden bulkheading. Along the shoreline where the concrete block bulkhead is present (±626.5'), the proposed bulkhead will be constructed on the immediate waterward side of the blocks. Along the unhardened canal shoreline (±543.5') and unhardened shoreline adjacent to Knotts Island Bay (±60'), the bulkhead will be installed s2' waterward of NWL. The proposed bulkhead along Knotts Island Bay will transition to a retaining wall for±30'along a USACE 404-wetlands shoreline and then extend landward through the wetlands for 240' staying 2' off of the tree/brush line. The portion of retaining wall landward of NWL will be constructed with aluminum flashing and will have a height of 12"above the substrate. No fill will be associated with the retaining wall. The applicant has indicated that disturbance limits will extend no more than 8' landward of the erosion escarpment (with the exception of the pond area where it will be less) and an 8' wide swath along the area of the proposed retaining wall. To add strength to the retaining wall along the shoreline and protect the remaining ±30 of wetland shoreline, the applicant proposes to install ±60' of riprap with a waterward toe extending 6' beyond NWL. To provide water access and docking, the applicant proposes to construct a 180'x6' pier with a 20'x20' platform ±125' south of the northern property line. Two 17'x1'finger piers and a 10'x1' finger pier will be installed on each side of the pier and platform to create four formalized slips. The proposed docking facility will not encroach within the 15' setback and meets the 1/a width rule. Water depths within the proposed slips are >_2' below NWL. Anticipated Impacts • The construction of the bulkhead and riprap along the proposed alignments will result in the filling of ±4,098 ft2 of Estuarine Waters and Public Trust Area AEC's with clean fill from an upland source. • The construction of the bulkhead along the proposed alignment will result in the filling of 2,506 ft2 of Estuarine Shoreline AEC. Charles&Carol Holden Field Investigation Report Page 4 • The construction of the bulkhead along the proposed alignment will result in the placement of ±341 cubic yards of fill material below NWL. • The construction of the retaining wall along the proposed alignment will result in the disturbance of 2,160 ft2 of USACE 404-wetlands. • The proposed docking facility will result in the shading of approximately ±1,568 ft2 of Estuarine Waters and Public Trust Area AEC's • The proposed docking facility create 4 formalized slips in water depths that are 22' below NWL. • It is not anticipated that the proposed docking facility will have any negative impacts to navigation. Submitted by: Ron Renaldi Date: October 11, 2016 Received OCT 7 - 2016 A Project Narrative—Charles Holden Major Permit application DCM-EC The primary purpose of this project is to stop the erosion from wind driven, northeastern, and from due east that wash water against the bank. From the time this property was subdivided around 1975 to the present time,erosion has taken away from 60'on the north end of the property line to approximately 90' on the south end with lesser amounts in the middle.This land is lost forever and now the bay is rising up and the wind force which blows from the south and builds up the water level then from the north to move it back into the Currituck Sound has increased causing faster erosion.The concrete blocks which were placed along the water line facing Knotts Island Bay cannot slow or stop the erosion and flooding that is taking place when the blocks were laid down in 1994 to now.The bay low water mark is approximately one foot higher now.That leaves an average of 16"from the top of the block to the land level.This new bulkhead will extend the new height 8" (above grade)which matches the existing bulkhead on the property next to us on the north end. The bulkhead would extend from the property line on the north towards the property line to the south, facing Knotts Island Bay.Starting on the north end,concrete blocks were placed against the erosion escarpment at that time in 1994.Two separate sections with a total of 155 blocks 15%2" high x 27"wide by 48" long,were placed.Over the years,strong winds have washed over the blocks causing erosion. Details of this are included on the drawings.The total length where blocks occur is 626'6".Total fill material from the proposed bulkhead to the existing erosion escarpment located on the landward side of the gravel behind the bulkhead is"226.8 cubic yards.The total area is—4,943 square feet. The bulkhead would be placed tight against the cement blocks which would add support. A—260' long canal extends from Knotts Island Bay westward into the property that has an unhardened shoreline. Along this shoreline,the bulkhead would be placed 12"to 24"from the erosion escarpment for a total of^'556'.Also,a 60'section of unhardened shoreline along Knotts Island Bay south of the concrete blocks will be bulkheaded.The total length of these sections are—616'.Total fill material between the bulkhead and erosion escarpment is—114 cubic yards.The total surface area is—1,232 square feet. In addition to the bulkhead we propose to build a retaining wall along the tree/brush line of the marsh land on the south end of the property.Water builds up in the marsh and flows out onto our grass land. In order to stop this,the retaining wall would be 12" above ground level.This area of land has been determined by the USACE visit on 7/28/2016 to be a USACE 404-wetland area that extends 30' landward of the tree/brush line where the retaining wall is proposed.The wall will be constructed 24"from the vegetation line and would be a total of—270' including a 30'section along the shoreline. No fill material will be placed in conjunction with the retaining wall.Additionally,a—60'x 6'section of riprap will be placed along both the retaining wall section and the remaining unprotected shoreline at the south property line to protect that area. Along with this project, a 180' long x 6'wide pier with a 20'x 20' platform at the end with four boat dock tie-ups is proposed.The pier will start at the new bulkhead, 125'from the north end property line into Knotts Island Bay.
