Project Summary: The applicant wishes to demolish a portion of the existing structures, construct a new 9-slip docking facility that will result in a total of ten slips, a 234-dry slip storage facility with offices and restrooms, a sewage disposal area, and fuel pumps at a second staging platform, new dredging of an upland basin, 68-space parking lot, and shoreline stabilization. 9. Narrative Description: Please note that the NC Division of Coastal Management (DCM) has determined that this proposal is exempt from the requirements of the NC Environmental Policy Act (NCEPA). The NCEPA requires that an environmental document be prepared by the applicant proposing to construct a new marina, or a 25% orgreater expansion in the number of slips at an existing and operating marina. According to this application package, there are eleven slips existing (but not operating). The proposal replaces three (out of the eleven) of the existing slips with nine new slips, resulting in a total of seventeen slips on the property. This would require review under the NCEPA. However, in contrast to the submitted application, the DCM has determined that there are three slips existing on this property (ref. State Permit #86-75 and on-site review by the DCM staff). Thus, the proposal will replace two (out of three) of the existing slips with nine new slips, resulting in a total often slips on the property. The property is a 24.97-acre parcel in Beaufort, Carteret County. The parcel is located at 2500 Front Street off of Lennoxville Road. Lennoxville Road splits this property. To the north of Lennoxville Road, is 16.633 acres of which is relatively undeveloped. To the south of Lennoxville Road, is 8.335 acres of which is developed with a fish processing plant. This existing facility ceased operations in 2005. It is located at the eastern terminus of Front Street on Taylors Creek, adjacent to the NCWRC public boat ramp to the west. To the east of the property, the adjacent property is developed and owned by Atlantic Veneer Corporation. The Town of Beaufort Land Use Plan has classified this area as Developed, with CAMA AEC's classified as Conservation. The applicant wishes to develop the property with a commercial nine-slip docking facility, and a dry stack storage facility with a parking area for clients. This site is developed with several dilapidated buildings to support a large commercial finfish processing operation; including but not limited to warehouses, equipment storage, sleeping quarters, docks, railway ramp, bulkhead, and dolphin clusters. The upland vegetation mainly consists of lawn grasses bordered by Section 404 Wetlands and coastal wetlands along the 665' of shoreline. Upland elevations range from +4 to +10 feet msl. There are three distinct sections of coastal vegetation adjacent to the property, mainly consisting of Salt Marsh Cordgrass (Snartina alterniflora). The second section is located approximately 180' east of the western property boundary and has an area of 595 square feet within an existing railway ramp. The final section is approximately a 15,000 square feet area bordering the mouth of an unnamed tributary within the southeastern section of the property. The waters of Taylors Creek are classified as SC. None of the project area is within PNA; it does not have submerged aquatic vegetation, and is closed to the harvest of shellfish. Bottom elevations within the project area range from -1 to -8 feet nlw. The bottom substrate is soft subtidal with shell. These waters have an approximate +/-3' lunar tidal amplitude. Taylors Creek is approximately 380' across at this location. There is a shallow, unnamed tributary that juts through the southeastern portion of the property. This tributary is approximately 100' from the eastern property boundary and is connected to Taylors Creek. This tributary runs in a north-south orientation and continues beneath Lennoxville Road via culvert. This unnamed tributary is approximately 10' wide and its degree of sinuosity is minimal. The bottom substrate is soft subtidal with shell. It is bordered by coastal and Section 404 Wetlands on both banks. 10. Proposed Development: The applicant wishes to demolish a majority of the existing structures, construct a new 9-slip docking facility that will result in a total of ten slips, a 234-dry slip storage facility with offices and restrooms, a sewage disposal area, and fuel pumps at the docking facility, new dredging of an upland basin, 68-space parking lot, and shoreline stabilization. The demolition proposes to remove all but one of the upland buildings. The demolition also proposes to remove the fish oil tanks, asphalt, and concrete pads on the property. This demolition activity is spread across the southern portion of the tract that is separated by Lennoxville Road and adjacent to Front Street. The remaining building to remain is labeled "TIN BUILDING" on Sheet 03. A portion of this building is waterward of the normal low water level. The demolition proposes to remove two [or three (ref. Sheet 05)] out of the five existing piers on the property, as well as the associated dolphin pilings and a section of bulkhead along approximately 300' of shoreline. These water dependent structures are located on the southwestern side of the property. Two of the remaining docks to the immediate east of this demolition activity are within the USACE channel setback as shown on Sheet 03. The final remaining pier is located adjacent to the eastern property boundary, 10' landward of the USACE setback, and is within 15' of the riparian property line. The proposed dredging area is at the southwestern corner of the property, adjacent to the NCWRC public boat ramp property. The excavation proposes to remove a total of 22,750 square feet (6,348 cubic yards) of material. This includes the existing railway ramp and existing bulkhead along with 595 square feet of coastal wetlands. Brad Connell May 21, 2008 Morehead City Field Investigation Report: Front Street Village, LLC Page 4 of 4 Approximately 6,800 square feet of excavation is primarily high ground, existing at 4'msl and digging down to a final project depth of -8' nlw. This will result in the removal of about 2, 008 cubic yards of material. The other 15,950 square feet of excavation is subaqueous in order to connect to the USACE channel depths, existing at -4' nlw and dredging down to -8' nlw. This will result in the removal of 4,340 cubic yards and results in a final project depth of -8' nlw. The high ground shoreline will be stabilized and retained with 270' of new bulkhead. Two parallel floating docking structures will run perpendicular to the shoreline in the proposed area of excavation to support the facility. This docking facility extends 95' waterward. These two structures combine to support a total of nine boat slips and are accessed from the high ground by two articulated aluminum gangways. Each pier is 90' long and 8' wide. Both piers have three, 4' wide and 35' long finger piers to define the nine slips. The docking facility will have two associated tie pilings, one at each docking structure. The entire docking facility will be located immediately landward of the USACE federal channel setback, however Slip #1 and Slip #5 are within the USACE channel setback. This docking facility will be 16' from the adjacent riparian property line. The eastern pier will support fuel pumps. There will be no over night or live aboards allowed. This docking.facility will also serve as a staging area to support the 234-slip dry stack building. This dry stack building will be 55' landward of the new bulkhead, connected by a 4,800 square foot reinforced concrete slab. This connecting slab will support lifts transporting boats to and from the dry stack building to the staging docks. This impervious concrete slab is entirely within the 75' AEC. The proposed dry stack will be a steel frame building. It will be 428' long, 147' wide, and 40' tall. It will be able to store 234 boats. It will also house an office, restrooms, and showers. A 6' wide and 428' sidewalk will run down the eastern edge of the outside of the dry stack building. On the eastern edge of the sidewalk, there will be a 68-space gravel parking area. This will connect to Lennoxville Road to the north. At this connection, 22' south of Lennoxville Road, there will be a 10' by 30' underground fuel storage tank. Each parking space will be 10' wide and 20' long. Across Lennoxville Road on the northern section of the tract, the applicant wishes to install a new wastewater disposal area (subject to soil testing). This area will be 44,100 square feet. It will be located 100' west of Section 404 Wetlands associated with the unnamed tributary. 11. Anticipated Impacts: The intended uses include commercial wet slip dockage and dry stack storage of marine vessels. The proposal will be a hazard to navigation. The proposed excavation will remove 595 square feet of coastal wetlands. Observation of a possible significant shellfish resource in the project area should be noted. This resource has not been quantified. The proposed excavation may impact this resource. No SAV were observed in the area. This excavation will remove 2,008 cubic yards of high ground and 4,340 cubic yards of subaqueous bottom. This new shoreline will be stabilized with 270' vinyl bulkhead. As proposed, the nine-slip docking facility will shade 2,280 sf of open water, which incorporates 14,250 sf along 665' of shoreline. The upland demolition and construction activities associated with the dry stack building, septic area, and parking lot will disturb approximately 238,500 square feet of high ground. Ross Jr., Secretary SUBJECT: Comments and Recommendations - CAMA Major Permit - Front Street Village, Carteret County The following is my assessment and consequent recommendations of the above referenced proposal: This proposal involves the excavation of coastal wetlands. This proposal may also impact a shellfish resource. The waters of Taylors Creek are closed to shellfish harvest. There is no submerged aquatic vegetation. This waterbody is not a Primary Nursery Area. Slip #1 &slip #5 are within the USACE federal channel setback and will pose a hazard to navigation. Assuming that state and federal agencies concur with the proposal, .I recommend the project be authorized as proposed, contingent upon the following conditions: 1) No boat slips shall be allowed within the federal channel setback, and the authorized structures and associated activity must not cause an unacceptable interference with navigation. 2) Prior to the initiation of any dredging activities within Taylors Creek, the permittee shall, in coordination with the Division of Marine Fisheries, develop and implement an oyster relocation plan for the Taylors Creek oyster population. Contact the Division of Marine Fisheries at (252) 726-7021 to initiate the required coordination. Notice of satisfactory completion of the relocation efforts must be provided to the Division of Coastal Management prior to initiation of dredging in Taylors Creek. 3) In order to protect juvenile shrimp and finfish populations, no excavation or filling will be permitted between April 1 and September 30 of any year without the prior approval of the Division of Coastal Management, in consultation with the Division of Marine Fisheries. 4) Excavation will not exceed eight feet below the normal low water level. In no case shall the depth of excavation exceed the depth of connecting waters. 400 Commerce Avenue, Morehead City, North Carolina 28557 Phone: 252-808-2808 \ FAX: 252-247-3330 \ Internet: www.nccoastaimanagement.net An Equal Opportunity \ Affirmative Action Employer - 50% Recycled \ 10% Post Consumer Paper Front Street Village, LLC May 21, 2008 Page 2 5) The spoil disposal area must be inspected and approved by a representative of the Division of Coastal Management prior to the commencement of any dredging activities. 6) No spoil material is to be placed within 30 feet of the normal high water line, except that which will be used to backfill the area behind the permitted bulkhead. 7) All excavated materials will be confined above normal high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. 8) An earthen plug and silt screen shall be left between the area to be excavated and.the existing creek and a 24 hour period after completion of excavation will elapse prior to plug removal to prevent unnecessary siltation into the adjacent water body. 9) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 10) The bulkhead must be constructed prior to any backfilling activities. 11) The bulkhead must be structurally tight so as to prevent seepage of backfill materials through the structure. 12) The fill material will be clean and free of any pollutants except in trace quantities. Metal products,- organic materials, or unsightly debris will not be used. 13) The docking facility will display a sign showing the location of the nearest pump out facility, including other appropriate waste disposal information, at the entrance and exit from the main pier(s). 14) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 15) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 16) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. Front Street Village, LLC May 21, 2008 Page 3 17) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 18) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 19) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 20) The permittee must install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors should be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 21) This permit authorizes a maximum of ten boat slips. At no time shall more than ten vessels be moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft. 22) In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters. 23) The permitted activity will be conducted in such a manner as to prevent a significant increase in turbidity outside of the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 25 NTU's or less in all saltwater classes are not considered significant. 24) A ground cover sufficient to restrain erosion shall be provided within the shorter of 15 working or 30 calendar days of completion of any phase of grading on cut or filled slopes. 25) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, sand fence, etc.). 26) Any development or land disturbing activity that is considered non-water dependent is not authorized within 30 feet of the normal high water level unless specifically exempted by Coastal Resource Commission (CRC) regulations in place at the time of such development. 27) In order to avoid unreasonable danger to life and property, all development shall be designed and placed so as to minimize damage due to fluctuations in ground elevation and wave action in a 100-year storm. Cantilevered decks and walkways shall meet this Front Street Village, LLC May 21, 2008 Page 4 - standard or shall be designed to break-away without structural damage to the main structure. 28) Any building constructed shall comply with the North Carolina Building Code and the local flood damage prevention ordinance as required by the National Flood Insurance Program. NOTE: The building code or flood damage prevention ordinance may impose additional more restrictive requirements than the Division's standards for development in areas of environmental concern (AECs). NOTE: The permittee's contractor is advised to contact the U.S. Coast Guard at (910) 772-2220 to discuss operations and appropriate lighting, markers, etc. for all dredge equipment. NOTE: Any proposal to add one or more additional boat slips to the authorized 10 slip facility will require that the docking facility be classified as a marina, and will therefore require a review under the N.C. Environmental Policy Act (NCEPA). NOTE: If the permittee discovers any previously unknown historic or archaeological remains while accomplishing the authorized work, he will immediately notify the District Engineer, Wilmington Branch, U.S. Army Corps of Engineers at (910) 251-4511, who will initiate the required State and Federal coordination. NOTE: The permittee is advised to contact- the local health department regarding requirements for septic tank installations (as required under 15A NCAC 18A.1900 et. seq.). For information concerning septic tank and other on-site waste disposal methods, contact the Carteret County Health Department. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 808-2808 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: This permit does not convey any rights, either in real estate or material. NOTE: Should either adjacent property be sold prior to the initiation of construction, the permittee shall be required to obtain a signed riparian corridor waiver from the new property owner prior to the placement of any structures within the 15 foot riparian corridor. The property was formally the site of a large menhaden factory known as Beaufort Fisheries which was in continuous operation from the early 1930s until 2005. The property was recently purchased by Front Street Village, LLC. The fish factory property is located on the south side of the Lennoxville Road at 2500 Front Street, Sheet 1. The property also includes acreage which is located on the north side of the road. Front Street Village, LLC is currently undergoing a number of market and other feasibility studies to determine the best development scheme for this property. As such, the development of the property will most likely be in three phases. The first phase has been determined and will consist of the development of a 234 dry stack boat storage facility along with demolition and removal. Other work under this permit will involve the demolition of most of the existing structures used in the fish factory operations, the excavation of a portion of Taylors Creek and an adjacent high ground area, construction of 9 boat slips, the construction of 270 linear feet of bulkhead, and the construction of a 234 dry stack boat storage building and concrete launching ramp with an adjacent parking lot. The project is located within the Extra Territorial Jurisdiction (ETJ) of the Town of Beaufort on Taylors Creek, 2 miles east of the downtown Beaufort waterfront (see Sheet 1). The property is zoned Industrial Warehouse (I-W) and the proposed dry stack storage facility and docks are permitted uses within I-W zoning district. The building designated as the raw box and the existing wharf will be left in place. Some of the facilities to be demolished are in the AEC. Ground disturbance will be minimized during removal of those facilities. Two existing piers, 70ft x 6ft and 80ft x 3ft respectively, extend into Taylors Creek will be removed in Phase 1 as well as a series of cluster dolphins Excavation- - The subaqeous areas of Taylors Creek proposed to be excavated have previously been dredged. (See Dredge and Fill Permit No. 86-75 and CAMA Permit No. 180- 90) These areas have now silted in and maintenance dredging is desirable to facilitate and maintain historic boat dockage, Sheet 5. The upland area to be excavated is currently stabilized with a wooden bulkhead. This bulkhead will be removed and a new one constructed on an alignment landward of the existing bulkhead. The high ground between the existing and new bulkhead will be excavated to an elevation of approximately -8 feet for the boat launching area. Floating Docks and Piles - The project will consist of construction of floating docks and gangways connected to the bulkhead. The total coverage of floating docks over the water will be approximately 2,700 square feet. The total Public Trust Area to be impacted is 0.17 acres. Within the footprint of the proposed docks, two existing docks, 840 square feet, will be removed as well as 5 pile cluster dophins. Sewer pumpout and fuel delivery will be provided on the floating docks. The docks will be for staging boats from the dry storage facility. Docks will be held in place by several steel pipe or pre-stressed concrete guide piles. A concrete or steel mooring pile will be placed to separate boat slips where there are two slips between adjacent finger piers. A typical elevation of the existing boardwalk, ramp and articulated ramp is shown in Sheet 6. Upland Development - Phase 1 development will include the construction of a 64,000 square feet, (234 boats) dry stack boat storage facility. This facility will be located on the western side of the property. A large fork lift will be used to transfer stored boats to Taylors Creek. Parking for the dry stack and boat slips will be provided. Town of Beaufort requires one parking space for every four boat spaces in the dry storage building plus one space for every two employees. Parking will be provided in the area shown on the site plan. Construction of the dry stack boat storage facility will require installation of underground water, sewer and electrical utilities, grading and concrete slab construction, building construction, stormwater management facilities, landscaping and paving. Potable water will be supplied by an existing onsite well. Sewage disposal will be provided by an onsite system located on land on the north side of Lennoxville Road. Stormwater from the dry stack storage building will be collected end treated (solids removal) on site. It is anticipated that there will be some reuse of stormwater for boat washdown and irrigation. Heavy gauge aluminum gangways will connect the boat docks to the landside development. The gangways will be 6 feet wide and average 50 feet long, and will provide pedestrian and utility supply access to the boat slips. The deck elevations of the gangways will be the approximate elevations of the existing bulkhead, which will be generally about elevation 5.4 NAVD 88. EXISTING CONDITIONS Site Topography and Hydrography - The topography of the upland development site is relatively flat varying from 5 to 10 feet in elevation on the site. The Beaufort Fisheries Site consists of fine to medium sand material. The base flood elevation at the site is 7 feet (NAVD 88 datum). r Front Street Village-Phase 1 January 11, 2008 Major CAMA Permit Application - Narrative i awl' The proposed boat docks will be located in an area where depths range from 0 to 4 NAVD 88. The U. S. Army Corps of Engineers conducted a hydrographic survey in 2006 of the federal channel's Range 3, proposed project area. A hydrographic survey of the proposed marina site was conducted in 2006. Depths from both surveys, relative to the NAVD 88 datum, are shown in Sheet 2. Comparison of the bottom elevations from both surveys shows areas of both shoaling and scour. Soils and Sediments - In order to evaluate the character of the bottom sediments in the area of the proposed boat slips, three samples of the sediments were collected within the footprint of the proposed boat slips. A qualitative analysis was conducted of the sediments collected. Results indicate that the material consists of 85 percent silt with the remainder being very fine sand. Land Use - The project area is located in the ETJ area of the Town of Beaufort adjacent to the towns boat launching facility, part of an 8.2 acre tract purchased by the applicant in 2007. The project is on the waters of Taylors Creek, a federally maintained navigation channel serving the Town of Beaufort. The remainder of the land parcel is expected to be developed,. but its uses are not known at this time. Historically, the riverfront of the Beaufort Fisheries Site was an industrial waterfront site. The Beaufort Fisheries Site ceased operations in 2005. Wetlands - There are coastal wetlands on the east and west sides of Phase 1 (see Sheet 2). There are coastal wetlands that are on both sides of a man-made stream that runs through the east side of the property. There will be a small amount of wetlands impacted by this project. This wetland area is located within the confines of a railway basin which has silted in. Areas of Archeological or Historic Value - The proposed project is not located within a designated Historic District of the Town of Beaufort. Only floating docks anchored by piles will be used for dockage. The federal channel boundary line runs along the entire southern margin of the proposed project site. The federal channel is 100 feet wide with an average depth of 15 feet at mean low water. The channel in front of the project propertyhas not been dredged for many years because naturally occurring flows tend to maintain the channel depths without the need for dredging. STORMWATER MANAGEMENT Approximately 1.5 acres of impervious areas will be part of the upland development. A state of the art stormwater treatment unit will be used to treat stormwater for the upland development. A stormwater management plan approved by the Division of Water Quality will be required for the upland development of the Beaufort Fisheries site. METHODS OF CONSTRUCTION Dock and bulkhead construction will be by conventional marine construction methods. Most dock construction will take place from the water side with barge mounted equipment and access. Pile driving and dock installation will be accomplished with barge mounted equipment. Bulkhead construction will take place mainly from land. Excavation will utilize a barge mounted excavator on the water side of the bulkhead. Dredged material will be offloaded on site and disposed at an upland site approved by DCM. Shoreline restoration excavation will utilize traditional construction equipment. Upland excavation will be conducted in the dry.
