Impact Justification and Mitigation 1. Avoidance and Minimization 1 a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. The applicant has designed the proposed residential sub -division to avoid other impact to streams and wetlands, specifically associated with lot/pad fill. The applicant has further demonstrated avoidance and minimization of stream impacts by proposing to construct approximately 5 and 12 feet tall culvert head/end walls. Additionally, the applicant has designed a plunge pool that further reduces stream impact compared to other typical dissipators. The applicant has designed the stream crossing in a relatively straight portion of the stream that does not contain adjacent wetlands. The remaining approximate 2,852 linear feet of stream and 3.75 acres of wetlands are being avoided. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. The clearing limits will be staked and silt fence will be used. A temporary coffer dam will be installed upgradient of the proposed culvert. During construction, water will be pumped around the construction footprint. Appropriate stream bank protection will be provided in the channel during construction and all excess excavated material will be immediately removed from the stream bank crossing area. Upon completion of the culvert installation, the temporary sand bag coffer dam will be removed and flow will be diverted through the culvert. Following construction, disturbed banks will be restored to similar pre - construction conditions, matted and seeded/live staked. 2. We consulted the Natural Heritage Program Website to determine if federally protected endangered or threatened species inhabit the Lake Brandt, NC Quadrangle (the quadrangle that contains the site) and Bethany, NC Quadrangle (the quadrangle north of the site quadrangle). The Bald Eagle is listed on the Lake Brandt, NC Quadrangle as being protected under the BGPA. Based on the size of water bodies on the site and the applicants avoidance of water bodies on the site, it is our opinon that the proposed project will not disturb the bald eagle. Federally listed species were not identified on the Bethany, NC Quadrangle. Therefore, it is our opinion that the proposed project will have no effect to federally listed species. 6.
