Dear Mr. Reiter:
On March 28, 2008, the Division of Water Quality (DWQ) received your application dated February 28,
2008, to fill or otherwise impact 0.0177 acres of 404/wetland, 110 linear feet of perennial stream, and
7,180 square feet of Zone 1 Neuse River basin protected riparian buffers and 4,605 square feet of Zone 2
Neuse River basin protected riparian buffers to construct the proposed residential development at the site.
The DWQ has determined that your application was incomplete and/or provided inaccurate information
as discussed below. The DWQ will require additional information in order to process your application to
impact protected wetlands and/or streams on the subject property. Therefore, unless we receive five
copies of the additional information requested below, we will have to move toward denial of your
application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we
receive this additional information. Please provide the following information so that we may continue to
review your project.
Additional Information Requested:
1. Please provide clear labels for the level spreaders on the plan sheets so that they can be easily
cross-referenced with the forms and calculations.
2. Based on the topographic information provided on Plan Sheet C-41), the filter strips are too steep
to allow for diffuse flow at two level spreaders: the level spreaders at Pond 1 and ADS 1. Please
either relocate these level spreaders to locations where the filter strip slopes are appropriate for
level spreaders or provide BMPs that remove a minimum of 85 percent TSS and 30 percent TN
from the stormwater generated by this project. In order to demonstrate that you have an
appropriate BMP design, you may either:
a. Provide a completed BMP Supplement Form, with all the required items for review by the
DWQ. The BMP Supplement Forms are available at:
http//h2o.enr.state.nc.us/su/bmp_forms.htrn. Please include both the Design Summary and
the Required Items Checklist along with all the required items listed therein.

Provide one copy of a stormwater management plan showing appropriate BMPs that has
been approved by the City of Raleigh, including plan details, calculations and other
supporting information.
3. The dissipater pad down slope of ADS 41 should not be placed directly on a fill slope.
4. It is not possible to evaluate the suitability of the filter strip down slope of the level spreader at
Pond 3. Plan sheet C-4D does not show the entire filter strip to the top of stream bank. If there
are appropriate filter strip slopes, then see Item (5). If the filter strip slopes are too steep for level
spreaders at this location, then please see Item (2).
5. The level spreader at Pond 3 is directly flow directly toward the dissipater pad down slope of the
outlet of the flow splitting device. Please reconfigure the design to avoid this problem.
Please submit this information within 30 calendar days of the date of this letter. If we do not receive this
requested information within 30 calendar days of the date of this letter, your project will be withdrawn
and you will need to reapply with a new application and a new fee.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters
or protected buffers. Please be aware that any impacts requested within your application are not
