Authorizing development in New Hanover County at Cape Fear River along Wilmington
waterfront , as requested in the permittee's application letter dated 3/26/08, including
attached workplan drawings (7) Drawings 1-6 all dated revised 1/4/08 & Drawing M1 dated revised 3/20/08
This permit, issued on May 212008 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
1) Unless specifically altered herein, this minor modification authorizes the following modifications to
the originally permit design, all as specifically depicted in the application letter dated 3/26/08 and the
attached"workplan drawings:
a. A revision of the previously authorized marina basin dredge limits,
b. A revision of the location of dredge disposal areas,
c. A revision in the alignment of a section of the previously authorized bulkhead, and
d. A reconfiguration of the previously authorized marina, resulting a a reduction in the number
of authorized open water boat slips from 204 to 195.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2010
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.
Signed by the authority of the Secretary of DENR and the
Chairman of the Coastal Resources Commission.

2) The permittee is reminded that Condition No. 11 of the original of Permit 44-07 remains in force under
this minor modification. This condition reads as follows:
In accordance with commitments made by the permittee, 32 slips shall be designated as transient
docks. This transient designation shall remain in force for the life of the permitted project.
3) This minor modification does not eliminate the need to obtain any additional state, federal or local
permits, approvals or authorizations that may be required, including any authorizations that may be
required from the U.S. Army Corps of Engineers, or any authorizations resulting from the handling,
containment, and/or disposal of contaminated materials.
4) This minor modification shall be attached to the original of Permit No. 44-07, which was issued on
3/30/07, and copies of both documents shall be readily available on site when a Division representative
inspects the project for compliance.
5) All conditions and stipulations of the original permit remain in force under this minor modification
unless specifically altered herein.
