(CEC), on behalf of Mr. Craig Woolmington, requesting written authorization for the construction of permanent road crossings associated with the development known as Ridgecrest. The DWQ determined that the application was incomplete and/or provided inaccurate information and requested three additional items for review. Each additional information request will be discussed below. 1. "Application Item II., requests Owner /Applicant Information. You have supplied that Woolmington-Smith Ventures, LLC is the owner and applicant of the property in question. On your supplied agent authorization document, you indicated that Woolmington-Smith Family Trust is the property owner. Neither company / entity is registered with the North Carolina Secretary of State to do business in the State of North Carolina. " "Additionally, the registered owner for the property in questions is Craig and Barbara Woolmington-Smith, Trust not either of these names listed in the application or supporting documents. " "You must provide clear and accurate owner information in both the application and the Agent Authorization. Any business or entity desiring to do business in North Carolina must be registered with the North Carolina Secretary of State. A copy of the warranty deed that names Craig and Barbara Woolmington-Smith as Trustees of the Trust, which owns the subject property, is attached for review (Appendix A). A revised copy of the permit application and agent authorization with correct owner/applicant information is included for review (Appendix B). A local Waynesville address is listed on the warranty deed; however, the applicant has requested that any correspondence be sent to the Orinda address listed on the application. 2. "Application Item IV., Prior Project History requests that all previous property related governmental actions (Jurisdictional Determination, Permits, wetland, stream, and buffer impacts, associated mitigation) be detailed. The supplied information describes the Notice of Violation issued by the Division, but does not indicate that any other actions have been taken. Please provide a more concise description of the governmental actions taken with respect to this property. " The most complete prior project history available to CEC at the time of application was supplied in the permit application within the "Prior Project History" section. The following excerpt was taken directly from the application dated April 9, 2008. "On January 24, 2008, a site visit was conducted by Kevin Barnett and Linda Wiggs of the DWQ; David McHenry of the WRC; and Marc Pruett and Jennifer Bradish of the Haywood County Erosion Control Office. On January 28, 2008, the DWQ issued a Notice of Violation; no DWQ Project number was identified on the NOV. On February 12, 2008, Mr. Craig Woolmington submitted a response to the NOV. On February 29, 2008, C1earWater Environmental Consultants, Inc. (CEC) had a telephone conversation with Kevin Barnett of the DWQ regarding the response. Mr. Barnett indicated that the February 12, 2008 response was sufficient to meet the condition that required Mr. Woolmington to respond with 30 days. CEC indicated that a permit for the unauthorized activity is forth coming." On February 19, 2008, Ms. Rebekah Newton and Mr. Clement Riddle of CEC delineated the subject property. This information was inadvertently omitted from the prior project history. On May 16, 2008, the US Army Corps of Engineers issued an after-the-fact Nationwide Permit 29 for impacts at the property. And, on May 22, 2008, the DWQ issued a "Request for More Information" to which this letter responds. To the knowledge of CEC, no other "governmental actions" have taken place at the project site. 3. "Application VI., 1. Proposed Impacts request that a description of the needed impacts be detailed. You have stated that these wetland impacts were necessary to access Lots 2, 20, 23, and 27. The supplied details indicate excessive fills were place to achieve these goals. You must provide a complete plan for property access, which will provide for the maximum restoration of filled wetlands possible not necessary to achieve the project need, in order to resolve the issued Violation. This discussion should include, but not be limited to, further sharing of driveways, re-arranging lot lines, restoration plans, etc. " The impacts associated with this project include the installation of driveways that have impacted wetlands. The existing driveways will provide access to lots 2, 27, and the unnumbered lot between lots 27 and 18 (lot 23). Lot 20 will be accessed via a shared driveway with lot 2; the driveway for lot 2 has already been constructed. Lots lines were redrawn to avoid further impacts to wetlands at the site. Due to topography and its position in the landscape, the existing driveway for lot 27 is not able to be shared and serve lot 22. Additionally, a shared driveway for lots 20 and 22 would require additional wetland impacts, which the applicant is trying to avoid. To access lot 22, a driveway will be constructed in an area that has already been impacted; lot lines were redrawn to make this possible Construction of this driveway will not require additional wetland impacts at the site. Approximately 0.07 acre of wetland was impacted to provide access to lots 22, 27, and the unnumbered lot (lot 23). Due to the topography at the site, extensive grading is necessary to construct driveways and provide access to lots. What appears to be "excessive fills" is necessary because of grading activities. The driveways and fill slopes of these three lots, 22, 27, and the unnumbered lot (lot 23), also prohibit any significant and meaningful wetland restoration. Wetland restoration in these areas would require removal of some fill slopes, which would jeopardize the structural integrity of the driveways that access the lots. A "blow up" of the site plan for lots 2, 20, 22, 27, and the unnumbered lot (lot 23) is included for review (Figure 1). This map indicates the proposed location of driveway access for lots 20 and 22, which currently do not have driveway access. The information discussed above was provided to Mr. Kevin Barnett via telephone and email on May 21, 2008. Wetland impacts at the site are minimal. Over half of the wetlands on the site have been avoided and the applicant has made every effort to resolve the violation in a reasonable manner, which does not involve further impacts to wetlands on site. The information submitted in this package addresses all issues setforth in the "Request for More Information" letter. Project Information 5 7 Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. The site was historically maintained as pasture. The land use in the vicinity is mostly residential with some commercial properties. 10. Describe the overall project in detail, including the type of equipment to be used: The project includes impacts to wetlands as a result of the development of a single-family residential subdivision and all associated infrastructure. The applicant will also install a culvert pipe in an existing driveway to restore the hydrology to a previously impacted wetland. Impacts to wetlands have been completed; the applicant is seeking after-the fact- authorization. 11. Explain the purpose of the proposed work: The purpose of the proposed work was to provide driveway access to residential home sites. Wetland impacts have been completed on site. The purpose of culvert installation is to restore hydrology to the wetland system that was disrupted through the installation of a driveway. IV. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. If so, describe the anticipated work, and provide justification for the exclusion of this work from the current application. No future project plans are anticipated at this time. VI. Proposed Impacts to Waters of the United States/Waters of the State It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to wetlands, open water, and stream channels associated with the project. Each impact must be listed separately in the tables below (e.g., culvert installation should be listed separately from riprap dissipater pads). Be sure to indicate if an impact is temporary. All proposed impacts, permanent and temporary, must be listed, and must be labeled and clearly identifiable on an accompanying site plan. All wetlands and waters, and all streams (intermittent and perennial) should be shown on a delineation map, whether or not impacts are proposed to these systems. Wetland and stream evaluation and delineation forms should be included as appropriate. Photographs may be included at the applicant's discretion. If this proposed impact is strictly for wetland or stream mitigation, list and describe the impact in Section VIII below. If additional space is needed for listing or description, please attach a separate sheet. 1. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. Lot 20 will share a driveway with Lot 2 and Lot 22 will be accessed through an area that is already impacted. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete.
