requixements of North Caralt,na General Statute 143-215 .1 and the Memorandum Qf Agreem�nt between
Nortis Carolina and the US Environmental l'rotection agency dated May 9, 1994 (or as subsequently
amended}.

PART X PERMxT'I'ED ACTIVITIES
During the period beginning on the effective date of the permit and lasting until expiratian,
NCDOT is authorized to discharge stormwater fram:
� General roadway includirag weigh stations and toiling facilities
• Canstructi4n activities disturbing greater than one acre
• Borrow pits/waste piles (including mines)
• Industzial iacilities wit� the following acti�ities
- Ferry tern�.ina.Is and maintenance
- Vehicle and equipment maint�nance
- Pesticide and fertilizer stQra�e
- Salt and dei�ing chemical storage
- Material storage areas
- Asphalt and concrete plants {NCIJtJT owned and operated anly)
- Rail maintenance
• Non-roadway non-industrial facilities �i.e., affi�e buildings and rest areas}
• General railway
Waste pile activities shall be covered under this permit unless the site requires a permit froan the
Division af Waste Management. If a Division of Waste Managem+ent permit zs required, the
facility also rnust file an applicatian with Division of Energy, Mineral and Land Resources
{DEMLR) for co�erage under a sepa.3rate NPDES stor�mwater permit.
All new general roadway and railway draina,ge, canstruction and bvrr+�w pitlwaste pile activities,
industrial facility drainage, and non-raadway non-industrial faciiity d�rainage will recei�e
automatic cc��erage under this permit. Loc�tion infarmation for NCDOT facilities will be pro�ided
tfl DEMLR upan rec�uest.
All discharges authQrized herein shall be adetiquately treated and managed in accordance with the
terms and conditions tifthis permit. Any other point source discharge ta sur�ace waters of the
state is prohibited unless it is an allawable non-stormwater discharge or is covered by another
permit, authorizat�on ar app�roval.
Caverage of the following activities supersedes the requzrements to seek discharge authorization
under the following NCDENR general perrnits, txnless specifically r�quired by the Directvr:
• NCG020000 (applicable to stormwater point source diseharge outfalls associated with
mining and quanrying of nonmetallic minerals (except fuels), land disturbance, and
vehicle maintenance, mine dewatering discharg� nutialls, wastewater discharge autfalls
from sand andlar gravel aperatians, nondischargi�g elased loop recycle systems, az�d
process recycle wastewater discharge outfalls};
• NCGO$OODO for owners or c►perators of stormwater poant source discharges associated
with activities that have Vehicle Maintenance Areas; and,
• NCG5�6aQ00 ta discharge pesticide products.

water quality standards, DEMLR may take enforcernent a�tian or P�iCDOT and DE14�LR shall
conduct an asses�ment and implerrtent the perrnit requirements ne�essary to adequately address
the permittee's cantribution to the water quality standards �r�ola.ti4n.

Sediment PailutiQn Control Act of 1973 and Chapter 4 of Title 1 SA of the
Nt�rth Carolina Administrati�e Cvde. This program includes pracedures
fQr public input, sanctians to ensure compliance, requirements for
constructivn site operators to iYnplement appropriate erosian amd sedirnent
cQntrol practices, review of site plans which incorporates consideration of
potential water quality impacts, and procetiures for site inspection ,and
enfarcement of control measures. This program has been delegated to and
implemented by NCD�T,
ii. NCDl7T s�all incorporate the applicahle requirements af NCGOl00Q0, the
Narth Carolina General Fermit to Dischaxge Stormwater under the
National Pollutant Discharge Eliminatit�n System associated with
c�anst�ruction acti�vities issued August 3, 2011 and as rnay be subsequently
amended, into its delegated ErQsion and Sediment Control Program,

and the potential pollutant sources which may be expected to contribute to
c�ntaxnination of str�rrnwater discharges. Th� site plan sha11 contain the

drafted equi�alent map}, showing th� facility's location in relatic�n
to transport�tion routes and surface waters, the name of the

drainage shuctures, drainage areas for each outfall and activities
occurring in the drainage area, building locations and impervious
surfaces, and the percentage of each drainage area that is

potential pollutants which could be expected tc� be present in the
stormwater discharge.
+(d) A list of significant spilis or leaks af pollut�nts that ha�e occYu�xed
at the facility dwing the 3 previous years and any corrective
activns taken ta mitigate spill impacts.
(e} Certification that the stormwater outfalls and discharge paint{s)
ha�re been evaivated for the presence of non-stormwater
discharges. The certificatian statement in Part III, Section A,
�aragz'aph G(c) will be signed by NC�}C3T Di�isi�n points c�f
cvntact.
ii. Stormwater Management Plan. The stormwater management plan shall
contain a narrative description of the materials managernent practices
ernploy.ed which confial or minirnize the exposure of significant materials
ta starnxwat.�r, zncluding structural and nanstructura] measures. The
stormwater management plan, at a minimum, sha11 in.corporate the
following:
(a) A rerriew of the technical and economic feasibility of changing the
methods �f aperatians and/ar stc�rage practices to eliminate or
reduce exposure afmaterials and processes to starmwater.
Where�er practical the pezmit�ee shall cc��er all storage areas,
material handling apera�.vns, and manufacturing or fueling
aperatians to pre�ent rnaterials exposure to stormwater. In areas
where eliminaiion af exposure is nat practical, the stormwater
management plan shall document the feasibility of diverting the
stormwater n�noff away from areas of patential contaminativn.
(b) A schedule to provide s�condary containment for bulk starage of
liquid materials, storage of Sectian 313 of Title III af the

practices (BMPs) to be cansidered such as, but not limited to, oil
and grease separation, debris control, �egetati�e filter strips,
infiltration and stormwater detention or retention, where necessary,

(e} Vehicle and Equipment Cleaning Areas. The Plan. must describe
measures that prevea�t or minimiz+� cflntamination af the
stormwater runofffrom all areas used for Vehicle and equipment
cleaning. The facility shail ct}nsider performing all cleaning
operations indoors, covering the cleaning operation, ensuring that
all washwater drain to the sanitary sewer system (i.e., nat the
stormwater drainage system, unless penn�itted by another NPDES
general or in.dividual permit), co�Iecting the starmwater runoff
from the cleaning area and prvviding treatrnent or recycling, or
ather equi�alent measures. If sanitary sewer is nat aVailable to the
. facility and cleaning aperatians take place �utdoors, the cleaz�ing
aperativns shall take place an grassed or gra�veled azeas tv prevent
poant source discharges vf the washwater into the stortn drains �r
surface waters. Where cleaning �perations cannot be performed as

panded water shall be remo�ed and properly handled, e.g., by
pump tc� a sanitary sewer syst�m or other }aroper dispasal method,
prior to rernvving the drain cover. Detergents used au�doors shall
be biodegradable and the pH adjusted to be in the xange of G tc� 9
standard units. The point source discharge of vehicle and
equipment wash waters, including tanic cleaning operations, are
not authorized by this perrnit and must be co�ered under a sepaz�ate
NPDES general or indi�idual permi# az discharged to a sanitary
sewer in accordance with applicable industrial pretreatment
requirernents.
iii Spill Pre�ention and Response Plan. 'I'�e Spill Prevention and Response
plan shall incarporate an assessment c�f patential poliutant saurces based
an a materials inventory of the facility. Fa�ility personnel (or team}
responsible for implementing the plan shall be identified in the plan. A
responsible person shall be on-site at all times during facility operations
that ha�e the potera�ial to contaminate starmwater runoff through �pills or
exposure of materials associated with the facility operatians.
iv. Preventative Maintenance and Go4d Housekeeping Frogram. A
pre�entati�e mair�tenance program shall be de�eloped. The program shall
dacurnent �chethties of inspections and maintenance activities of
stormwater can#rol sys�ez�ns, plant equipment and systems. Inspectivn of
maierial handling areas ar�d regular cleaning schedules of these areas shall
}�e incorporated into #he program.
�. Emp�oyee Training. Training sehedules shall be de�elaped and txainzng
praUided at a minimum on an annual basis an pra�per spill response and
�leanup procedures az�d preventative maintenance acti�ities for ail
personnel in�olVed in any of the facility's operations that haue the
potential to cc�ntaminate stormwaier runoff. Facility personnel (or team}
responsible far implementing the training shall be identified i� tla� Plan.
�i. Respvnsible Party. The Starmwater Pollution Pre�ention Plan shali
identify a specific pvsition{s} responsible fvr the o�verall caordination,
de�elopment, implernentation, and re�ision to the Plan. Responsibilities
for all camponents vf the Plan shall be documented and. position(s}
assignments pro�ided.
vi� Plan Amendment.
(a) The permittee shali amend the Plan whenever there is a change in
design, eonst�uction, operation, or maintenance which has a
significant effect an the patential for the discharge ofpollutants to
surface waters. The Stvrmwat�r P�llution Preventian Plan shall be
r�viewed and updated an an annual basis.

(b} The L3irectar may notify the permittee when the Plan does not meet
one or mare af the min�mum requir�ments of the permit. Within
30 days of such natiee, the permittee shall submit a time schedule
to the Director for modifying the Plan to meet minimum
requirements. 'The pezrnittee shall pra�vide certification in writing
(in accordance vvith Part III, Section A, Paragraph 6) to the
Dire�tar that the changes have been made.
viii Facility Inspectians. Inspections of t�ae facility and all storr�wa#ear systems
shall acc�xr at a rninimum vn a semiannuai schedule, once in the fall
�5e�atember-No�ember) and oncc; during the spring (Apri1= June}. The
inspection and any subsequent maintenance acti�ities perfarmed shall be
dvcumented, recording date and time of inspection, individual{s) making
the inspection and a nazratiye descriptian of the facility's stormwater
control sys#ems, plant e�uipment and systems. Recards of these
inspections shall be incarporated into the Stormwat�ex Pollution Prevention
Plan or maintained in a retrie�able electranic �rersion.
i�. Implementativn. Irnpletnentation c�f the Flan shall include documentation
of alI monitoring, rneasurennents, inspectians and maintenance activities
and trauung provided to employees, including the iog of the sampling data
and of activities taken io implement BMPs associated witYi the industrial
acti�vities, izzcluding vehicle maintenanee acti�ities. Such documentation
shall be kept on-site far a p�riod of five years and made available to the
Directar or his authorized representative immediately upon request.
3. Qualitati�e Manitaring
a. Objec�ive
(i} E�aluate the effecti�eness of the indus�ial Stormwater Pollut�on
Pre�ention Plans (SPPP} for each industrial facility.
(ii) Perform xequired quaiitati�e monitoring at stormwater discharge paints ar
vutfalls identified in the SPPPs ar d�aring supplemental inspections as
required in Part II.D.2.i.
b. Qu�litatiVe manitoring shall be perfc�xrned at each industrial stormwater
outfall or discharge point twice per year, ance in the s�ring (April -]une)
and once in the fall (September - November). Qualitati�e monitoring
rec�uires an inspection of each storrnwater ouifall or discharge paint far the
parameters listeci in paragraph (c}. Qualitati�e monitvring is far the
purpose c�f e�aluating the effectiveness of the SPPP. Nv ana�ytical tests

It is the responsibility of the permittee to keep abreast witla the de�elopment of the 303(dj list as
well as with the issuance of TMDLs.
1, At any time during the effec#iVe dates of this perxxiit, NCD�T will de�etop and implemez�# a
prograrrm ("Pragram"} to address impaired waters idexxtified in TMDLs in which NCDQT
is named as a significant contributor of the pollutant address�d by the TMDL and that
assigns NCDOT a wastelaad allocation (WLA) separate frvm other point sources.
2. NGD{7T's Program shall summarize the lacatians of NCDC}T autfalls that are identified
in its implicit Stormwater 4utfall In�entory that have the patenti�l ta discharge the
TMDL pollutant of concern into the impaired segrnents, to their tributaries, and to
segments and tributaries within the watershed contributing to the impaired segnents.
3. NCDOT's Program shall irnplernent an Assessment & Monitoring Plan ("Plan"}. T"he
Plan shall inciude an eValuation vf ihe need far additianal data collectian related to the
NCDOT's discharge of the TMDL poilutant af �ncern. Additic�nal data collection t4 be
evaluated rnay include (but does not require) a supplemental inventory of NCD�T
outfalls, monitoring, an assessment of the effectiVeness of existing BMPs, and an
assessment flf non-NCDQT dischaarges entexing NCD(7T's con�eyance system and
negati�ely impacting the quality of NCDOT stormwater discharge. If the Plan praposes
analyti�al monitoring, then it shall include a description af the sample types, frequency,
and seasonal cc�nsiderations, if applicable. Wh+�re ap�rapriate, NCD�T may reduce its
monitoring burden by monita�ing outfalls that DEMLR considers substantially similar to
other outfalls. The Plan may be adjusted as additional outfalls are identified.
4. 'The Plan shall inclnde a schedule for implementing the proposed assessment and
m4nitoring acti�ities. The Plan shall be submitted to DEMLR for cammenfs no later
than 12 rnonths a�ter notificaiion by NCDEIVR that NCDOT has �beex► assigneti a WLA
DEML�t shall camplete its review of the Plan within 6 manths of recei�ing the plan from
NCD�T.
5. NCDflT shall initiate implementation of the Plar� within b mvnths af receiving Plan
appro�al fram DEIVILR. In accordance with the Plan implementation schedule,lVCDQT
shall pro�vide a surnmary af the assessment and mvnitvring a�cti�vzt�es performed within a
reporting penod in subsequent annu�I reports.
Within d months of completing the assessment and manitoring activities outlined in the Plan,
NCD�T shall submit a report of its findings to DEIVILR. The report shall include an assessnnent
of whether additional structural andlar non-structural BMPs a.z'e necessary to meet NCDaT's
WLA. If neeessary, the rept�rt will also document why BMPs are infeasible to mee# the WLA
and discuss BMPs to reduce the load t� the maximum extent practicable. The report shall
include a schedule for implementing such BMPs. Upon appra�al by DEMLR, NCDUT shall
implement any appraved BMPs in accordanee with the schedule. Subsequent aru�ual reports will
pro�ide updates on the implementatian af tr�ie Plan.

SECTIUN A COMPLIANCE AND LIABILITY
1. Duty ta Camply
NCD�T must comply with all canditians oFthis permit. Any permit nancvmpliance
constiiutes a �iala�ion of the Clean Water Act and is g.r�wnds for enforcement action; for
permit termination, revocation and reissuance, or rnodi�icataon; or denial of pern�it
co�erage upon renewal application,
a. NCD�T shall comply with standards or prohibitions established under section
3D7�a) of the Clean Water Act #'or toxic pollutamts w7iitlun the time pro�ided in the
reguiatians t�at establish these standards or prohil�itzons, e�ert if the permit has
not yet been modified to incorporate the requirement.
b. The Ciean Water Act pro�ides tl�at a�ay person who �iolates section 301, 3Q2, 306,
307, 308, 318 or 405 of the Act, or any pez7mit Gandition or limitation
irnplexraenting any such se�tians in a permit issued under section 402, or any
r�quirement impased in a pretreatment program appro�ed under sections
402{a)(3) or 4D2(b)(8) of the Act, is subject to a civil penalty not ta exceed
$27,50{? per day for eac� �iolataion. The Clean Water Act provides that any person
who negligently �iolates sections 3�11, 3Q2, 306, 307, 308, 31 S, or 405 of the Act,
ar any condition or Iimitation implementing any of such sectians in a permit
issued under section 402 of the Act, or any requirement impvse� in a pre#reatrnent
prvgram apparoved under section 402�a}(3) pr 402(b)(8) a�the Act, is subject to
crimin�l penalhe5 Of $2,500 tQ $25,OD0 per day of �iolativn, or imprisonment of
not more than 1 year, or bath. In the case of a secflnd or subsequen# convietian for
a negligent �iolation, a person shall be subject to criminal penatties of not more
than $50,{}00 per day of �iolation, or by imprisonment of nat more than 2 years,
ar both. Any person who knowingly violates such sectians, t�r sueh candi�ions vr

person in imminent danger of death or serious bodily injury, shall, upon

more than 15 years, or bvth. In the case of a second or subsec�uent c�n�iction for a

af this permit which has a reasonahle likelihood of adversely afFecting human health or
the environrnent.
3. Civil and Cirim�inaX Liability
Except as provided in Part IV, Section B, Paragraph 3+�f this permif regazding bypassing
of stozmwater contxol facilities, nv#hing in this penmit shall be canstrued to relie�e the
perrnittee frmm any responsihilities, liabilities, �r per�alties ft�r noncampliance pursuant to
NCGS 143-2153,143-215.6A, 143-215.65, 143-215.6C or Sec�ion 309 of the Federal Act,
33 USC 13I9. Furthermore, ihe permittee is respansible for consequential damages, such
as fish kills, even though the responsibiiity f�r efFect�ve complianee may be ternporarily
suspended.

Nathing in this per�nit shall be eonstrued to preclude the instiiutian of any legal actioa� or
relie�ve the permittee frorn any respansibilities, liabilities, or penalties to which the
permittee is or may be subject to under NCGS 143-21�.75 et seq. or Section 311 af the
Federal Act, 33 L7SC 1321.
5. Property Rights
The issuance af thi.s pennit does nvt con�vey any property rights in either real or personal
property, or any exclusive priuileges, nor dves it autharize any injury to private property

regulations.
b. Severability
The prowisions of this permit are se�erable, and if any pravision vf this permit, or the
application of any provision of this permit to any circumstances, is held invalid, the
application af suck► pr��vision to other circumstances, and the remainder of this permit,
shall not be affected thereby.
7. Duty ta Prvvide Information
The pernrnutittee shall furnish ta the Directoz, within a rea�onable time, any information
which the Director rnay request to determine �rhether caus� exists for modifying,
revoking and reissuing, or terminating the co�erage issued pursuar�t fa this permit or ta
determine campliance with this permit. The permittee sha11 alsv fiirnish to the Directvr
upon request, cflpies af records required by this pertnit.
S. Penalties for Tam.pering
'I'he Clean Water Act provides that any pers�n who falsifies, tampers with, or knowiz�gly
renders inaccurate, arty monitoring devic� or method required to be maintained under this
permit shall, upon can�iction, be punished by a fine of not more than $10,00� per

maintenance alsa includes adequate Iaboratory �nirois and appropriate quality assurance
procedures. This pro�ision requires the operation of back-up or auxitiary facilities or
simiiar systems that are installed by a permittee only when the operativn is necessary to
achie�ve compliance with the conditions af the permit.
2. Need ta Halt ar Rerluce not a Defense
It s�all nat be a defense far a pern-►itiee in an enforcement action that it would have been
necessary to halt or retiuce the pernxit�ed acti�vit}i in order to maintain compliance with the
conditian af thi� permit.
3. Byp�ssing of Stormwater Control Facilities
Bypass is prohibited and the Directar may take enforcement ac�ion against a permittee far
bypass unless:
a. Bypass was unavoidable to prevent Iass aflife, personal injury or severe property
darnage; axad
b. There were no feasible alternatives t� the bypass, �uch as the use of auxiliazy
contral facilities, retention of starmwater or maintenance during nflrmal periods
of equipment dawntime or dry weather. This cr�ndition is not sati�fied if adequate
backup contzols should ha�ve been installed in the exercise af reasonable
eng�neering judgment to prevent a bypass which occwnred dtair�ng z�orrnal peri�ds
of equipment dawntime ar pre�enri�e maintenance; and
c. The p�r�mittee submitted notices as required under Part III, Section A of this
permit.
d. The Director may appro�e an anticipated byp�ss, after considering its ad►rerse
effects, if the Director determines that it will meet the three conditians Iisted
above.

1. R.epresentative Sampling
Samples collected. and measurements taken, as requared here�in, shall be characteristic o�
the voIume �und nature of the permitted discharge. Analytical sampling sha11 be
perfQrmed during a representative storm e�rent. Samples shall be taken on a day arzd time
that is ehaxacteristic of the discharge. AIt samples shall be taken before the disc}�azge
jains or is diluted by any other waste stream, bady of water, ar substance. Monitoring
points as specified in this permit shall not be Ghanged r�rithout natification to and
appra�al of #he Directar.
2. Flt�w Measurements
Where r�quired, appropriate flow rneasurement devices and methods consistent with
accepted scientific practices shall be selected and used tc� ensure the accuracy and
reliahiiity of zneasur�ments af the �alume of monitored discharges.
3. Test Procedures
Test prpcedures far the analysis of pollutants shall confarm to the EMC regulations
published pwrsuant ta NCGS 143-215.G3 et. sec�, the Water and Air Quality Reporting
Acts, and to regulati4ns published pursuant ta Section 304(g), 33 USC I314, ofthe
Federal Water Pollution Contral Act, as Amended, and Regulatian 40 CFR 136.
Ta meet the intent of the monitoring required by this permit, all test pr�eedures must
produce minimum detectian and reporting le�rels and all data generated must be reported
down to the minimum deteetion or lvwer reporting le�el of the procedure.
4. Inspectian and Entry

An impiicit outfall is a geospatial point listed in the irnplicit storm�water outfall in�ventory.
implicit outfalls are not verified in the field as meeting the definition of an outfall.
17} 1Vlunicipal Separate Storrn Sewer System
Municipal separate storm sewer means a conveyance or system af canveyances
(includiag roads with drainage systems, municipal streets, catch l�asins, cur�s, gutters,
ditches, maxz-made ch�.rmels, or storrr� drains}:
(i) Owned Qr operated by a State, city, town, i�vrough, county, parish, district,
associa�ion, or other public body (created by vr pursuant to State law} ha�ving
junsdiction o�er dispasal of sewage, industrial wastes, starm water, or other wastes,
including spe�ial districts under State law suGh as a sewer district, fload cantrol
district or drainage distxict, or similar ez�tity, or an Indian tribe or an authorized
Indian tribal organizati�n, or a desxgnated and approv�d management agency under
sectian 2�8 af the CWA tha# di�charges tv wate;rs of the United States;

2Z} Representative Storm Event
A storm event that measures greater than �. � inches of rainfall and tha# is preceded by at
least 72 hvwrs in which no starm e�ent measuring greater than 0.1 inches has occurred. A
singte storrn euent may contain up to 10 cpnsecutive hours af no precipitati�n. Far
example, if it rains far 2 hours withaut produGing any ct}llectable discharge, and then
stops, a sample may be collected if a rain producing a discharge begins again within the
next 10 hours.
23} Retrofit
A retrofit is a structural ar non-structural bes# managernent practice which provides
stormwater treatment or aids the Department in its pollukian pre�entian objectiVes, and is
canstructed on existing develapment or put into practi� within existing palicies and
procedwres. Retrofit best managenr�er�t practices are typically constructed or put inta
practice some perivd vf time after tt�e original de�elopnnent acti�ities we�re cannpleted and
were not part of the original de�elopment plans.

Wildtife Service or the Natimnal Tvlarine Fisheries Sei-�ice under the provisions of
the Endangered Species Act af 1973 (Pub. L. No. 93-205; $7 Stat. 884; 16 U.S.C.
§§ 153 i, et seq.), as amended.

A camprehensi�e site-specific plan which detaiis measures and pra�tices to reduce
stormwater pollution and is based on an evaluatian of the poliutic�n potential of the site.

storm drains):
