SUBJECT: Request for Emergency Declaration for Dredging Operations
1. The purpose of this memo is to request your declaration of an emergency, which will
allow for emergency dredging operations within the Federal Navigation project: Manteo
(Shallowbag) Bay, NC. The work in this navigation project would be conducted in
accordance with 33 CFR Part 337.7, Emergency Actions. The emergency action is
needed in Range 14A of the Manteo (Shallowbag) Bay, NC project, which is the
entrance channel for Wanchese Harbor. Currently, the Wanchese Harbor fleet cannot
safely transit the channel due to rapid shoaling from Hurricane Matthew.
2. President Obama has declared Hurricane Matthew as a Major Disaster in the States
of Florida, Georgia, South Carolina, and North Carolina. The Corps was notified in
writing by the Office of Governor Pat McCrory on October 14, 2016 that shoals due to
Hurricane Matthew have significantly affected the ability of the Wanchese Harbor's fleet
to navigate safely in federally maintained channel. Wanchese Harbor is utilized by the
U.S. Coast Guard (USCG) navigational aid vessel, fishing industry including trawlers,
recreational fishermen and seafood houses, and large boat construction facilities. The
Deputy Chief of Staff expressed concerns of the storm shoaled channel and its
economic impact to users of Wanchese Harbor. The trawling fleet within the harbor is
unable to leave the docks under the channel conditions following Hurricane Matthew. In
addition, the USCG remains unable to complete channel marking missions out of
Wanchese Harbor. The upkeep of channel markers is critical to the health and safety of
project users. We also received a letter on October 14, 2016, jointly signed by U.S.
Senator Richard Burr, U.S. Senator Thom Tillis, and U.S. Congressman Walter B.
Jones, stating that "it is critical that the Army Corps of Engineers begins dredging
immediately".
3. Per our reconnaissance hydrographic surveys on October 11, 2016, the passing of
Hurricane Matthew caused increased shoaling in the channel. The post storm
controlling depth is 5 -feet, with most of the fleet vessels requiring channel depths
between 8 toll 0 -feet for safe passage. Shallowdraft special purpose dredges are now
the only plant capable of working in the current depths, tide conditions, and proposed
disposal conditions. This emergency declaration is necessary to begin agency
coordination to obtain the environmental clearances necessary to alleviate the severely
shoaled ferry channel. The District is coordinating with resource agencies for approval
to conduct a one-time dredging in this channel. We can begin dredging as soon as all
authorizations are received. Funding is available through Federal funding totaling
approximately $700,000, or through existing non -Federal MOA dollars on the project.
We will operate the Currituck or Murden for 10 days to 15 days (24-hour operations)
and focus mainly on the area between buoy # 3 and the eastern limit of Range14A,
because there is less than a depth of 5 -feet across the entire authorized channel width.
A before dredge survey will be conducted to identify specific areas for dredging within
the prescribed limits. Dredged materials will be placed in the limits of the federal
channel near Oregon Inlet (see attached map), and total quantity of material will not
exceed 20,000 cubic yards. This area was selected because it is currently much deeper
than the project's authorized depth of 12 feet. The proposed use of a special purpose
dredge would provide immediate passage and relief in the shortest amount of time.
CESAW will initiate Emergency Notification procedures pursuant to a Memorandum of
Agreement for Emergency Dredging and Disposal, Federal Navigation Projects with the
State of North Carolina once an emergency declaration has been made.
4. Pursuant to the attached MOA for Emergency Dredging and Disposal at paragraph 3,
the District has evaluated the criteria necessary for a declaration of emergency, as
described below:
a. The District has received complaints / requests for help from users, including
North Carolina Governor Pat McCrory, U.S. Senators Richard Burr, U.S.
Senator Thom Tillis, and U.S. Congressman Walter B. Jones.
b. The storm related shoaling within the Wanchese Harbor entrance channel
has created a situation which would result in an unacceptable hazard to life or
navigation, and an immediate and unforeseen significant economic hardship if
corrective action is not taken within a time period less than the normal time
needed under standard procedures.
c. A District survey, attached, shows that the authorized navigation channel has
recently shoaled to a level unacceptable for the safe passage of fully -loaded
commercial vessels as a result of recent unexpected events. Normal
maintenance dredging of this channel reach is not scheduled within the next 3
months.
d. The channel has been at the current controlling depth (5 -ft msl) since
Hurricane Matthew.
e. This proposed dredging (15,000 to 20,000 cubic yards) would resolve the
emergency.
f. The proposed disposal area is located in the limits of the federal channel near
Oregon Inlet (see attached map), and total quantity of material will not exceed
20,000 cubic yards.
g. Normal dredging and disposal coordination and contracting procedures are
inadequate due to the immediacy of the dredging need, the shallow nature of
the channel. Shallowdraft special purpose dredges (Currituck / Murden) are
the only vessels that can work safely and efficiently within these parameters,
and meet the immediate need.
h. Before the work can proceed, the District must coordinate with State and
Federal resource agencies.
i. The alternative to declaring an emergency would be to work through normal
contracting and environmental procedures to obtain clearances and
equipment to dredge this channel, resulting in a continuation of unacceptable
conditions for the next couple of months while we worked to award a contract.
Based on the above evaluation, I have made the determination that circumstances
surrounding this authorized project require emergency action. By copy of this
Memorandum, I request approval of the emergency action from the Division Engineer.
5. Attached are the location maps for the federal navigation project, the associated
channel condition survey (Before and After Hurricane Matthew), disposal locations, and
the emergency action dredging area.

We are requesting expedited emergency dredging to address severe shoaling that has
occurred at the east end of the Wanchese Access Channel connecting to the Roanoke Sound
Channel as a result of Hurricane Matthew.
The storm related shoaling is severely impacting the ingress and egress of commercial fishing
vessels and boat builders. The inability to travel from Wanchese to Oregon Inlet is preventing
numerous residents and business owners in the community from collecting paychecks this
week. These fishing vessels and boat builders have a significant impact on the economy of the
Dare and Hyde County region.
Additionally, the USCG Sector North Carolina operates an Aid to Navigation Team (ANT) out of
the Wanchese Harbor and the shoaling is inhibiting its ability to deploy and repair channel
marker and buoys which are essential to safe navigation.

We write to request immediate assistance for Wanchese Harbor in Dare County, North Carolina
that is experiencing excessive shoaling due to Hurricane Matthew. This impact has prevented
fishing vessels from entering or leaving the harbor. The Army Corps of Engineers' South
Atlantic Division, in concert with the Corps' Wilmington District Office, has initiated their
emergency situation procedures in order to resolve the issue and begin emergency dredging for
the harbor.
It is critical that the Army Corps of Engineers begins dredging immediately. The livelihood of
the harbor and the surrounding areas depend on safe and passable waterways. Additionally, the
fishing industry in North Carolina is at a total standstill because of the inaccessibility to
Wanchese Harbor. Again, we ask for immediate approval for the Corps to begin this necessary
dredging.

AND
U.S. ARMY CORPS OF ENGINEERS, WILMINGTON DISTRICT
FOR
EMERGENCY DREDGING AND DISPOSAL, FEDERAL NAVIGATION PROJECTS
1. $)$POSE, This Memorandum of Agreement (MOA) between the State of
Nor-th Carolina, Department of Natural Resources and Community
Development, and the U.S. Army Corps of Engineers, Wilmington District,
will allow the Wilmington District to perform emergency dredging that
meets identified criteria within the coastal zone of the State. The M3A
will allow the State to expedite its review of a project that meets the
criteria so as to allow the District to perform the emergenq- work with
State approval.
2. APPL•TC RIL.ITY. This procedure is applicable to any authorized
Federal navigation project that has an individual Section 401 (P.L.
95-217) water quality certificate or that can meet the requirements of
any general water quality certificate issued by the North Carolina
Division of Environmental Management.
3. CRITERIA. The emergency procedure will be implemented in those
eases where a rapid response is required because of unpredictable shoals
forming in an authorized Federal navigation channel. The channel must
be one in which commercial tonnage is moved. No recreational. projects
will be considered except those where the U.S. Coast Guard ,contemplates_`
closure of a channel to all navigation because of critical -shoaling.
The Corps of Engineers' decision to declare an emergency shall be made
based on the following evaluation:
a. the District has received complaints from users;
b. the basis of the emergency which is defined as follows: a
situation which would result in an unacceptable hazard to life or
navigation, a significant loss of property, or an immediate and unfor-
seen significant economic hardship if corrective action is not taken
within a time period less than the normal time needed under standard
procedures;
c. a District survey shows that the authorized navigation channel
has shoaled as a result of a recent and unexpected event, and normal
maintenance dredging is not scheduled within the next 3 months;

d. the length of time the channel has been at the controlling depth
shorn by the most recent survey available;
e. the quantity of material that needs to be dredged to resolve the
emergency;
f. the proposed disposal area;
g. the reason(s) why normal dredging/disposal coordination and
contracting procedures are inadequate;
b. the administrative and contractual requirements that have to be
met before the work can proceed; and
i. the alternative(s) to declaring an emergency.
Based on the above evaluation, a determination will be made by the
District Engineer that circumstances surrounding an authorized project
require emergency action. The District Engineer will be responsible for
requesting approval of the emergency action from the Division Engineer
(33 CFR 209.145(f)(4)).
4. DISPOSAL METHODS. Dredged material disposal in emergency situations
Will be in�aceordance with an individual water quality certification or
a general water quality certification. Disposal under general water
quality certificate No. 1332 dated 18 June 1979 for sidecasting or other
dredging with open water disposal adjacent to the channel will be
considered:
a. only if an upland disposal area is not available or within
reasonable distance; or'. -
b. an upland area is available but a pipeline dredge oaanor, be
obtained within a reasonable time because of availability, distanoe from
the emergency site, or time required for contractual procedures.
5. PROCEDURES. The District staff will be responsible for informing
the point of contact or the designated alternate in the Division of
Coastal` Management (via telephone) that the necessary approval has been
received from the Division Engineer for work to proceed under emergency
authority. The District staff Will also be responsible for notifying
and coordinating with Federal agencies.
The North Carolina Division of Coastal Management will be responsible
for designating a single point of oontact for 000rdination of emergency
actions with the Distriot and State agencies and the establishment of a
single State position on each project.

Once an emergency action has been declared by the Corps of Engineers,
the Division of Coastal Management will be responsible for 000rdinating
State review (via telephone), resolving aEy conflicts, and obtaining a
State position.
A formal consistency determination under Section 307 (c) (1) and (2) of
the Coastal Zone Management Act Will be Waived. All emergency work will
be conducted in a manner consistent to the maximum extent practicable
with policies and guidelines of the North Carolina Coastal Management
Program for dredging and dredged material disposal. Waiver of the
consistency determination will not relieve the District of obtaining or
complying with other applicable State or Federal environmental permits
or approvals.
On receipt of State verbal approval (via telephone) from the Division of
Coastal Management, the District will issue a public notice required by
33 CFR 209.145(8), Section 404(a) of P.L. 95-217, and 33 CFR 209.145
(f)(4). State verbal"approval will be confirmed in writing to the
District. The emergency work Will be performed concurrently with the
issuance of the public notice.

and develop dredged material disposal
management strategies that satisfy the
long-term (greater than 14 years) needs
for Corps projects. Full consideration
should be given to all practicable
alternatives including upland, open
water, beach nourishment, within banks
disposal, ocean disposal, etc. Within
existing policy, district engineers should
also explore beneficial uses of dredged
material, such as marsh establishment
and dewatering techniques, in order to
extend the useful life of existing
disposal areas. Requests for water.
quality certification and/or coastal zone
consistency concurrence for projects
with identified long-term disposal sites
should include the length of time for
which the certification and.i or
consistency concurrence is sought. The
section 404(b)(1) evaluation_ and
environmental assessment or
environmental impact statement Should
also address long-term maintenance
dredging and disposal. District engineers
should use the guidance at 40 CFR
230.80 to shorten environmental
compliance processing time. The Corps
of Engineers will be responsible for
