Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. HORIZONTAL AND VERTICAL STREET ALIGNMENTS OPTIMIZED TO MINIMIZE WETLANDS IMPACTS LOTS SHARE COMMON DRIVEWAY ACROSS WETLANDS WHEN NEEDED SEWER CROSSINGS ARE ONLY TEMPORARY DISTURBANCES AND RESULT IN NO LOSS TO WETLANDS. SEE ATTACHED FOR MORE INFORMATION. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to Page 9 of 12 freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/stnngide.html. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. FOUR (4) EXISTING CROSSINGS WILL BE RESTORED, APPROXIMATELY 60 LF OF CULVERT WILL BE REMOVED. Please note that this decision does not assure that the payment will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact these agencies to determine if payment to the NCEEP will be approved. This acceptance is valid for six months from the date of this letter and is not transferable. If we have not received a copy of the issued 404 Permit/401 Certification/CAMA permit within this time frame, this acceptance will expire, It is the applicant's responsibility to send copies of the permits to NCEEP. Once NCEEP receives a copy of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the In Lieu Fee to be paid to NCEEP by an applicant is calculated based upon the Fee Schedule and policies listed at www.nceep.net. Based on the information supplied by you the impacts that may require compensatory mitigation are summarized in the following table. If the regulatory agencies require mitigation credits greater than indicated above, and the applicant wants NCEEP to be responsible for the additional mitigation, the applicant will need to submit a mitigation request to NCEEP for approval prior to permit issuance. The mitigation will be performed in accordance with the Memorandum of Understanding between the N. C. Department of Environment and Natural Resources and the U. S. GEO)_O A FOLDER DESCRIBING TOPOGRAPH 1 1978 Blue Creek Estates Brynn Creek, LLC Wetlands Narrative and Justification Blue Creek Estates is a proposed 111 lot residential subdivision off of Blue Creek Road in Onslow County, North Carolina. The site is 109.4 acres of which 22.72 acres are wetlands. Impact minimization was a clear focus during the road design phase. The streets curve around the wetlands as much as practical to avoid wetlands crossings. In fact, the streets only cross the wetlands in two (2) places. In addition to the street crossings one adittional permanent crossing is needed to gain access to lots. In this case, Two (2) lots share a single driveway (lots 43 and 44.) Lots 45 and 46 will make use of an existing crossing to access the buildable area across the wetlands. Additional Temporary disturbances are required for the installation of sanitary sewer mains. Once the sewer mains are installed the area will be regraded to match the previously existing grades and planted with a wetlands seed mixture. The temporarily disturbed areas for sewer line crossings will be placed in a utility easement. To mitigate the impacts of the permanent and temporary crossings, many existing piped crossings will be restored. The wetlands will be restored by removing existing culverts and fill material to the native soils. Once native soils are reached a seed bed will be prepared, seeded with a wetlands seed mix, and covered with a Curlex Blanket. Approximately 60 LF of existing pipe and 1043 SF of wetlands will be restored. In addition, there are many forded wetlands crossings witch will be abandoned once the subdivision is constructed. The impact areas are summarized as follows: Impact #1: The first road crossing culverted is pirpendicular to the wetlands. The road is kept as low as possible to minimize the width of the impact. Impact #2: The second road crossing is also pirpenmdicular to the wetlands. The road is kept as low as practical to minimize the width of the crossing. Restoration #3: This is an existing hunting trail crossing that has an existing pipe. The intent of the restoration is to hydraulicly reconnect the wetlands by removing the pipe, restoring the crossing to the original cross section by removing fill, preparing a seed bed and seeding with a wetlands seed mix. Restoration #4: This is an existing hunting trail crossing that has an existing pipe. The intent of the restoration is to hydraulicly reconnect the wetlands by removing the pipe, restoring the crossing to the original cross section by removing fill, preparing a seed bed and seeding with a wetlands seed mix. Restoration #5: This is an existing hunting trail crossing that has an existing pipe. The intent of the restoration is to hydraulicly reconnect the wetlands by removing the pipe, restoring the crossing to the original cross section by removing fill, preparing a seed bed and seeding with a wetlands seed mix. Restoration #6: This is an existing hunting trail crossing that has an existing pipe. The pipe will be removed as part of the restoration efforts in Blue Creek Farms, Section II. The restoration will mimic the original cross section by removing fill, preparing a seed bed and seeding with a wetlands seed mix. Temporary Disturbance #7: This is an aerial sanitary crossing. A minimal amount of wetlands will be disturbed as the contractor installs the aerial crossing. After installing the crossing the area will be restored to the original cross section, a seed bed will be prepared, and the area seeded with a wetlands seed mix. Temporary Disturbance #8,9,10: These are underground sanitary sewer crossings. A minimal amount of wetlands will be disturbed as the contractor installs the sanitary sewer line. After installing the crossing the area will be restored to the original cross section, a seed bed will be prepared, and the area seeded with a wetlands seed mix. Impact # 11: The culverted driveway crossing is pirpendicular to the wetlands. The road is kept as low as possible to minimize the width of the impact. Two (2)lots 43 &44 will share this crossing to minimize the total number of impacts. WITNES SETH: THAT WHEREAS Declarant is the owner of the real property described in Paragraph 1 of this Declaration; and WHEREAS Declarant intends to develop said tract of real property; and WHEREAS Declarant, as a part of its intention to develop said tract of real property, is desirous of designating by this instrument areas on said tract of real property that are generally described as wetlands. WETLANDS AND CONSERVATION SPECIAL PROVISIONS: A. Compliance with Wetlands Regulations: It shall, be the responsibility of each owner, prior to alteration of any lot, to determine if any portion of the Lot shall have been determined to meet the requirements for designation as a regulatory wetland. Any subsequent fill or alteration of this wetland area shall conform to the requirements of state wetland rules adopted by the State of North Carolina in force at the time of the proposed alteration. The intent of this deed restriction is to prevent additional wetland fill, so the property Owner should not assume that a future application for fill will be approved. The Property Owner shall report the name of the subdivision, in any application pertaining to wetland rules. This covenant is intended to insure the continued compliance with wetland rules adopted by the State of North Carolina, therefore benefits may be enforced by the State of North Carolina. This covenant is to run with the land and shall be binding on all parties and all persons claiming under them. B- Conservation Areas: The areas shown on that plat recorded in Map Book Page , as conversation areas shall be maintained in perpetuity in their natural or mitigated condition.
