Dear Col. Pulliam:
PCS Phosphate Company, Inc. ("PCS") has reviewed the Corps' proposed Section
2.7 for the FEIS. PCS disagrccs with some the conclusions the Corps has reached.
However, based upon the exigencies of the present circumstances, PCS hereby requests
the above-referenced permit application he modified and that the Corps issue a permit to
PCS for Alternative L as described in the Supplemental Draft Environmental Impact
Statement dated November, 2007.
By copy of this letter, PCS is also requesting that (i) the Division of Water
Quality ("DWQ") of the North Carolina Department of Environment and Natural
Resources ("DENR") correspondingly amend the 401 Water Quality Certification now
under consideration. and (ii) the Division of Coastal Management ("DCM") revise the
proposed action being considered for consistency with the Coastal Area Management
Act.
