Sorry about the email confusion. I thought I had sent it to the DOT address. Yes the cumulative permanent impacts >150 lf and the fact that the stabilization is “but for the culvert,” triggered the mitigation requirement. Had the stabilization been unrelated to the culvert installation, we would not have required the mitigation. I forwarded your email to myself – just an FYI, I’m never in my Raleigh office so my DOT email is the quickest way to get to me. Just for my own clarification/edification – DWR is requiring 1:1 mitigation on the sum total of the permanent stream impacts because it is over 150 LF, correct? I’m asking because I’ve had other projects with streambank stabilization (again, restricted to the banks below the OHWM) that did not require 1:1 mitigation from DWR, but the cumulative permanent impacts were below 150 LF. I just want to make sure I get this right because in future applications, I can address it directly. And yes, the USACE will require, and NC DOT proposed, 2:1 mitigation ratio in the application. Nikki, Based on the application, it appears that there will be 105 lf of impact for the culvert and an additional 58 lf for bank stabilization and flood plain bench construction with total permanent impacts equaling 163 lf. DWR will require mitigation for the 163 lf at 1:1. Because it appears that DMS is supplying mitigation for 105 lf at 2:1 for the Corps, this should be plenty of mitigation. I just wanted you to be aware before I issue the 401. I’ve copied David on this to verify that 2:1 mitigation will be required for the stream impacts. If not, we’ll need a new letter from DMS detailing acceptance of mitigation for 163 lf of impact. Thanks and let me know if you have any questions. Brian L.
