Dear Sir or Madam:
On May 5, 2008, the Division of Water Quality (DWQ) received your application dated November 8,
2007 to impact 137 linear feet of perennial stream and 7,486 square feet of Zone 1 Neuse River basin
protected riparian buffer and 4,297 square feet of Zone 2 Neuse River basin protected riparian buffer to
construct the proposed mixed-use development at the site. The DWQ has determined that your
application was incomplete and/or provided inaccurate information as discussed below. The DWQ will
require additional information in order to process your application to impact protected wetlands and/or
streams on the subject property. Therefore, unless we receive five copies of the additional information
requested below, we will place this project on hold as incomplete until we receive this additional
information. If we do not receive the requested information, your project will be formally returned as
incomplete. Please provide the following information so that we may continue to review your project.
Additional Information Requested:
1. Please show the delineated drainage basins as called for per the Required Items Checklist.
2. Please address the following design issues associated with the proposed bioretention areas:
a. The width of the bioretention cells appears to have been overestimated in the
Bioretention Supplement Forms. The width of the bioretention area may only be counted
as the width of the level treatment area, not the whole footprint of the cut slope. In your
resubmittal, please be certain to provide an adequately wide bioretention area.
b. The soil media and planting plan should be called out on the detail sheets for the
bioretention areas.
c. The slope of the underdrain pipes must be called out on the plan sheets. In addition,
outlets for the underdrain systems must be shown on the plans.
d. It is preferable to place the construction sequence on the plans where it can be easily seen
by the contractor. The language in the construction sequence should be re-worded to

clearly state that bioretention cells may not have stormwater directed to them until the
site is completely stabilized. The temporary sediment basins must be retained until the
entire site is stabilized. Please clarify in item 2 of the construction sequence that the
bioretention area must be constructed a minimum of 50 feet away from the stream.
e. The entire boundary of the BMP maintenance easement must be shown on the plans.
Please submit this information within 30 calendar days of the date of this letter. If we do not receive this
requested information within 30 calendar days of the date of this letter, your project will be withdrawn
and you will need to reapply with a new application and a new fee.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters
or protected buffers. Please be aware that any impacts requested within your application are not
