Cornwallis Rd, Durham, NC UT to Northeast Creek On -Site Determination for Applicability to the Jordan Lake Riparian Area Protection Rules (15A NCAC 2B.0267) Dear Mr. Gibson: On October 4, 2016, at the request of Steven Ball with Soil & Environmental Consultants (S&EC) on your behalf, Katie Merritt, with the Division of Water Resources (DWR), conducted an on- site determination to review one feature on your property labeled as "Feature B" for applicability to the Jordan Lake Buffer Rules (15A NCAC 2B .0267). This feature is shown on the attached Durham County Soil Survey map initialed by Ms. Merritt on October 12, 2016. The City of Durham had previously conducted an on-site determination of this feature/reach as provided in their letter dated August 24, 2016. Your letter dated August 31, 2016 requested an appeal of the intermittent determination of Feature B as provided within 15A NCAC 02B .0267(5). Ms. Merritt conducted an appeal of the original City of Durham determination as stated above. During her review, she evaluated Feature B using the DWR Stream Classification Form Version 4.11. Pictures of the feature taken the day of the site visit are attached to this letter. Feature B was determined to start at the culvert and continue throughout to the property boundary. Feature B was evaluated to have a score of at least 20 on the DWR form. The form states that if the score is "greater than or equal to 19 points the stream is intermittent and greater than or equal to 30 points the stream is perennial." DWR Project #: 16-0856 October 12, 2016 Page 3 of 3 The DWR has determined that the feature on the attached map is an intermittent stream and is subiect to the Jordan Lake Buffer Rule (15A NCAC 02B .0267) as indicated by the City of Durham's letter August 24, 2016. This determination shall replace the determination originally performed by the City of Durham and shall expire five years from the date of this letter. You can contest the Director's decision as provided in Articles 3 and 4 of G.S. 150B. To contest the Director's decision, you must file a petition for an administrative hearing. You may obtain the petition form from the office of Administrative hearings. You must file the petition with the office of Administrative Hearings within sixty (60) days of receipt of this notice. A petition is considered filed when it is received in the office of Administrative Hearings during normal office hours. The Office of Administrative Hearings accepts filings Monday through Friday between the hours of 8:00am and 5:00pm, except for official state holidays. The original and one (1) copy of the petition must be filed with the Office of Administrative Hearings. The petition may be faxed -provided the original and one copy of the document is received by the Office of Administrative Hearings within five (5) business days following the faxed transmission.
