The Division of Water Quality received your revised application on September 9, 2004 (dated September
8, 2004). Unfortunately, the application did not address any of the issues raised in our April 4, 2004
letter. In additional, since total wetland impact now exceeds one acre, a total 401 Certification fee of
$475.00 (an additional $275.00 is required. Finally, it is not clear whether the Ecosystem Enhancement
Program (previously named the Wetland Restoration Program) is willing to accept the mitigation
responsibility for this project.
Please address these issues in the next submittal. If these issues are not addressed in your next submittal,
then the Division will have to return the incomplete application and require a resubmittal with a new fee.
