On February 8, 2005, the Division of Water Quality received a copy of the Public Notice
that was issued by the US Army Corps of Engineers for this project. We are also in receipt of a
letter sent by Mr. Landon Younce dated September 28, 2004 which was written in response to
our April 4, 2004 letter.
In order for DWQ to complete our review and permitting for this project, we will need to
have the following questions addressed. These questions were raised in our April letter but not
adequately addressed in your September response. Please address the following questions so
we can issue the required permits for this project.
1. Mitigation: Please provide a copy of the letter from the NC Ecosystem Enhancement
Program which agrees to provide compensatory mitigation for the 404 wetlands and
the isolated wetlands that are proposed to be impacted for this site (total of 2.66
acres of wetland impact).
2. Monitoring plan: Please provide a monitoring plan for the isolated wetlands in order
to ensure that wetland standards are being protected in these wetlands. Monitoring
for vegetation and aquatic macrobenthos would be appropriate for these wetlands
both before disturbance and post-disturbance.
3. Non-discharge rules: Our April letter asked your consultant to contact Mr. Kim
Colson of DWQ to be certain that additional setbacks from the non-discharge rules
are not required. Your September response did not indicate whether Mr. Colson had
been contacted. Please provide written confirmation of Mr. Colson's review of this
issue.
