Dear Mr. Younce:
On March 12, 2004, 2002, the Division of Water Quality (DWQ) was notified by receipt of your
application (dated March 11, 2004) regarding your plan to fill isolated wetlands for the purpose of
construction of the Town of Swansboro `s forested reclaimed water spray application site at SR 1744
And NC 24 in Onslow County. Approval from DWQ is required to disturb these wetlands. Please
provide 7 copies of the following information and refer to the DWQ # listed above in your reply so we
can begin to determine your projects' compliance with 15A NCAC 2H .1300.
1. According to Mr. Ken Polig of DWQ's Construction Grants and Loans Section, the Town will
be required to grade and install a liner in the footprint of the storage lagoon. Therefore this
activity will result in a discharge of fill material to the isolated wetlands within the footprint
of the lagoon and an isolated wetland permit will be required for this fill. Since the total
impact for the lagoon exceeds one acre, compensatory mitigation at a 2:1 ratio will be
required in this permit. Please provide a mitigation plan that meets the requirements of 15A
NCAC 2H.1305(g). In addition, DWQ will need to prepare a Public Notice for this project
once the mitigation and monitoring plans (see below) are prepared.
2. As discussed with Mr. Green, discharge of treated wastewater into a portion of the remaining
isolated wetlands on the site is exempt from the isolated wetland rules. However as
discussed, we may recommend that monitoring be included in DWQ's non-discharge permit
for these areas in order to be sure that wetland impacts are minimal. I believe that a site visit
will be needed to determine the need for monitoring and am in the process of scheduling a
site visit with Kim Colson (Non-Discharge Unit), Ken Polig (Construction Grants and Loans
Section), Ed Schwartzman of the Wetlands Unit and Noelle Lutheran (DWQ's Wilmington
Regional Office) as well as yourself. Once we have a tentative date for the meeting, I will
call you to confirm.
3. According to Mr. Colson, the location of spray fields near wetlands may require additional
setbacks or a variance from the setback rules. Please call Mr. Colson at 919-733-5083, ext.
540 to clarify and discuss this issue.
Please telephone me at 919-733-9646 if you have any questions or would require copies of our rules
or procedural materials. This project will remain on hold as incomplete in accordance with 15A
NCAC 2H .1300. The processing time for this application will begin when this information is
received. If we do not hear from you by writing within three (3) weeks we will assume you no longer
want to pursue the project and will consider it withdrawn.
