Dear Chad:
Enclosed is a 401 WQC Application submitted on behalf of WCP II, LLC to construct Phase 3, Section 2 of
Waterway Cove, an existing residential subdivision located in Ocean Isle Beach, NC (Brunswick County).
Phase 3, Section 2 of this development will consist of 58 single-family lots, roadways and open space.
Impacts to 0.01 acre of 404 wetlands and 0.1 acre of isolated wetlands (basin) are needed for site access
and lot development. Note that a previous developer obtained permits in 2007 for this project, which
included impacts to these areas as well as the repair of three earthen dams. The earthen dams were
repaired, but because of the economic downturn, this phase of development was delayed. Because the
404 wetland area to be impacted is emergent and the isolated wetland impacts are below required
thresholds, no mitigation is proposed.
Enclosed are the PCN form, site maps and the site plan. The 401 application fee has been submitted to
your Raleigh office. Please let me know if you have any questions or need additional information in order

homes. Adjacent properties are mostly undeveloped/forested or residential.

The purpose of the proposed project is to construct Phase 3, Section 2 of an existing residential subdivision. One small
404 wetland impact is needed for site access. Another isolated wetland impact is needed for lot fill and road construction.

This project includes the development of Phase 3, Section 2 of an existing residential subdivision. This phase will contain
58 single-family lots, roadways and open space. Stormwater facilities for this phase have already been installed. Typical
construction equipment will be used to pave a road system and clear lots for building footprints. A total of 0.01 acre of
404 wetland impacts and 0.1 acre of isolated wetland impacts are needed to provide access and lot development
throughout the site.

A previous developer obtained a CAMA Major Permit (#179-07), NWP 14/GP 197800056, and 401 WQC (DWQ# 07-
1790) to install a community pier docking facility and to repair 3 earthen dams. Permanent impacts to 0.11 ac of 404
wetlands and temporary impacts to 0.087 acre of 404 wetlands were authorized by the USACE. DWR also authorized
0.096 ac of isolated wetlands for a road crossing and lot fill. The earthem dams were repaired but the wetland impacts
related to roads and lot fill in Phase 3 were not completed. This application proposes to complete these impacts. Note
that the previous permits required that remaining wetlands be preserved. Attached is the recorded preservation
document.

Impacts were minimized by careful site design. Road and lots were arranged to reduce overall impacts. The 404 wetland
to be impacted will be clipped by the construction of a proposed road. The amount of wetland to remain would likely be
too small to be functional, so the entire polygon is considered an impact. Note that this small wetland does not support
woody vegetation and is considered emergent.

Silt fencing will be used during construction to reduce sediment from eroding into the jurisdictional areas.

The NC Natural Heritage Program GIS layer was used to determine the presence of federally listed species. No rare
species are known to occur within the site. Several rare plant and animal species are known to occur within one mile of
the site, including the Atlantic sturgeon, West Indian manatee, loggerhead sea turtle, green sea turtle, and seabeach
amaranth. These are all water-dependent or coastal species and are likely known to occur within the AIWW or its
beaches, which is located approximately 300 ft south of the site. No impacts to these species would occur from this
project.

located approximately 300 ft south of the site and is designated as EFH. No impacts to EFH would occur from this
project.

4- ALL ROOF DRAINS SHAT BE DIRECTED TOWARDS ONSITE COLLECTION SYSTEM.

RETAINING WALL NOTES:
1.) THE STRUCTURAL DESIGN FOR THE RETAINING WALLS SHOWN ON THIS PLAN SHALL BE DESIGNED BY
OTHERS. PLEASE NOTE THAT THE STRUCTURAL ENGINEER SHALL ALSO PROVIDE, WHERE NECESSARY, A

along N.C. Highway 179, at the intersection of N.C. 179 and Waterway Drive abutting the AIWW in Ocean Isle

Description of projects area and activity: Discharge of fill material permanently impacting a total of 0.11 acres and
temporary impacting a total of 0.087 ac of waters of the United States, including riparian wetlands, associated with
the repair of three existing dams and the construction of a community pier for the Waterway Cove Subdivision.
The proposed 6'x 24' pier terminates with a161x16' gazebo with a fixed finger pier to access two 41x24' fixed finger
piers with four boatlifts located landward of the USACE AIWW channel setback as shown in the NCDCM CAMA
Maior permit application dated 10-23-07.

suspended or revoked. If, prior to the expiration date identified below, the nationwide permit authorization is reissued and/or

SPECIAL CONDITIONS:
1) The Permittee shall execute and cause to be recorded in the Brunswick County Register of Deeds the
Conservation Areas (see attached) for the purpose of maintaining approximately 3.47 acres (3.58 acres
total wetlands minus 0.11 acres of permanent wetland impacts) of riparian wetlands as preservation
areas, as shown on the "404 Wetlands Survey for Atlantic Coast Deveopment ", dated 10-20-06 prepared
by Bobby M. Long & Associates in their natural and mitigated state in perpetuity, prior to the sale or
conveyance of any lots or other property within the subdivision. A final survey map of the
development, which clearly depicts the surveyed areas of preservation, must also be recorded with the
Brunswick County Register of Deeds at the same time the Declaration is recorded. No person or entity
shall fill, grade, excavate, or perform any other land disturbing activities; nor construct any structures,
nor allow animal grazing or watering or any other agricultural use on such conservation areas. The
permittee shall enforce the terms of the Declaration and, prior to conveyance of the property, shall take
no action on the property described in the Declaration inconsistent with the terms thereof. The permittee
shall provide a copy of the recorded Declaration and recorded Survey to the Corps of Engineers within
15 days of recording.
These provisions relating to wetlands cannot be amended or modified without the express written
consent of the U.S. Army Corps of Engineers, Wilmington District.

impact 0.154 acres of wetlands/waters and to permanently impact 0.109 acres of jurisdictional
Wetlands/waters for the purpose of repairing existing dams repair/replacement. You also have our
approval to impact 0.096 acres of isolated wetlands for a road crossing and lot fill and also construct a
community pier, as described within your CAMA Express application dated October 25,2007. After
reviewing your application, it has been determined that the impacts are covered by General Water Quality
Certification Numbers 3624 (GC3624) and Isolated waters permit (IWGP100000). These Certifications
can also be found on line at: http://h2o.enr.state.nc.us/ncwetlands/certs.htm]. These Certifications allows
you to use the CAMA Major Permit when issued by the Division of Coastal Management. In addition, you
should obtain or otherwise comply with any other required federal, state or local permits before you go
ahead with your project including (but not limited to) Erosion and Sediment Control, Non -discharge, and
stormwater regulations. Also, this approval to proceed with your proposed impacts or to conduct impacts
to waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If the property is sold,
the new owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying with all conditions. If total fills for this project (now or in the future) exceed one acre of
wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h). This approval requires you to follow the conditions listed in the attached certification and
any additional conditions listed below.

2. Sedimentation and Erosion Control
Erosion and sediment control practices must be in full compliance with all specifications
governing the proper design, installation and operation and maintenance of such Best Management
Practices in order to protect surface waters standards:
a. The erosion and sediment control measures for the project must be designed, installed,
operated, and maintained in accordance with the most recent version of the North Carolina
Sediment and Erosion Control Planning and Design Manual.
b. The design, installation, operation, and maintenance of the sediment and erosion control
measures must be such that they equal, or exceed, the requirements specified in the most

shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects,

Surface Mining Manual.
d. The reclamation measures and implementation must comply with the reclamation in
accordance with the requirements of the Sedimentation Pollution Control Act.
3. No Waste, Spoil, Solids, or Fill of Any Kind
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond
the footprint of the impacts depicted in the Pre -Construction Notification. All construction
activities, including the design, installation, operation, and maintenance of sediment and erosion
control Best Management Practices, shall be performed so that no violations of state water quality
standards, statutes, or rules occur.
4. No Sediment & Erosion Control Measures w/n Wetlands or Waters

extent practicable. If placement of sediment and erosion control devices in wetlands and waters is
unavoidable, they shall be removed and the natural grade restored within six months of the date

5. Deed Notifications
Deed notifications or similar mechanisms shall be placed on all retained jurisdictional wetlands,
waters and protective buffers in order to assure compliance for future wetland, water and buffer
impact. These mechanisms shall be put in place prior to impacting any wetlands, waters and/or
buffers approved for impact under this Certification Approval and Authorization Certificate. A
sample deed notification can be downloaded from the 401[Wetlands Unit web site at
http://712o.enr. state.nc.us/ncwetlands. The text of the sample deed notification may be modified
as appropriate to suit to this project. Please provide this Office with a copy of the deed
notification or similar mechanism after it has been recorded, within ninety (90) days from
the issuance of this permit).
6. Protective Fencing
Protective Fencing of the outside wetland boundary and along the construction corridor
within the boundary approved under this authorization shall be clearly marked with
orange warning fencing (or similar high visibility material) for the areas that have been
approved to infringe within the wetland prior to any land disturbing activities.
7. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality,
1650 Mail Service Center, Raleigh, NC, 27699-1650.
Violations of any condition herein set forth may result in revocation of this Certification and may result in
criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct
impacts to waters as depicted in your application and as authorized by this Certification shall expire upon
expiration of the 404 or CAMA Permit.
If you do not accept any of the conditions of this Certification (associated with the approved wetland or
stream impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that
you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of
the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a
hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

10) The permittee shall maintain the authorized work is good condition and in. conformance with. the terms
and conditions of this permit. The permittee .is not relieved of this .requireracnt if they abandon the
permittcd activity without having it transferred to a third party.
11) The permittee shall install and maintain at their expense any signal lights or signals prescribed by the
U.S. Coast Guard, through regulation or otherwise, on the authorized fa.ciliti.es. At a m.inimurn,
permanent reflectors shall, be attached to the smicture in order to make it more visible during lloll[S of;
darkness or inclement weather.
12) It is possible that the mahorized structures may be damaged by wave wash from passing vessels. The
issuance of this permit does not relieve the .permittee from taking all proper steps to ensure the integrity
of the permitted structure. The permittee shall not hold. the State of North Carolina nor the Uiuted States
liable for any such damage.
13) This permit authorizes a maximum of four (4) boat slips.
14) The authorized project is located within a prin1.ary mu.rsery area (PNA). Therefore, in. accordance with
T15A:07H.0208 of the Rules of: the Coastal Resources Commission, no new dredging or excavation
within the PNA shall be permitted. Dredging in any mariner, inctud.ing "kicking" with boat propellers, is
not authorized. This prohibition shall. be applied and enforced throughout the entire existence 0-1 the

declarations to the Division. of. Coastal Management Morehead City Office and the Corps of Engineers

CONSERVATION DECLARATION
This DECLARATION of CONSERVATION COVENANTS, CONDITIONS, and RESTRICTIONS
("Conservation Declaration") is made on this 20th day of October, 2009, by Waterboro Village
Management LLC ("Declarant").
RECITALS & CONSERVATION PURPOSES
A. Declarant is the sole owner in fee simple of the certain Conservation Property (Property) being
approximately 3.58 acres, more particularly described in the 404 Wetlands Survey (Exhibit
A) attached hereto and by this reference incorporated herein.
B. The purpose of this Conservation Declaration is to maintain wetland and/or riparian resources
and other natural values of the Property, and prevent the use or development of the Property
for any purpose or in any manner that would conflict with the maintenance of the Property in
its natural condition. The preservation of the Property in its natural condition is a condition of
Department of the Army permit Action ID No. 2006-41576-010 issued by the Wilmington
District Corps of Engineers (Corps), required to mitigate for unavoidable impacts to waters of
the United States authorized by that permit, and this Conservation Declaration may therefore
be enforced by the United States of America.
NOW, THEREFORE the Declarant hereby unconditionally and irrevocably declares that the Property
shall be held and subject to the following restrictions, covenants and conditions as set out herein, to run
with the subject real property and be binding on all parties that have or shall have any right, title, or
interest in said property.
ARTICLE I. PROHIBITED AND RESTRICTED ACTIVITIES
Any activity on, or use of, the Property inconsistent with the purposes of this Conservation Declaration is
prohibited. The Property shall be maintained in its natural, scenic, and open condition and restricted from
any development or use that would impair or interfere with the conservation purposes of this
Conservation Declaration set forth above.
Without limiting the generality of the foregoing, the following activities and uses are expressly prohibited
or restricted.
A. Disturbance of Natural Features. Any change disturbance, alteration or impairment of the
natural features of the Property or any introduction of non-native plants and/or animal species
is prohibited.
B. Construction. There shall be no constructing or placing of any building, mobile home, asphalt
or concrete pavement, billboard or other advertising display, antenna, utility pole, tower,
conduit, line, pier, landing, dock or any other temporary or permanent structure or facility on
or above the Property.

C. Industrial Commercial and Residential Use. Industrial, residential and/or commercial
activities, including any right of passage for such purposes are prohibited.
D. Agricultural Grazing and Horticultural Use. Agricultural, grazing, animal husbandry, and
horticultural use of the Property are prohibited.
E. Vegetation. There shall be no removal, burning, destruction, harming, cutting or mowing of
trees, shrubs, or other vegetation on the Property.
F. Roads and Trails. There shall be no construction of roads, trails or walkways on the
property.
G. Signage_No signs shall be permitted on or over the Property, except the posting of no
trespassing signs, signs identifying the conservation values of the Property, signs giving
directions or proscribing rules and regulations for the use of the Property and/or signs
identifying the Grantor as owner of the property.
H. Dumping or Storage. Dumping or storage of soil, trash, ashes, garbage, waste, abandoned
vehicles, appliances, machinery or hazardous substances, or toxic or hazardous waste, or any
placement of underground or aboveground storage tanks or other materials on the Property
is prohibited.
I. Excavation Dredging or Mineral Use. There shall be no grading, filling, excavation,
dredging, mining or drilling; no removal of topsoil, sand, gravel, rock, peat, minerals or
other materials, and no change in the topography of the land in any manner on the Property,
except to restore natural topography or drainage patterns.
J. Water Quality and Drainage Pattern. There shall be no diking, draining, dredging,
channeling, filling, leveling, pumping, impounding or related activities, or altering or
tampering with water control structures or devices, or disruption or alteration of the restored,
enhanced, or created drainage patterns. In addition, diverting or causing or permitting the
diversion of surface or underground water into, within or out of the easement area by any
means, removal of wetlands, polluting or discharging into waters, springs, seeps, or
wetlands, or use of pesticide or biocides is prohibited.
K. Development Rights. No development rights that have been encumbered or extinguished by
this Conservation Declaration shall be transferred pursuant to a transferable development
rights scheme or cluster development arrangement or otherwise
L. Vehicles. The operation of mechanized vehicles, including, but not limited to, motorcycles,
dirt bikes, all -terrain vehicles, cars and trucks is prohibited.
M. Other Prohibitions. Any other use of, or activity on, the Property which is or may become
inconsistent with the purposes of this grant, the preservation of the Property substantially in
its natural condition, or the protection of its environmental systems, is prohibited.

C. Recording. Declarant shall record this instrument and any amendment hereto in timely
fashion in the official records of Brunswick County, North Carolina, and may re-record it at
any time as may be required to preserve its rights.
D. Environmental Condition of Conservation Property. The Declarant warrants and represents
that to the best of its knowledge after appropriate inquiry and investigation: (a) the Property
described herein is and at all times hereafter will continue to be in full compliance with all
federal, state and local environmental laws and regulations, and (b) as of the date hereof
there are no hazardous materials, substances, wastes, or environmentally regulated

borders Waterway Drive SW to the west, a residential subdivision under construction to the east, residential
dwellings and Waterway Drive SW to the south, and undeveloped, forested land to the north.

A. Preliminary Determination
There appear to be waters, including wetlands, on the above described property, as depicted on the attached
exhibit, that may be subject to Section 404 of the Clean Water Act (CWA)(33 USC § 1344). This preliminary
jurisdictional determination may be used in the permit evaluation process, including determining compensatory
mitigation. This preliminary determination is not an appealable action under the Regulatory Program
Administrative Appeal Process (Reference 33 CFR Part 331). However, you may request an approved JD,
which is an appealable action, by contacting the Corps district for further instruction.

X There are Navigable Waters of the United States within the above described property subject to the permit
requirements of Section 10 of the Rivers and Harbors Act and Section 404 of the Clean Water Act. Unless
there is a change in the law or our published regulations, this determination may be relied upon for a period not

C. Basis for Determination: The proiect area exhibits wetland criteria as described in the 1987 Corps
contains an imAoundment of a Relativelv Permanent Water (RPW). On-site wetlands are considered
both abuttine and adiacent to an RPW and are considered
Water Act, as is the RPW. In addition, there is a section of wetlands flowed by the tide that is
'urisdictional under both Section 404 of the Clean Water Act and Section 10 of the Rivers and Harbors

de icts the approximate extent of `uriisdictional waters of the U.S. ineludine wetlands..

This delineation/determination has been conducted to identify the limits of Corps' Clean Water Act jurisdiction for
the particular site identified in this request. The delineation/determination may not be valid for the wetland
