P 3 0 2016 DEO-WATER RE OURCES 401 & BUFFER PERMITTING Subject: Pre -Construction Notification for NWP#29 for the Chateau Residential Development (AID: 2016-00107), Charlotte, Mecklenburg County, NC Ms. Higgins and Messrs. Shaeffer, Johnson, and Hamstead, Enclosed is a request for Nationwide Permit #29 associated with the proposed Chateau Residential Development (formerly known as the Elisha Site) in Charlotte, Mecklenburg County, NC. Proposed permanent impacts associated with the project total approximately 147 linear feet of a perennial tributary (Perennial RPW Tributary AA) and approximately 0. 175 acres of onsite wetlands (Wetlands Z, VV, TT, and ZZ). Permanent impacts are associated with the construction of three residential lots and the installation of two road crossings. Temporary impacts associated with sewer line installation total 0.013 acre of wetlands and 51 linear feet of stream channels. Due to the locations of the onsite jurisdictional surface water features, complete avoidance of impacts was not practicable. Rindner. PLLC. proposed lots and access routes. No compensatory mitigation is being proposed for the permanent stream channel impacts due to the minimal impacts being proposed. Wetland mitigation is being proposed to compensate for the 0.175 acre of permanent wetland impact at a 2:1 ratio through payment to NCDMS. All mitigation provided by NCDMS will be for riparian wetlands even though a portion of the impacts are to non -riparian wetlands (see attached acceptance letter). Also enclosed is a copy of our Threatened/Endangered Species Evaluation for the site in which no listed species were identified within the project area. The site is wooded which may be considered summer roosting habitat for the listed Northern Long Eared Bat. However, we have consulted with the latest guidance associated with the Final 4(d) ruling and there are no known hibernation and/or roosts sites within a 45 -mile radius of the project area. Based on this information we believe that the project meets the exemption criteria for the 4(d) rule and formal USFWS concurrence is not required. Chateau —Threatened /Endangered /Protected Species Evaluation Three plant species with federal protection were included in the survey efforts: Schweinitz's sunflower (Helianthus schweinitzit), listed as Federally Endangered, is typically found in open habitats which historically have been maintained by wildfires and grazing bison and elk herds. Now most occurrences are limited to roadsides, woodland and field edges, and utility rights-of-way (ROW). • Smooth Coneflower (Echinacea laevigata), listed as Federally Endangered, is typically found in open woods, cedar barrens, roadsides, clear cuts, dry limestone bluffs and power line rights-of-way, requiring abundant sunlight and little competition from other plant species. • Michaux's Sumac (Rhus michauxii), listed as Federally Endangered, requires habitat of sandy forests and woodland edges. This species requires periodic fire as a part of its ecology. A total of three animal species with federal protection are listed as potentially occurring in Mecklenburg County: Bald Eagle (Haliaeetus leucocephalus), protected by the Bald and Golden Eagle Protection Act, typically inhabits forested areas near large bodies of open water such as lakes, marshes, seacoasts and rivers, where there are suitable fish populations and tall trees for nesting and roosting. • Carolina heelsplitter (Lasmigona decorata), listed as Federally Endangered, is restricted to cool, clean, well -oxygenated water. Stable, silt- free stream beds are required for this species. Typically stable areas occur where the stream banks are well -vegetated with trees and shrubs. Northern Long-eared Bat (Myotis septentrionalis), listed as Federally Threatened. During summer, northern long-eared bats roost singly or in colonies underneath bark, in cavities, or in crevices of both live and dead trees. Males and non -reproductive females may also roost in cooler places, like caves and mines. It has also been found, rarely, roosting in structures like barns and sheds. Chateau — Threatened /Endangered /Protected Species Evaluation RESULTS: Habitat Descriptions (Species lists reflect the seasonality of the survey) The majority of this site is covered with a mosaic of upland old fields and pastures planted in a monoculture of young Loblolly Pines (Pinus taeda), and the remainder is a fragmented mix of old fencerows, dirt roads, sewer line rights- of-way, ponds, timbered woodlots, and disturbed woodlands and scrub/shrub thickets. There are mixed hardwood buffers along the drainages and creeks. Roadside habitat borders the property edges along Hamilton Road and Smith Road. The disturbed woodland habitat on site is composed of a mixed pine and hardwood forest with pines dominating the uplands and grading into the hardwood dominated slopes. Canopy trees present include Shortleaf Pine (Pinus echinata), Loblolly Pine (P. taeda), Virginia Pine (P. virginiana), White Oak (Quercus alba), Black Oak (Q. velutina), Red Oak (Q. rubra), Bitternut Hickory (Carya cordiformis), Sweetgum (Liquidambar styraciflua), Sycamore (Platanus occidentalis), Tulip Poplar (Lidodendron tulipifera), Hackberry (Celtis laevigata), and Green Ash (Fraxinus pensylvanica), with the average dbh (diameter at breast height) at 10 inches. Subcanopy trees include Red Maple (Acer rubrum), Sourwood (Oxydendrum arboreum), Black Gum (Nyssa sylvatica), Ironwood (Carpinus caroliniana), Winged Elm (Ulmus alata), Redbud (Cercis canadensis), Flowering Dogwood (Cornus florida), and Black Cherry (Prunus serotina). The shrub layer includes Strawberry Bush (Euonymus americanus), Blueberry (Vaccinium sp.), Russian Olive (Elaeagnus umbellate) and Chinese Privet (Ligustrum sinense). Vines present are Poison Ivy (Toxicodendron radicans), Japanese Honeysuckle (Lonicera japonica), Virginia Creeper (Parthenocissus quinquefolia), Crossvine (Bignonia capreolata), and Muscadine (Vitis rotundifolia). The herb layer includes Christmas Fern (Polystichum acrostichoides), Spotted Wintergreen (Chimaphila maculata), Bedstraw (Galium sp.), and Japanese Stiltgrass (Microstegium vimineum). The roadsides have Fescue (Festuca sp.) shoulders and ditches that are periodically mowed. The narrow ecotone at the woods and fencerow edges are made up of Fescue Serecia (Lespedeza cuneata), Broomsedge (Andropogon virginicus), Dog fennel (Eupatorium spp.), Goldenrod (Solidago spp.), Blackberry (Rubus spp.), and Multiflora rose (Rosa multiflora). Chateau — Threatened /Endangered /Protected Species Evaluation Endangered/Protected Species Results • Although potential habitat exists for Schweinitz's Sunflower, Michaux's Sumac and Smooth Coneflower along the roadside corridor, and woods edges, examination of these areas revealed no occurrences on-site. • No habitat exists on the site for Bald Eagles, and there were no sightings nor were any nesting sites observed. The on-site streams are either degraded or do not appear to have the habitat characteristics required to support populations of the Carolina Heelsplitter. Based on existing documentation, Carolina Heelsplitter populations have not been previously identified in this basin. No individuals were observed during the survey nor would any be expected on-site. Comparing our site location to the USFWS Asheville office's website (http://www.fws.gov/asheville/htmis/project review/NLEB in WNC.html) it appears that the site meets the "exempt" criteria which requires no further action under section 7 of the Endangered Species Act for the northern long eared bat. RECOMMENDATIONS: We recommend further consultation with you and your project planners and engineers regarding coordination with USFWS and other federal and state agencies.
