The proposed 0.02 acres of permanent wetland impacts are below the thresholds established in WQC No. 3890, and therefore written authorization from NCDWR is not required. However, in order to provide documentation for the applicant's files, we request an email from NCDWR documenting that written authorization from NCDWR is not required for this project. The project is ±49.81 acres in size and is located at 5320 Forestville Road, at the intersection of Needham Road and Forestville Road in Raleigh, Wake County (Latitude: 35.835198°N; Longitude: -78.517880°W). The project is located in the Neuse River Basin and onsite waters drain to a UT to the Neuse River. The Water Quality Classification for the UT to the Neuse River is Class C; NSW and the Stream Index Number is: 27-(22.5). The cataloging unit for the site is 03020201. Your Success. The proposed project consists of the construction single-family residential units and associated infrastructure, including roads, utilities, and stormwater control measures. Standard commercial construction equipment and techniques will be used in construction of the proposed project. Project History Onsite wetlands were delineated by WithersRavenel in October 2015. Tasha Alexander (USACE) issued an Approved Jurisdictional Determination (AID# SAW -2015-02532) for the subject property on June 17, 2016. A copy of the JD has been provided as an Appendix. Sara Knies of NCDWR issued a Buffer Determination (NBRRO#15-473) for the subject property on December 3, 2015. A copy of the Buffer Determination Letter has been provided as an Appendix. Proposed Impacts The proposed impacts consist of 0.02 acres of permanent wetland impacts. The proposed impacts will occur from construction of a road (`Road A') and necessary stabilizing fill material. Avoidance and Minimization Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands and waters could be minimized. The proposed permanent wetland impacts have been minimized to only those necessary for construction of Road A and necessary stabilizing fill material, providing access to developable uplands. Road A is a main thoroughfare throughout the subdivision (a majority of proposed residences are situated on Road A), and is designed to provide access, continuity, and critical ingress and egress for the subdivision. Overall impacts were further minimized by restricting the proposed development to the northern extent of the property, avoiding the need for additional impacts for road crossings to access approximately ±4.16 acres of developable uplands within the southern portion of the site. By constraining development to the northern portion of the property and minimizing the impacts to only 0.02 acres of wetlands, the proposed site plan avoids impacts to ±5.15 acres of wetlands (of ±5.17 acres total), and ±2,866 linear feet of stream. Stormwater Management Plan The proposed stormwater management plan consists of one level spreader and an engineered vegetated filter strip which will provide discharge at non-erosive rates. The Stormwater Management Plan will be reviewed and approved by the City of Raleigh as the certified municipality. The review of the NHP data did not identify any occurrences of federally listed threatened or endangered species or critical habitat on the subject property or within 1.0 miles of the project, see attached NCNHP project review letter. Site reviews did not identify any potential habitat for any federally protected species known to occur in Wake County, except for the Northern Long Eared Bat. Potential habitat for the northern Long-eared bat (NLEB) is listed as mature forest with trees over 3" dbh, which is used for roosting during the day. The proposed project area contains forested areas with trees over 3" DBH, and therefore is considered potential northern long eared bat habitat. The USFWS Final 4(d) rule for the Northern Long -Eared bat specifies that tree removal within the White Nose Syndrome (WNS) Zone is not prohibited as long as it occurs more than 0.25 miles from known hibernacula and does not result in destroying known occupied maternity roost trees, or any other trees within a 150 ft -radius from the maternity tree, during the pup season (June 1 — July 31). The proposed project is not located within 0.25 miles of any known hibernacula, nor is there any known maternity roost trees present on the project. Additionally, clearing of mature forest between June 1St and July 31St is not anticipated for construction of the proposed project. Therefore, WR concludes that the project "may affect, but is not likely to adversely affect" the northern long- eared bat. 6. Essential Fish Habitat (Corps Requirement) 6a.
