Hey Rob,
I have confirmed that the credits they show on the attached ledger are available. I also received a copy of their
conservation easement plat too, which is what I was waiting for.
I have all I need to confirm the mitigation site is acceptable for their project. LF has all of the information regarding the
Morrisville mitigation project (2002-0820) in case you need anything for your files.

Hey Jason,
The ledgers don’t indicate what type of mitigation credits the ledgers are representing. Can you make sure to add
something on the ledgers that specify the mitigation type being either Stream or Neuse Buffer credits?

Attached are the stream and riparian buffer ledgers for the Morrisville Community Park Stream and Riparian Buffer
Restoration Project. I have also included a signed memo from the Town of Morrisville explaining the history on the
projects and the status of the restoration credits and past projects, and addressing any future Crabtree Crossing project.
Let me know if you need anything else from us to modify the mitigation provider for the NC 54 Bypass (McCrimmon
Parkway) Phase I 401 approval, or if you have any questions!

Jason,
Keep working with Katie and whatever she and the 401/Buffer Unit need in order to verify the credits are there and
available and have been approved. (Since the original project for which you are referring to was not via my unit.)
My part in this would be to modify the approval once everything they need is verified. To do that, in Addition to what
Katie needs, I will add that I need also a memo from the Town to acknowledge that the referenced Crabtree Crossing
Pkwy (#20021297) project was (a) Never built and (b) that the permits for that have all expired, and if that project is ever
revived they’d have to start the process completely over again with a different source of mitigation. (If at all.)

Yes, they still need to create a ledger. Their first "transaction/purchase" will be the total ft2 of buffer
mitigation they are claiming they have. That amount will be entered into the "credit" column and then they
will provide their balance in the balance column. From there, TOM will start recording and tracking all uses of
those credits for their projects. That way, from this point forward, they will have a method of tracking their
mitigation credits and matching them to the projects they used them for. I havent talked to Rob over here
about this project yet, but he will have to determine if he is okay with the stream restoration project being an
acceptable mitigation option.

Thanks for the info Katie. Based on my conversations with the Town, they do not believe they have used any credits
from the restoration project since in their mind it was dedicated to the Crabtree Crossing Parkway project. It was only
when we started discussing the upcoming mitigation needs for their projects that they asked about the restoration
work.
With that in mind, do we still need to pull together a ledger for the Morrisville Community Park Stream Restoration
Project even though it will be empty? Once we have an approved modification and can debit the 36 LF of stream credit
and 63,537 square feet of riparian buffer credit, we will have entries for the ledger but we would not list that in the
ledger until the modification is approved correct?

Hey Jason,
That’s a hard question to answer for the buffer mitigation requirement. Only, because the DWR hasn’t kept track of any
of the mitigation that may have been used from this site on other TOM projects. We are weary of accepting offsite
permittee provided mitigation that is from older projects where mitigation credits haven’t been tracked and where the
st
project was specifically built for a particular project. I would suggest that the 1 step for TOM would be to produce a
ledger, similar to the one I have attached here that we use for banks, for the buffer mitigation it created and fill out the
ledger with any transactions that have occurred over the years. Submit the ledger to me and Rob and then we can
proceed to Step 2…which we will figure out at that point.

Good afternoon Rob and Eric-
On behalf of our client, the Town of Morrisville, Kimley-Horn is requesting a modification to the compensatory
mitigation as approved in the 404 Authorization and the 401 Water Quality Certification for the McCrimmon
Parkway/NC 54 Bypass Project (USACE AID: SAW-2016-02205 and NCDWR Project #20160212). The Town of Morrisville
would like to utilize existing constructed stream restoration and riparian buffer credits generated by the Town’s
Morrisville Community Park Stream Restoration Project. The restoration project was constructed by the Town for
mitigation for the Crabtree Crossing Parkway project (NC DWQ Project #2002-1297), which a planned extension of
Crabtree Crossing Parkway to Morrisville-Carpenter Parkway at Town Hall Drive. The original permit for the roadway
extension required 522 LF of stream mitigation and 3.07 acres of riparian buffer credits, and mitigation was proposed to
debit from the Morrisville Community Park restoration project (NC DWQ Project #2002-0820) from the total of 3,100 LF
of stream restoration and 6.89 acres of riparian buffer. The original approvals for the restoration project indicated that
any remaining credits from the project would be available for Town use on future projects. Since the Crabtree Crossing
Parkway Project was never built but the restoration project was constructed and closed out by NCDWR, the Town of
Morrisville believes that all of the constructed mitigation credits should be available for application to current Town of
Morrisville projects. As such, the Town is requesting that the Section 404 Permit Approval and the Approved 401 Water
Quality Certification be modified to allow the use of 36 LF of stream credits and 63,537 square feet of riparian buffer
credits from the Morrisville Community Park Stream Restoration Project for compensatory mitigation on this project.
I have attached the McCrimmon Parkway/NC 54 Bypass 404, 401, and mitigation transfer forms as originally approved
