Reference the Department of the Army (DA) permit issued on May 26, 2011, to authorize the
placement of fill material into streams and wetlands to facilitate widening and improving of US
321 between SR 1500, Blackberry Road, and US 221 at Blowing Rock in Watauga and Caldwell
Counties, North Carolina. Also, reference a modification to this permit dated July 24, 2012, for
a small increase in impacts at Site #XII. This project is identified as TIP R-2237C.
On September 27, 2016, we received a written request for a second modification to the
permit referenced above. This modification is needed to address drainage issues on the southern
end of the project where piped stormwater has eroded private property. Additional impacts are
requested to Site XIII (Blackberry Road Site) in the amount of 201inear feet of permanent stream
channel impact from bank stabilization, and 801inear feet of temporary stream impact due to
dewatering for construction. In addition, 201inear feet of permanent stream bank stabilization is
also requested at Site XIV (Bailey Creek Site). Plans and supporting documentation were
provided with the September 27th request.
We have completed our evaluation and concur with your request for a change in impacts and
plans associated with your referenced DA permit. Please note that all work authorized by this
permit must be performed in strict compliance with the plans attached to the original permit,
those reflected within the modification of July 24, 2012, and those contained within the permit
modification request of September 27, 2016. The approved plans for this request are attached.
Please note that any further modification to any and all plans associated with this project must be
approved by the US Army Corps of Engineers (USACE) prior to implementation.

Since no fill will be placed on the bottom of the stream, impacts from this request are not
considered.a loss of waters of the U.S., therefore no additional compensatory mitigation is
required for this modification. It is understood that all conditions of the permit, including the
