PROJECT SUNLNIARY: This project is being done as a Major Modification to Major Permit # 167-07. As an amenity to the recently permitted subdivision the applicant is proposing to develop a pier, dock, footbridge, walking path and 6 wet slips with tie pilings. 9. Narrative Description: The Mariners Point project is located at 1400 Mainsail Drive off of Oglesby Rd. Oglesby Rd. is found by turning right off of N. 20"' St. in Morehead City in the area locally known as Crab Point. The site is identifiable by construction taking place under State Permit 167-07. Dill Creek borders this site to the east and north. Mariners Point is 64.15 acres in its entirety and varies from 0' to 35 above NHW. The high ground portion of this site is comprised of former agricultural fields. Within these fields are drainage ditches that have naturalized and contain Coastal Wetland and Section 404 plant species. Above NHW, Cattail (Typha spp.), Black Needle Rush (Juncus roemerianus) and Salt Meadow Grass (Spartina patens) are present. Smooth Coordgrass (Spartina alterniflora) is present in the ditches below NHW. A large fringe of Coastal Wetlands is also present along the shore adjacent to Dill Creek. This fringe contains Smooth Coordgrass (Spartina alterniflora), Black Needle Rush (Juncus roemerianus) and Salt Meadow Grass (Spartina patens). The shorelines to the north and south of this project are comparable in nature with a similar subdivision permitted on the south east side. Within the waters of Dill Creek are large expanses of oyster rock. The water depths in Dill Creek are mostly shallow but according to the survey, reach -4' NLW within the channel portion and - 3' at NLW at the waterward end of the proposed structure. Site verification has not been made at this time but is scheduled for a later date. The substrate in this area is thick organic mud. This section of Dill Creek is a Primary Nursery Area as designated by the Division of Marine Fisheries and the Division of Water Quality classifies it as SA waters. The area in which the proposed project would take place is closed to the taking of shellfish. Morehead City's Land Use Plan dated 1999 classifies this area as Limited Transition and Conservation within the AECs. 10. Proiect Description: As an amenity to the subdivision the applicant is proposing a 6-slip docking facility extending into Dill Creek. The community docking facility is proposed on the common area lot at the end of the Mainsail Road cul-de-sac. This lot has a shoreline length of 336' along the NHW. The width of the body of water at the proposed dock location varies from 383' to 500' from marsh to marsh. As shown on the survey the Riparian Corridors are drawn perpendicular to the line of the channel so that it intersects with the shore at the point the upland property line meets the waters edge. The outer most mooring pilings would be located at an average distance of 42' from the centerline of the channel. Field Investigation Report: Nature's Own Land Company Page 03 The dock would leave high ground and cross 240' of Coastal Wetlands (180' below NHW) before reaching open water. The dock would continue another 120' while weaving through a large expanse of oyster rock and intersecting a 6'X 96' dock. Extending off of the dock would be 2 finger piers that are an average of 2' wide and 8' long. These fingers along with 5 mooring piles would create 6 slips. The mooring piles would be located 20' waterward of the proposed dock. Water depths in the area of the slips average -3.0'to-3.6' at NLW. The survey shows the extrapolated marsh line and the application has the proposed dock not within 1/a width of the water body. This location for the six-slip dock was chosen through consultation with DCM staff. A footbridge for the s/d is also being proposed. This would be made of wood and would be 4' wide and 16' long. It would provide a path for residents to walk to the community clubhouse. It would cross a tidal ditch located next to storm water basin 1 which was classified as jurisdictional wetlands. A pervious footpath is also being proposed. It would disturb 300 square feet of high ground. One location would be located north of the proposed footbridge in a 4' x 85' area with the other located south in a 4' x 35' area. CAMA Major Permit # 167-07 was issued for the upland development on this site. Development for this project has started but at this time is not at completed. 11. Anticipated Impacts: The proposed dock would shade 1,568ft2 of Coastal Wetlands. It would also shade 1,298ft2 of Open Water and incorporate 1,510 ft2 by the docking facility. The Primary Nursery Area of Dill Creek could potentially be impacted by an increase in boat traffic occurring at low tides. Large oyster rocks containing live populations existing along the shoreline would be disturbed during the construction process. It appears that a hindrance to traditional navigation will not occur from the proposed location of the dock, which would meet the 1/a width of waterbody and not encroach within the channel. This can be seen on plats dated revised 3/11/08. Once built out, this subdivision would be 23.9% impervious within the 75' AEC and 36.7% impervious for the entire tract. The total land disturbance from the footbridge and footpath would be 300 W. The Division of Land Resources approved the sedimentation and erosion control plan (CARTE-2006-440) on 6/19/06. Previously a 10-slip community dock was proposed for this area. For the revised community dock the connecting pier will be 346' feet long. The structure will be located in -3 feet of depth at NLW and have a 6-foot by 96 foot dock with 3 finger piers, 6 wet- slips, and 7 tie pilings. The dock has been revised to fall within the One-Quarter distance to marsh rule as defined by CAMA. The number of wet-slips was decreased from ten to six and the dock relocated to reduce harm to existing oyster beds, shell bottom, and infringement on the existing channel. A footbridge is also proposed to cross the tidal ditch next to storm water basin 1 that was classified as 404 wetlands. It will provide a path for residents to walk to the community clubhouse. The footbridge will be made of wood and the path leading to it will be pervious wood chips. The length of the bridge will be 16' and the width will be 4'. A Submerged Aquatic Vegetation (SAV) survey of the community dock area was conducted on April 13, 2007 at low water. No vegetation, rhizomes, or other evidence of SAV were found. Substrate data obtained from the Division of Marine Fisheries Shellfish Mapping Program characterize the area as "0 - Intertidal Soft, Non-Vegetated Shell". This area is shown as oyster rock and scattered oyster rock in the plats.` The area outside of the oyster beds over which most of the proposed dock will be located is characterized as "D - Subtidal Soft, Non-vegetated w/o ell".
