This permit, issued on May 13.2008 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) Due to concerns raised by the Division of Marine Fisheries and in order to be found consistent with 15A NCAC 07H.0208 (b)(6)(J)(i) of the Rules of the Coastal Resource Commission, the observation pier extending into the Pamlico River shall not extend more than 150' feet beyond the normal water level. 2) Except as altered herein, this permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Any material used on the sides shall net obstruct } view and must be permeable to air and water. Screen or wire on the sides along with benches and knee walls are permitted. Lattice is specifically excluded from being used under this authorization. 4) The roof of the covered gazebo shall not be designed for second story use. 5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 6) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 7) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor. This corridor is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. 8) In order to ensure compliance with Condition No. 7 of this permit, an as-built survey showing the location and dimensions of the constructed structure, and the distance to the neighboring riparian corridors, shall be performed on the facility, and copies of the survey shall be provided to the Division of Coastal Management, within 60 days of completion of construction. 9) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 10) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 11) This permit authorizes a maximum of ten formalized boat slips. Excavation 12) Excavation shall not exceed -5 feet below normal water level. In no case shall the depth of excavation exceed the depth of connecting waters. 13) No coastal wetlands shall be excavated or filled even temporarily. 14) The temporary placement or doubling handling of excavated materials within waters or wetlands is not authorized. Shoreline Stabilization 18) Unless specifically altered herein, this permit authorizes the removal of the two existing jetties located on the Pamlico River and the bulkhead that are expressly and specifically set forth in the workplan drawings. 19) The alignment of the authorized bulkhead shall adhere to the alignment depicted on the attached workplan drawing. 20) The bulkhead shall be slatted in areas adjacent to wetlands. 21) The bulkhead shall be constructed prior to any backfilling activities. 22) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 23) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved by division personnel. No excavation landward of the bulkhead is permitted except for that which may be required for the construction of the bulkhead wall, riprap, deadmen cables, etc. 24) All backfill material shall be clean and free of any pollutants except in trace quantities. 25) All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. 26) No backfill material is to be placed within 30 feet of the normal water line, except that which will be used to backfill the area behind the permitted bulkhead. Upland Development 27) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the referenced property, including but not limited to all parking areas, utilities, and infrastructure associated with the development of the single family residence, all as expressly and specifically set forth in the attached permit application and workplan drawings. 28) This permit does not authorize the removal of the existing culverts, any such request shall require a modification of this permit. Inner Banks Development, LLC ADDITIONAL CONDITIONS Sedimentation and Erosion Control Permit # 76-08 Page 4 of 4 NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the Department of Environment and Natural Resources, Land Quality Section, A) 943 Washington Square Mall, Washington, NC 27889. 29) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 30) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. Stormwater Management 31) The Division of Water Quality approval of this project under stormwater management rules of the Environmental Management Commission is covered by way of Stormwater Permit No. SW7071004, which was issued on 2/12/08. Any violation of the permit approved by the DWQ shall be considered a violation of this CAMA permit. General 32) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 33) No wetlands shall be excavated or filled outside the area indicated in the attached workplan drawings. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 946-6481 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water Quality Certification No. 3642 (DWQ Project No. 07-1669), which was issued on 2/14/08. t NOTE: The U.S. Army Corps of Engineers has assigned the proposed project COE Action Id.
