Environmental Consultants May 14, 2008 TO: Ms. Kimberly Garvey US Army Corps of Engineers PO Box 1890 Wilmington, NC 28402-1890 RE: Additional Information for the NWP 18 Permit Application Lot 4, Swordfish Lane; New Hanover County, NC Action ID: SAW-2005-1200 Dear ICim: Thank you for your letter dated May 2, 2008 in which you request additional information regarding the project at "Lot 4, Swordfish Lane" located in Carolina Beach, NC. Below is a response to each of your concerns: 1. Please provide this office with a parcel address. The correct parcel address is reflected on the previously submitted tax parcel printouts from the New Hanover County GIS website. The project area consists of 1216 and 1218 Swordfish Lane. Proof of ownership for both parcels was also included in the original permit package in the form of North Carolina General Warranty Deeds. 2. The plans that you submitted are unclear. (a) Xo signed and sealed survey exists for dris site to verify the sire of these wntlanr's.. Please provide this office with a signed and sealed survey. The original delineation for this site was performed by Southern Environmental Group, Inc. A Notification of Jurisdictional Determination was issued by Ronnie Smith September 6, 2010. A copy of this was included in the original package. A corresponding survey Nvas not signed but a copy of the survey was signed and sealed by Patrick Bristow March, 12, 2008 for the pennit application. Please advise if this is not sufficient. Box 2522, Wilmington, NC 28402 . ? 1214 and 1216 Swordfish Lane. This delineation is reflected on the survey prepared by Patrick Bristow. Since the delineation the Town of Carolina Beach has re- addressed Swordfish Lane. The corresponding lots are 1216 and 1218 Swordfish Lane. The survey and parcel lines front our in house GIS database and the New Hanover County GIS website are consistent with the provided documentation. The address of the project area will change again as the separate parcels will be combined upon issuance of the permit. 3. It does not appear that you looked for opportunities to avoid and nzininziie impacts to waters of the US as required by our program (NWP 18 General Condition 20(a)). (a) It appears based on the information submitted by your agent, Ashley Futral ofLand Management Group, Inc. that you own hvo adjacent lots. Please explain why you are not constructing the home on the lot that is entirely uplands. The applicant owns only the lots located at 1216 and 1218 Swordfish Lane. These two lots are each 100'x25'. A 25' wide parcel is not large enough to honor the 7.5' side of lot setbacks required by the Town of Carolina Beach. The two parcels have to be combined in order to support a dwelling. The location of the wetlands and the small lot size makes avoidance of impacts to the wetland area impossible. 4. Compensatory mitigation will be required to ensure that the project does not result in more than minimal adverse effects to the environment (NWP 18 General Condition 200). This office recomrn.ends payment to North Carolina Ecosystem Enhancement Program. An In-Lieu Request Form was faxed to Valerie Mitchener of the NCEEP May 14, 2008. A copy of the acceptance letter will be forwarded to you when it is received. I hope this information adequately answers your concerns. Please contact me if you have any additional questions.
