Taylor PO Box 12006 New Bern, NC 28561 Subject Property: East Bay Farms, LLC, Atlantic Beach REQUEST FOR MORE INFORMATION Dear Mr. Taylor: On May 12, 2008, the Division of Water Quality (DWQ) received your 401 Pre Construction Notification (PCN) application dated May 5, 2008 for utility crossings within the subdivision. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. The proposed subdivision (group of houses) does not show how the subdivision will be accessed. Will additional impacts be required for a driveway off NC HWY 58 be required to access the lots, if so then you need to include this impact in the application. 2. During a site visit with the Division of Coastal Management (DCM), DCM indicated there may be coastal wetlands that are not shown on the proposed plans. These coastal wetlands may be impacted by the proposed house on the east side of the property. Please have the Division of Coastal Management confirm the extent of coastal wetlands on site and indicate these on your drawings. Taylor DWQ Project # 08 0802 June 23, 2008 3. Please copy the DWQ in your response to the incomplete letter that you received from Mr. Mickey Sugg from the US Army Corps of Engineers. Please respond within three weeks of the date of this letter that you have submitted your application to DCM. Please reference the DWQ Project # of 20080802 in all future correspondence. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
