Dear Ms. Karoly and Mr. McMillan:
On May 1, 2008, DWQ issued a Request for More Information letter for the above project. This
letter is to request that the DWQ not withdraw this project from the 401 Certification Program
and to allow an extension of our response time in order to adequately address the issues raised in
the May 1, 2008 letter. We anticipate having our responses completed by June 30, 2008.

REQUEST FOR MORE INFORMATION
Dear Mr. Nepywoda:
On April 28, 2008, the Division of Water Quality (DWQ) received your application and level spreader
designs dated April 28, 2008 to impact 984 square feet (ft2) of Zone 1 protected riparian buffers and 640
square feet (ft2) of Zone 2 protected riparian buffers to construct the proposed residential development at
the site. The DWQ has determined that your application was incomplete and/or provided inaccurate
information as discussed below. The DWQ will require additional information in order to process your
application to impact protected wetland, streams and/or buffers on the subject property. Therefore, unless
we receive the additional information requested below, we will place this project on hold as incomplete
until we receive this additional information. If we do not receive the requested information, your project
will be formally returned as incomplete. Please provide the following information so that we may
continue to review your project.
Additional Information Requested:
Diffuse Flow and Buffer Authorization:
a. Please submit bypass channel design information. Channel capacity and riprap lining
material shall be designed for the 10-year storm. Please use the precipitation intensity
corresponding to the time of concentration (5minutes) but riot the 24-hour storm to
estimate the peak flow rate.
b. Please use discharge rate from the dry pond to size the level spreaders, and split the flows
to the level spreaders if JB-80 serves that purpose. This will help avoid very long level
spreaders that are difficult to install.
Please respond within three weeks of the date of this letter by sending this information to me in writing
and Lauren Witherspoon of the DWQ Raleigh Regional Office. If we do not hear from you within three
weeks, we will assume that you no longer want to pursue this project and we will consider the project as
withdrawn.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters
or protected buffers. Please be aware that any impacts requested within, your application are not None Carolina
