I was able to meet with Ian McMillan and other DWQ staff members at your offices on May 19d' to review and discuss. Pursuant to that meeting and review by civil engineer, please reference the following: Item 1: The last bound-and-published soil survey listed for Buncombe County is from 1954; we could not locate a printed copy. The NRCS lists Web Soil Survey as the alternative and we have attached a map here here with the project site overlain. Item 2: Submitted under separate cover by civil engineer (Mercer Design), via Federal Express this date. Item 3: An impervious inventory is attached. Items 4, 5, 6, 11: All requested features are depicted in revised drawings sent under Item 2 above. Item 7, 8: A letter from the civil engineer with two sketches is attached. This outlines why in his professional judgment the alternative road layouts as proposed at the May 19th meeting are not feasible and states that all proposed impacts are accounted for in the submitted plans. 9. Agent Authorization is attached. 10. Field review of the delineation by USACE/DWQ on 15 January 2008 deemed all streams as flagged to be jurisdictional and perennial beginning at headwaters. L d s? g y X o 4 C w` a r 5 PHOENIX COVE SUBDIVISION IMPERVIOUS AREA INVENTORY In response to Comment No. 3, contained in the Division of Water Quality's Request for More Information dated May 5, 2008, the following is an inventory of expected build-out impervious areas for the subject property. The total project area is approximately 159 acres, subdivided into 72 single family lots of over one acre each as required and approved by the Buncombe County Watershed Board. For the purposes of this inventory, each lot is expected to have a 2,700 sf structure footprint (two story sloping lot single family structure). Each home site will be accessed by driveways of approximately 12 ft width and averaging 200 If long. Historically for subdivisions of this nature and locale, approximately 50% are developed as aggregate base course surfaces. For the purposes of this inventory, all driveways will be considered to be paved. The project has a total of 2.51 miles (12,252 If) of proposed roads, with widths of 18 and 20 feet. For the purposes of this inventory, the roads will be considered to be 20 ft wide and paved. No curbing is planned, with grassed shoulders and drainage swales. Division of Water Quality 2321 Crabtree Blvd., Suite 250 Raleigh, NC 27604 Ms. Karoly: Mercer Design Group, at the request of Mr. Charles Johnston of Environmental Services Inc. has completed a review of the Phoenix Creek Development plan as it relates to Department of Water Quality Request for More Information dated May 5, 2008. Specifically we have been asked to address items #7 and item #8. Re: Item #7: The plan as originally submitted includes all anticipated stream impacts and accounts for all fill slopes, driveways and other proposed construction. The impact of each crossing was measured along stream length, not the culvert length. Rip-Rap dissipaters are not generally placed in high quality water streams and are usually not allowed by NCDENR, Land Quality Section. Our intent is that the contractor will disturb only that portion of the stream necessary to install the culvert. The culvert invert will be set below the stream invert and the bottom of the culvert shall be backflled with the excavated material to accommodate aquatic passage through the culvert. Re:.Item #8. The Buncombe County Ordinances which regulate major subdivisions allow for a maximum of 15% grade in tangent sections with an allowance for short section of 18% maximum grade within the tangent section. The maximum grade through a horizontal curve is 15% and the minimum radius of a horizontal curve is 90-feet. We have reviewed the alternative road re-alignments as sketched by DWQ staff in the meeting with Mr. Johnston on May 19th. The road grades for these layouts exceed 20% grade and in at least one area exceed 40% grade. We also studied lengthening the proposed re-alignments; however this did not alleviate the maximum grade problems and at several points would actually require graded slopes to extend into stream buffer areas not previously impacted.
