The encroachment will be within parts of the buffer that is beyond 30 feet from the top of bank. The need for the buffer is because of the physical constraints of the topography that limits location of the outfall. We are proposing to install a gravity sewer main and a force main no closer than 30 feet from the top of bank from this tributary. To locate it further out will place it in topography that rises quickly resulting in a much deeper outfall that would create a greater impact on the environment and will result in an outfall that is too deep to be practical. Future single family home sewer service laterals will need to be excavated with large track backhoes to get the depth needed to tie into this proposed outfall. Only a single stream crossing is used to keep impact on the stream at an absolute minimum. This crossing located near existing Hillview Drive and is done at almost a 90 degree angle and places most of the disturbance within the existing road bed. An extra manhole and additional length of pipe was used to achieve this minimal impact. Please let me know if you have any questions or if I can be of further assistance. Construction of the proposed sewer line will proceed in accordance with all general conditions that apply to Nationwide Permit 12, as well as all of the conditions of the 401 Certification associated with NWP 12. However, parallel buffer impacts to Zone 2 are unavoidable due to topographic constraints, therefore we are requesting buffer compliance from the NC-DWQ. A Pre-construction Notification Application (PCN) is attached, as well as an agent authorization form. The applicant requested that S&EC delineate the wetlands, stream channels, and buffers along the proposed route prior to choosing the alignment in order to minimize impacts. A copy of the applicable USGS Quadrangle and Soil Survey are attached showing the approximate route of alignment. Buffer confirmation from the NC-DWQ was issued on October 7, 2002 and March 4, 2003. Both buffer confirmation letters are enclosed. A site meeting with the USACE was performed on January 10, 2003 We submitted for an USACE jurisdictional determination on April 11, 2003, however, we have not received a signed delineation map. This project consists of the installation of approximately 7,200 feet of sewer force main that will serve the proposed residential area. The sewer alignment begins at the proposed pump station and extends parallel to an unnamed tributary of Lick Creek across Opal Street then crosses the stream channel at Hillview Drive (Impact 1). The sewer line then extends parallel to Sherron road and Hwy 98 crossing another unnamed tributary of Lick Creek (Impact 6) before tying into an existing sewer line (see maps). The proposed alignment will impact 40 linear feet (Impact 1) and 21 linear feet (Impact 6) of stream channel. After crossing the stream, the remainder of the sewer line will run parallel to the road within the existing right-of-way until reaching an existing sewer line. The total cumulative impact for this project consists of 61 linear feet of temporary stream channel impacts. In addition to the temporary channel impacts, the proposed alignment will impact Zone 2 of the riparian buffer (Impacts 2,3,4, &5) due to topographic constraints (see attached justification) Therefore we are requesting buffer compliance from NC-DWQ for Impact 2(Zone 2-3,045 SF), Impact 3 (Zone 2-1,427 SF), Impact 4 (Zone 2-8,287 SF) and Impact 5 (Zone 2-2,826 SF). The USACE's current policy requires applicants to avoid and minimize wetland and stream channel impacts to the maximum extent practicable and may require further compensatory mitigation to offset unavoidable losses of waters of the US when permanent impacts exceed the requirements for notification (0.1 acre). The applicant requested a detailed delineation of wetlands present on the along the proposed corridor prior to construction in order to avoid wetland impacts. Because a majority of the construction corridor is located within an existing road right-of-way, additional clearing will be minimal. In addition, the stream channel will be restored to original contours following completion of the project and the banks will be reseeded following current guidelines. Because the applicant will minimize impacts to stream channels by utilizing perpendicular crossings within an existing right-of-way, and because the proposed impacts are temporary, S&EC does not believe compensatory mitigation should be required by the USACE for this project. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. The applicant requested a wetland delineation along the sewer line corridor to select the route with the least amount of impacts to wetlands and stream channels. The applicant is proposing to install a force main no closer than 30 feet from the unnamed tributary of Lick Creek. If the sewer line had been located further away from the tributaa, completely out of Zone 2 of the Buffer, a much deer outfall would be needed because of the steep topography resulting in an outfall that is too deep to be practical (see attached justification). The UASCE's current policy requires applicants to avoid and minimize wetland and stream channel impacts to the maximum extent practicable and may require compensatory mitigation to offset unavoidable losses of waters of the US Because impacts are temporary we do not believe mitigation should be required VIII. Mitigation DWQ - In accordance with 15A NCAC 214 .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. Page 7 of 14 USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/strm,,iide.htmi. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. Because the applicant has avoided and minimized stream channel impacts by crossing stream channels in a perpendicular fashion, and because the proposed impacts are temporary, S&EC believes that compensatory mitigation should not be required by the USACE. 2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration Program (NCWRP) with the NCWRP's written agreement. Check the box indicating that you would like to pay into the NCWRP. Please note that payment into the NCWRP must be reviewed and approved before it can be used to satisfy mitigation requirements. Applicants will be notified early in the review process by the 401/Wetlands Unit if payment into the NCWRP is available as an option. An evaluation of the stream features was performed on December 17, 2002 to determine whether the site would require compliance with the Neuse Buffer Rule. The features represented on the Durham County Soils and the Southeast Durham USGS topographic maps were evaluated to determine their subjectivity to the Neuse Buffer Rule. It was determined that there are nine features represented on the property between the two maps. These are labeled as Features A through I as indicated on the attached plat map. Features G, and H are not subject to protection under the Neuse River Basin-Nutrient Sensitive Waters Management Strategy: Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A:02B.0233 (NCAC 0233). A small portion of Feature F (broken subjectivity) and the area of Feature I that encroaches into the property are subject. The remaining features are subject through the property.
