(Summit Consulting Engineers drawing No. 22 entitled, "Subdivision Development Drayton Reserve, Town of Rolesville, Wake County, North Carolina", revision 1, with Professional Engineer stamp dated 04/10/08) Progress Energy Carolinas, Inc (PEC) has no objection, insofar as its rights are concerned, for the installation and maintenance of the permanent sediment pond encroachment within the edge of our transmission easement area upon the following terms and conditions: 1. The dimensions and construction of the new pond shall be as shown on the identified Summit Consulting Engineers drawing. 2. The pond construction must not allow for any erosion around the base of the adjacent transmission line steel structure. 3. The owner/developer shall have responsibility for vegetation maintenance of that portion of the 1 of 3 5/8/2008 1:06 PM FW: Drayton Reserve (PEC Encroachment #20070179) pond that lies within the PEC easement area. 4. The owner/developer shall have responsibility for addressing any mosquito abatement issues resulting from the pond location. 5. All ground facilities must be capable of bearing the weight of PEC maintenance vehicles. The encroachment shall not interfere with PEC's ability to travel up and down the easement area. 6. OSHA minimum equipment safe working distances shall be maintained between line conductors and any construction equipment operating within the limits of the PEC easement area. 7. None of the excavated topsoil shall be permanently placed or stockpiled within the one-hundred and eighty (180) foot PEC easement area. PEC will use reasonable care to avoid damage to said encroachment during construction, maintenance, operation and removal of its transmission line, but PEC will not be liable for any damage that might occur during the performance of these activities. Landscape plantings within the easement area shall not exceed a maximum height of twelve (12) feet at maturity, and may not interfere with PEC's access and/or maintenance requirements. Harold Wagner Contract Land Agent From: Mark Altman [mailto:maa@millridgeco.com] Sent: Wednesday, May 07, 2008 11:41 AM To: Wagner, Harold Subject: Drayton Reserve Harold, Per our conversation from last Friday, I am writing to further explain the reasons behind our request for installing a permanent storm water pond that will be partially located within the Progress Energy easement located within the Drayton Reserve subdivision. As you are aware there is currently a temporary sediment control pond located in the essentially the same location as the permanent pond will be. The existing device was originally planned to be temporary and was slated to be removed once the subdivision was complete and there was no longer a need for sediment control. This device was constructed in the summer of 2007. However, in November 2007 there was a change in DWQ regulations, which govern storm water discharges. The new regulations decreased the amount of impervious service that is allowed for any given project before that project must install permanent storm water devices. Since our project was already under construction and impervious surface allocations were already locked in, we are being forced to convert our temporary device into a permanent device. This conversion will actually consist of reducing the footprint of the temporary device and the permanent device will have less of an impact on your easement than the temporary device currently does. We understand that your engineering department has approved the plans that were submitted directly to you by our consultant, Summit Engineering. We would like to get from you a written approval that can be provided to DWQ and that acknowledges the approval from Progress Energy.
