Like she says, this is not really a typical stream "restoration". In my mind, it should be more of a NW13 with some deviations, but the corps wants to do a NW39. She feels it will be best covered under a NWP 39 for the Corps' purposes, citing the likelihood that we will have to remove more than 25 cu. ft. of sediment from the pond and that NWP 27 would generally cover traditional restoration projects. (We discussed that this is a bit of a'band-aid' or repair, rather than something that would increase the overall aquatic resource). I just wanted to let you know if the NWP change on the Corps' part in case that affects the DWQ review in any way. Can you please pass this on to central office personnel? Lia Myott? I've never seen her signature on a letter before, so she's new to me...never worked with her. Also, I put my letter response to the DWQ letter in the mail today .... it should arrive Monday or so.
