Sullins, Director Division of Water Quality April 29, 2008 DWQ Project # 08-0678 Yadkin County Mr. Donald Hawks, Construction Director Yadkin County Board of Education 121 Washington Street Yadkinville, NC 27055 Subject Property: Eastern Middle School Forbush Creek [030702, 12-83-(0.3), C] Dear Mr. Hawks: On April 11, 2008, the Division of Water Quality (DWQ) received your application to fill or otherwise impact 266 linear feet of isolated stream to construct the proposed school. The DWQ has determined that your application requires the submittal of a Stormwater Management Plan. You have requested a written explanation of this requirement. Per the requirements of 15A NCAC 02H 130(c): "The Director shall issue an Individual Permit ...upon determining that existing uses are not removed or degraded by a discharge to isolated classified surface waters for a discharge resulting from an activity which:" (5) "provides for protection of downstream water quality standards through the use of on-site stormwater control measures" For information regarding current Division policy regarding what should be submitted for approval of a stormwater management plan please refer to Stormwater Management Plan (SMP) Requirements for Applicants Other Than the North Carolina Department of Transportation, available at: http ://h2o. enr. state.nc.u§/ncwetlands/documents/SMPRequirementsforApplicantsothertha nNCDOT.pdf. Please include an SMP that removes a minimum of 85 percent TSS and 30 percent TN from the stormwater generated by this project. For each proposed BMP, please provide a completed BMP Supplement Form, with all the required items. Please note that the above referenced policy was approved and adopted as part of the formal public notice process as part of the recent approval of new General Certifications.
