PROJECT SUMMARY: The applicant proposes to remove existing boat davit, skiff ramp, platform and mooring pilings, and to construct a boat ramp with an approach and sidewalls extending water-ward, add a three-lift boathouse with two finger piers and a breakwater. Proiect Settin The site of the proposed development is a 21-acre tract with 209 feet of shoreline located at 155 Courtney Lane in Moyock, Currituck County adjacent to the Currituck Sound. Approximately 1/2 of the tract is a managed pine forest, while the other 1/2 is utilized in active agriculture. Loblolly pines border the developed area and vegetation within consists of native lawn grasses. Man-made features in this area include a single-family dwelling with accompanying gravel driveway and detached garage. The garage has a concrete slab extending to the east, upon which is a dog kennel. To the northeast of the garage exists a storage shed. A gravel pathway with lighting structures extends from the house to the bulkheaded shoreline. A small radial-arm boat davit, with a concrete foundation is located just landward of the bulkhead, to the south of the pier. Approximate elevation of the property is 4 ft above normal water level (NWL). Review of available information suggests that there are no archeological sites within the property. The shoreline of the applicant's lot abuts the Currituck Sound and runs generally in a north- south direction. No wetlands were observed on the site. Existing development within the adjoining Public Trust and Estuarine Waters Areas of Environmental Concern (AEC) includes a 6 ft wide by 33.5 ft long pier ending in a 16 ft x 15 ft platform. Other development is limited to the bulkhead along the shoreline, 6 associated mooring pilings surrounding the platform, and a wooden skid skiff launch. Water depth along the bulkhead is approximately 3.5 ft below NWL. Water depths increase gradually proceeding to the east, reaching approximately 4.5 ft below NWL at a distance of 90 ft offshore. The lot to the north of the applicant's is partially cleared and has approximately 147 ft of bulkheaded shoreline. The lot to the south is undeveloped and has approximately 400 ft of shoreline, 150 ft of which is bulkheaded. Both of these lots have no water-dependent structures. The waters of the Currituck Sound along this area are approximately 2.5 miles across, and are classified by the NC Division of Water Quality as SC waters. The NC Wildlife Resources Commission and NC Marine Fisheries Commission also classify these waters as joint fishing waters. Although no submerged aquatic vegetation was observed, water milfoil and widgeon grass are generally present in the Currituck Sound. These waters of the Currituck Sound are outside any primary or secondary nursery areas. However, an Inland Primary Nursery Area exists approximately 3400 feet to the north, the Tull Creek and Bay Primary Nursery Area. These waters of the Currituck Sound are listed by the Shellfish Sanitation Commission as closed to shellfish harvesting. Bray Island LLC Field Investigation Report Page 3 Development Proposal In order to gain water access, the applicant proposes to construct a concrete boat ramp adjacent to and south of the existing pier, and will extend 20 ft waterward of NWL at the existing bulkhead. It will be 15 ft wide and extend 20 ft landward of the existing bulkhead, where it will join a 10 ft wide accessway to be constructed of gravel or concrete, connecting the boat ramp to the existing driveway. Bulkhead return walls of 12 ft will be constructed on both sides of the boat ramp extending landward. Bulkhead sidewalls would be constructed on both sides of the ramp extending waterward, 20 ft on the north side and 24 ft on the south side where it will connect to a proposed breakwater structure. The proposed boathouse will measure 31 ft x 18 ft to the dripline, covering three boatlifts, each measuring 7 ft x 16 ft, and two 16 ft x 3 ft 9 in finger piers which will extend on both sides of the middle boatlift. A total of 21 pilings will be driven to support walkways, boathouse and boatlift equipment. The waterward extent of the boathouse will extend 61 ft 6 in beyond NWL (11 ft beyond existing pier). The boathouse will have sidewalls on the south, east and west sides, extending 'h the distance from roof to NWL. A boathouse of this size is needed to launch and store the applicant's three hunting and fishing vessels during open seasons. These vessels average 16 ft in length and are considered run-abouts. Applicants would also like the possibility of charging for the mooring of vessels in the three boatlifts during times of non-use. The proposed breakwater structure will enclose the boat ramp and boathouse area. A two section breakwater structure will extend from the corner of the existing bulkhead, starting 15 ft south of the north riparian line, with the first section running to the southeast for 57.5 ft, and the second section running nearly due south for another 24 ft. A four section breakwater structure will extend from the eastern shore of the southern boat ramp sidewall bulkhead, with the first section of 9.5 ft running in a southeast direction, the second section of 24 ft will extend to the east, the third section of 24 ft will extend to the north, leaving an opening of 15 ft between the two breakwater components. The 163 ft breakwater will be supported by 22 vertical pilings on 8 ft centers, with 21 of the pilings provided with lateral support through the use of batter pilings on the landward side of the breakwater. In addition, the applicant proposes the following demolition: 1. Removal of the wooden skiff launch. 2. Removal of a 16 ft x 9 ft section of the existing platform to bring the pier width down to 6 ft. 3. Removal of 6 mooring pilings located on the three sides of the existing platform. 4. Removal of the radial boat davit, along with its concrete foundation. Anticipated Impacts An addition of 976 square feet of impervious surfaces will be added to the 75 ft Estuarine Shoreline AEC. The proposed development would bring the total impervious surface coverage within the AEC to 11.7%. Bray Island LLC Field Investigation Report Page 4 The proposed boat ramp will require the excavation of 16.3 cubic yards within the 75 foot Estuarine Shoreline AEC to create a proper slope. Excavated material will be removed from site. The proposed boat ramp will encompass a 300 square foot area within the Estuarine Waters (EW) and Public Trust Area (PTA) AEC's and require 23.1 cubic yards of upland fill below NWL. A temporary wall will be constructed at the end of the ramp to control turbidity during construction. Total land disturbance on this lot associated with the proposed development is 2460 square feet, which includes the sum of the boat ramp access that lies within previously existing impervious area, plus the remainder of the boat ramp access that lies outside the AEC. The existing pier shades approximately 300 square feet and the proposed 3 lift boathouse with two finger piers will shade an additional 558 square feet totaling 858 square feet of shading in the EW and PTA AEC's. The proposed breakwater will enclose 4851 square feet of EW and PTA AEC's. A temporary increase in water turbidity during construction will occur. The Currituck Sound at the development site is approximately 2.5 miles wide. The proposed breakwater will extend approximately 90 ft waterward of NWL; no navigational impacts are anticipated. Coastal Wetlands and Submerged Aquatic Vegetation were not observed during site visit. Take left at the "Y" going north on NC Hwy 34. Continue on NC Hwy 34 for another 8.8 miles to the intersection with NC Hwy 168 in Sligo. Turn right on NC 168 and proceed to east for 2.8 miles and the intersection of Tulls Creek Road. Turn to the left and proceed north for 3.1 miles to the intersection of Launch Landing Road. Turn to the Right and proceed to the northeast for 0.1 miles to the intersection of Tice Road. Turn to the right and proceed to the east for 0.5 miles to the intersection of Courtney Lane. Proceed straight on Courtney Lane at the point where Tice Road bends to the left. In approximately 0.1 miles Courtney Lane will bend to the right; continue for another approximately 0.1 miles to a driveway on the left at 155 Courtney Lane. This is the development site. SITE: This property consists of a 21 acre tract with only 209 feet of shoreline on the Currituck Sound. Approximately '/2 of the tract is a managed pine forest, while the other %2 is utilized in active agriculture. For approximately 700 feet along the shoreline to the north of this lot, there exist 4 lots of approximately 200' in depth, all with residential structures on them with the exception of the lot immediately to the north. The lot to the south has approximately 400 feet of shoreline and 1300 feet of depth, and is undeveloped, with approximately 50% in managed forest and the remainder utilized in active agriculture. The next lot to the south, of approximately the same size has a residential structure and landscaped yard near the water, with approximately 90% of the remaining area in managed forest, and the other 10% in active agriculture. Farther to the north and south there exist large agricultural and forested tracts interspersed with large residential tracts along the Currituck Sound. This tract, and the various agricultural, silvacultural and residential lots to the north and south abut the Estuarine and Public Trust waters of the State of North Carolina, directly along the Currituck Sound. The 4 residential lots to the north of this tract have bulkheads, and the 3 farthest to the north have docks and/or boat houses. The undeveloped lot immediately to the south has approximately 1 /3 of its shoreline bulkheaded, up to the point where 404 wetlands are encountered. Additional bulkheaded shoreline is not encountered as you proceed to the south for approximately another 2000 feet. Erosion is minimal along the Currituck Sound in the vicinity of the Bray Island tract where the abutting lots have been bulkheaded, but some erosion is noticeable where the high ground somewhat subsides immediately landward of the bulkheads. Both the lot to the north, and to the south, have no water-dependent structures other than a bulkhead. Piers along the same shoreline consist of a 64 ft pier, 280 ft to the north, and a 220 ft pier, approximately 1600 feet to the south. No wetlands exist on the Bray Island tract. No submerged aquatic vegetation (SAV) was observed in the waters along this area. Wastewater treatment on developed residential lots is by use of septic systems with leach fields. Potable water is available through Currituck County water mains. Existing development on the applicant's lot consists of a residential structure with accompanying gravel driveway and detached garage. The garage has a concrete slab extending to the east, upon which is a dog kennel/run. To the northeast of the garage exists a small storage shed. A gravel pathway extends from the house down to the bulkheaded shoreline; along the gravel path, and driveway, lighting structures exist with buried electric supply, including an electrical junction box. A small radial-arm boat davit, with a concrete foundation is located just landward of the bulkhead, to the south of the pier. Existing development within the adjoining Public Trust and Estuarine Water Areas of Environmental Concern includes a 6 ft wide by approximately 50 ft pier, with the end consisting of a 16 ft x 15 ft platform. Other development is limited to the bulkhead along the shoreline, 6 associated mooring pilings surrounding the platform, and a wooden skid skiff launch. The shoreline of applicant's lot abuts the Currituck Sound, which runs in a generally north-south direction in this location. This is a high energy shoreline in this area when subjected to northeast winds. Water depth along the bulkhead is approximately 3.5 feet below Normal Water Level (NWL). Water depths increase gradually proceeding to the east, reaching approximately 4.5 feet below NWL at a distance of 90 feet offshore. Waters along this stretch of shoreline appear to deepen uniformly when proceeding east into the Sound, and for the purposes of determining the Y? Page 2 of 6 direction of the riparian lines, the line of deep water is considered to run parallel to the shoreline. The waters of the Currituck Sound along this area are approximately 2.5 miles across, and are classified by the NC Division of Water Quality as SC waters. These waters of Currituck Sound are outside any primary or secondary nursery areas. However, an Inland Primary Nursery Area exists approximately 3400 feet to the north, the Tull Creek and Bay Primary Nursery Area. These waters of Currituck Sound are listed by the Shellfish Sanitation Commission as closed to shellfish harvesting. PROPOSED DEVELOPMENT At present, the applicants' utilization of this site during the hunting and fishing seasons is often limited, or complicated, by the severity of the wave energy and the difficulty and safety hazards that this presents for loading, launching, landing, storage and retrieval of the three relatively small vessels needed for the hunting and fishing efforts. For private use, the applicants propose to improve the utility of this site through the development of a boatramp to facilitate the launching and retrieval of their boats, along with three boathouse-enclosed boatlifts for the temporary storage of these boats, and a protective breakwater to facilitate the launching and lifting of these boats, and the embarking and debarking from these boats with safety. The Applicant also proposes to build, totally within the drip line of the boathouse, two narrow walkways on both sides of the middle boatlift. The proposed concrete boatramp, is to be located adjacent and to the south of the existing pier, and will extend 20 ft beyond the NWL at the existing bulkhead; it will be 15 ft in width, and extend another 20 ft landward of the existing bulkhead, where it will join a 10 ft wide accessway to be constructed of gravel or concrete, connecting the boatramp to the existing driveway. Bulkhead return walls of 12 ft will be constructed on both sides of the boatramp extending landward. Bulkhead sidewalls to the boatramp will be constructed on both sides of the boatramp extending into the water, 20 ft on the north side of the boatramp, and 24 ft on the south side where it will connect to the breakwater structure. Impervious surfaces within the 75 ft Estuarine Shoreline Area of Environmental Concern (AEC) consist of the gravel pathway, the electrical junction box, the lights, and the concrete boat davit. Total impervious area equals 490 square feet. This represents 3.9% of the 12,447 square feet of this AEC. Additional impervious surface within the Estuarine Shoreline AEC results from the boatramp (308 sq ft), and the boatramp access (668 sq ft), for a total additional 976 square feet. The proposed removal of 7.5 sq ft of impervious surface (existing boat davit foundation) along with additions from the proposed development, would bring the impervious surface coverage within the Estuarine Shoreline AEC to 11.7%. Total land disturbance on this lot associated with the proposed development is 2460 square feet, which within the Estuarine Shoreline AEC includes the boatramp access, some of which lies within previously existing impervious area, plus the remainder of the boat-amp access that lies outside of this AEC. To facilitate the proposed construction, Applicants propose the following demolition: 1. The removal of the wooden skid skiff launch, which is currently located just to the north of the existing pier at the bulkhead. 2. The removal of a 16 ft by 9 ft section of the existing platform to bring the pier width down to 6 ft from shoreline to waterward extreme. 3. The removal of the 6 mooring pilings located on the three sides of the existing platform. 4. The removal of the radial boat davit, along with its concrete foundation. Applicants would also like the possibility of charging for the mooring of vessels, other than their own, in the three boatlifts inside the boathouse, Page 4 of 6 AVOIDANCE AND MIMIMIZATION Applicants seek to improve the usability of their waterfront property. The small boats needed for duck hunting in this region are susceptible to extreme buffeting by wind and waves on this high-energy shoreline during the winter weather of the hunting season. They seek to improve this usability of their property while still avoiding and minimizing impacts within the public trust waters to as great an extent as possible. For this reason, they have chosen to locate the protected launching and recovery basin for their boats to the northern extent of their shorefront, leaving only minimal room to maneuver their boats into and out of the boathouse. This also minimizes the extent of the breakwater that protrudes out into the Currituck Sound. The amount of water enclosed within the breakwater is further minimized by terminating the breakwater immediately adjacent to the southern part of the boat ramp, rather than seeking to enclose the entire length of their shoreline. The amount of water enclosed within the breakwater is further minimized by designing the southern portion of the breakwater in 4 sections, leaving only the minimal area necessary for a boat launched at the boat ramp to transit within the breakwater to the boathouse. Impediments to the transit of fish are minimized by not extending breakwater sheetpiles all the way to the existing bulkhead, and by keeping every other sheetpile off of the bottom, extending only 1' below normal water level. The above measures to address the transit of fish also minimize water circulation and water quality impacts. Water quality and circulation impacts are further minimized by drilling the full-length sheetpiles with circular, 2" diameter holes, from a distance of P below normal water level to the point where the sheet pile encounters the bottom. The number, size and spacing of these holes has been designed to give an open area equivalent to a 1" lateral gap for every linear foot of breakwater. This design was adopted in order to retain the strength in the vinyl sheetpiles, which would be unnecessarily weakened by a rectangular 1" gap every 12 inches. As designed, with every other sheetpile not extending to the bottom, and with the drilled circular holes, this breakwater provides 6.3 inches of opening per linear foot of breakwater. The only standard for circulation published by the Coastal Resources Commission is found in their rules for marsh-enhancing breakwaters, and this requirement is only a 1" lateral opening for every linear foot of breakwater. Those same rules require a 5' gap between overlapping sections of breakwater, which must occur every 100 feet. The design of the Applicants' breakwater with gaps on either end, and with the navigable opening between the northern and southern sections, provides over 10' of gap per 100 feet of breakwater. Page 5 of 6 Further impacts to the public trust waters are avoided by removing existing platform, wooden skid skiff launch and mooring pilings. Additional minimization is achieved by locating the boathouse as close to the shoreline as possible, while still being able to launch and retrieve their boats at seasonally low water levels during wind events. The concrete boatramp, adjacent to the existing pier, will extend 20' beyond the NWL at the existing bulkhead; it will be 15' in width, and extend another 20' landward of the existing bulkhead, where it will join a 10' wide accessway to be constructed of gravel or concrete, connecting the boatramp to the existing driveway. Bulkhead return walls of 12' will be constructed on both sides of the boatramp extending landward. Sheetpile sidewalls to the boatramp will be constructed on both sides of the boatramp extending into the water, 20' on the north side of the boatramp, and 24' on the south side where it will connect to the breakwater structure. The breakwater structure will enclose the boatramp and boat house area. A two section structure will extend from the corner of the existing bulkhead, 15' south of the riparian line, with the first section running to the southeast for 57.5', and the second section running nearly due south for another 24'. A four section structure will extend from the eastern extreme of the southern boatramp bulkhead, with the first section of 9.5' running in a southeast direction, the second section of 24' will extend to the east, the third section of 24' will extend to the northeast, and the fourth section of 24' will extend to the north, leaving an opening of 15' between the two breakwater components. The breakwater will be supported by 22 vertical pilings on 8' centers, with 21 of the pilings provided with lateral support through the use of batter pilings on the landward side of the breakwater.
