Sullins, Director Division of Water Quality Chuck Wakild, P.E., Deputy Director Division of Water Quality April 29, 2008 DWQ Project # 08-0533 Pamlico County CERTIFIED MAIL: RETURN RECEIPT REQUESTED Cert. # 7007 3020 0001 8861 7325 Mr. Duffy Harrison 1626 Scott Town Road New Bern, NC 28560 Subject Property: Harrison Property at 1066 Paradise Shore Road Buxton Creek, Neuse River Basin REQUEST FOR ADDITIONAL INFORMATION Dear Mr. Harrison: On March 20, 2008, the Division of Water Quality (DWQ) received your application dated February 13, 2008, to impact a 30 X 30 foot (900 ft2) area to convert upland into a boat basin and displace 30 linear feet of the Neuse riparian buffer landward. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected buffers on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H.0506 and 2B.0233(8) and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Construction of the proposed boat basin will move additional Zone II Neuse River riparian buffer onto the adjacent property owners. It is required that a written signed and certified letter of aggreance be obtained from owners of the neighboring properties and copies sent to this Office. Please respond in writing to the DWQ within four weeks of the date of this letter to with the requested information. If we do not hear from you within four weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers.
