Dear Mr. Black:
The Division of Water Quality (DWQ) received your application for a 401 Water Quality Certification for
the subject project on April 24, 2008. 1 have reviewed the application and the following
information/comments are needed by this office in order to complete our review:
a) The application states that the net impact is 247 linear feet of stream. Apparently a typo occurred.
The net impact should be 274 If. Application to the Ecosystem Enhancement Program should be
modified and a corrected copy submitted to DWQ.
b) For the proposed stream crossings please provide construction details (plan view, longitudinal
profile and cross sectional views). Stream impacts associated with culvert installation and riprap
should be identified/differentiated.
C) There are several temporary stream impacts proposed for the site. Please clarify the need for
these temporary impacts and state why the use of the proposed permanent impacts for the stream
crossing will not suffice to gain access to the site.
Pursuant to 15A NCAC 2H .0507(h), please be advised that this project will be placed on hold. Failure to
submit the requested information by March 21, 2008 will result in the application being withdrawn from
consideration. You may reapply, but a new fee and application will be required. In addition, this office is
requesting that the Army Corps of Engineers withhold processing the 404 permit until the requested
