PROJECT SUMMARY: The applicant proposes to construct a 10-slip pier structure for a seven unit condominium complex which is under construction. PROJECT SETTING The proposed development site is an approximate half-acre tract of cleared land that is being converted to private condominiums, named Waterway Condominiums, and located off the intersection of Ward St. and Poindexter St.(SR 1329), on Continental Drive, in City of Elizabeth City limits, Pasquotank County. The development site is located on the Pasquotank River just north of downtown Elizabeth City in the urban waterfront district. The property is flat and contains indigenous weeds and grasses. A seven unit condominium complex is currently under construction and the property has a shoreline bulkhead. The property to the southwest is the location of two demolished grain elevators. Rivers Bend Condominiums, owned by River's End Development Corporation, care of William Ballinger, Jr., is a 10-condominium complex permitted under CAMA Minor Permit #070102A and is located immediately northeast of the proposed site for development. Rivers Bend Condominiums also has a 10-slip pier structure under CAMA Major Permit #150-04, issued on November 2, 2004. Northeast of this development is open lawn area with an upland basin owned by Roanoke Bible College that extends to the mouth of Knobbs Creek where the lumber mill is located. Water depths adjacent to the proposed pier structure range from -2-feet near shore, -10-feet within the proposed boat slip areas adjacent to the pier, and -16-feet to -18-feet within proposed boat slip areas at waterward end of proposed "T" platform. The bottom within the project area is fine sand and silt. The width of Pasquotank River in the area of the proposed pier is approximately 795-feet and a Federal Channel is marked in this area. The shoreline of the property consists of 103-feet of new wood bulkhead issued under General Permit A48775 with an elevation approximately 7-feet above normal water level (NWL). There are no Section 404 or coastal wetlands on the property. A gravel access exists on the property to connect Continental Drive to existing River's Bend Condominiums. There are no submerged aquatic vegetation or shellfish in the vicinity of the proposed pier structure. There are no known archeological sites or geologic formations associated with the applicant's property. The waters of Pasquotank River in this area are classified as SC by the Division of Environmental Management and are closed to shellfish harvesting. Soil type on the property is Bertie (Bh) very fine sandy loam. DEVELOPMENT PROPOSAL The proposed development will be a 10 slip pier structure. In order to provide water access for the owners of each condominium unit, the applicant has dedicated one boat slip per unit and three boat slips for guests for a community water access pier. r Field Investigation Report Causeway Associates, LLC, c/o William Ballinger Jr., Waterway Condominiums Page 3 The proposed community boating access pier will consist of a 54-foot long by 6-foot wide pier to a 52-foot long by 6-foot wide "T" platform with four finger piers 8-foot long by average 3.5-foot wide. There will be thirteen mooring pilings 40-foot long by 8-inches wide to form the ten slips. The pier structure will be setback 32.5-feet from Rose Harbor, LLC, riparian owner to the southwest and extend 85-feet into Pasquotank River. There is no request for restrooms, gasoline, sewage pumpout, or dredging with this development proposal. A series of elevated, slatted walkways constructed of wood will be located within and outside the 30-foot Area of Environmental Concern (AEC) over uplands in order to provide a walking path for residents from condominiums to the pier structure. A 107.5-foot long by 6-foot wide elevated walkway will run parallel to the shoreline. Four separate 4-foot wide elevated walkways will run perpendicular to the shoreline, through the 30-foot AEC, to connect three condominium units and the parking area with the shoreside dock. All elevated walkways will form one contiguous structure connecting to the pier structure. The entire lot will be graded after the installation of a silt fence along the shoreline near the bulkhead in preparation for landscaping the site. The buildings are setback outside the 30-foot buffer. The condominium units and asphalt parking associated with the complex will comprise 74% of total project's lot coverage with impervious surface. There are no impervious surfaces proposed in the 30-foot buffer. ANTICIPATED IMPACTS The multi-slip dock will project approximately 85 feet into Pasquotank River, and will shade 748 square feet of Public Trust Area, 1,125 square feet of uplands in the Public Trust Shoreline (PTS) and 53 square feet of uplands outside the PTS Areas of Environmental Concern (AECs) in the form of wooden elevated, slatted walkways. Each boat slip will be 14-feet to 15.5-feet wide by 25-feet to 30-feet long, and the entire pier structure area including mooring area will occupy approximately 5,580 square feet. Boating activity will increase in this area resulting in a possible increase in water turbidity. This will be the third multi-slip pier along this shoreline. There are no expected navigational impacts due to the pier structure. The entire 19,735 square feet of Waterway Condo's lot will be graded in preparation for the upland development, 3,090 square feet of which are in the PTS AEC. A total of 14,609 square feet will be impervious fill resulting from the construction of condominium units (7,969 square feet) and asphalt paving (6,640 square feet) on uplands outside the PTS AEC. A total of 3,948 square feet of open area, or 20% of the lot area, will be seeded with indigenous grass or planted with landscape species. Temporary water turbidity will occur during construction. The project, as proposed, is to disturb less than one acre for construction of building. As there is proposed less than one acre of disturbance, an erosion and sedimentation control plan does not have to be submitted (to this office) for prior approval. You also asked about whether a Coastal Stormwater Permit, from the Surface Water Section of the Division of Water Quality, would be required. There are two "triggers" for the requiring of the Stormwater Permit. One is the requirement for an erosion and sedimentation control plan approval by the Land Quality Section. The other is the requirement for a major development permit from the Division of Coastal Management. Therefore, unless a major permit is required for this project by the Division of Coastal Management, no stormwater permit will be required.
