PROJECT SUMMARY: The applicant proposes to disturb approximately 1.5 acres of high ground (for residential development) and construct a private docking facility to accommodate four vessels. PROJECT DESCRIPTION Land Management Group, Inc., on behalf of Robert Hill, has requested that the attached application be processed under the Express Permit Review Program. Please note that the applicant submitted a CAMA major permit application for development at the subject property in July 2007. The development activities proposed at the time included the construction of a private pier, platform and floating dock system. The facility would have allowed dockage for up to nine (9) vessels. The project, as proposed, was ultimately denied by the Division of Coastal Management due to the overall length of the structure (exceeded the 1/3 width allowance). Although several adjacent property owners received a variance to exceed the 1/4 and 1/3 width allowance, the applicant did not pursue a variance request through the Coastal Resource Commission. The applicant is now proposing to reduce the length of the structure, as well as the platform area, and reduce the total number of slips from nine to four. For site description information, please refer to the Field Investigation Report (FIR) for Robert O. Hill, Jr., prepared by Robb Mairs and circulated on 7/30/07. Prior to circulation of the initial FIR, the applicant had begun construction of a single-family residence, private driveway and swimming pool on the subject property. Following circulation of the application package, it was determined that the development was partially located within the 575' Area of Environmental Concern (AEC). Following discovery of the violation, the applicant was issued a Notice of Violation for failure to obtain a CAMA permit while working within the AEC. The case file against the applicant has been closed and the applicant has complied with the Division of Coastal Managements request to obain a CAMA Major permit. The remaining upland development, which is not yet constructed, is being included in this permit application package along with the proposed pier, platform, floating dock and boatlifts. PROPOSED PROJECT The applicant proposes to continue the upland development activities on the property, including house, pool and pool house construction, construction of an outdoor patio and a three-tier landscape area leading down through a retaining wall. Additionally, the applicant is proposing to construct a private pier, gazebo, "horseshoe" shaped floating dock and four boatlifts adjacent to the subject property. The applicant proposes to continue construction on the upland portion of the property. The activities proposed include completion of the driveway, residence, swimming pool and poolhouse. Additionally, the applicant proposes to fill and grade a portion of the property, east of the residence, and install a tier-type terraced lawn and retaining wall. According to the application package, all of the upland development would be located a minimum of 360' from the Normal High Water (NHW) line. Please refer to sheet 2 of 4 for a detailed layout of the landscaping, retaining wall(s), swimming pool and pool house. The pier (6' x 965') would originate from a narrow peninsula located in the southeast corner of the property and extend over a large span of coastal marsh (in an easterly direction towards the AIWW) before terminating into a 25' x 25' platform. A 10' x 10' golf cart turn around would be located along the southern side of the access pier near the terminal end, just landward of the 25' x 25' platform. The applicant proposes to construct a 16' x 16' covered gazebo in the center of the 25' x 25' platform. A ramp would attach to the platform and provide access to the proposed "horseshoe" shaped floating dock. The floating dock would be constructed in three sections. A 10' x 40' section would be constructed perpendicular to the access pier and two (2) 6' x 30' finger docks would run parallel to the access pier at each end of the 10' x 40' dock ("spine"). Four boatlifts would be installed, one on each side of the proposed finger docks. According to the applicant, this facility would provide dockage for up to four (4) vessels. Water depths in the vicinity of the floating structure range from -4' to -7', below the normal low water contour. Robert Hill Page Two 4/28/08 10. ANTICIPATED MPACTS The overall size of the proposed docking facility seems excessive for private, residential development, however the applicant has adequate shoreline for the proposed pier and platform. There is no Submerged Aquatic Vegetation (SAV) in the general area of the proposed pier and platform, and the platform structure would be located over open water. As proposed, the planned upland development would be located a minimum of 360' landward of NHW and approximately 1% of impervious coverage would be located within the 575' AEC. According to the site plans, the proposed pier and docking facility would be located within the applicant's area of riparian access. Additionally, the structures would not extend beyond, or into, the edge of the adjacent channel, nor would the structure extend beyond i/4 of the width of the waterbody. The proposed pier and docking facility would incorporate approximately 6,215 sq. ft. of public trust and estuarine waters. Hill, Applicant This CAMA Major Express Permit Application proposes an elevated fixed access pier, elevated fixed platform area with a covered gazebo, an additional platform area for golf cart parking and turnaround and a four slip docking facility with lifts for a single family residence. The site is located adjacent to the Atlantic Intracoastal Waterway, Wilmington, New Hanover County, North Carolina. Waters of the AIWW in the vicinity of the subject property are classified as SA, ORW by DWQ and DMF has classified the marshes and bottom areas as Primary Nursery Area (PNA) and the area is open to shellfishing. All floating structures will be located in a minimum depth of -2' Mean Low Water (MLW). None of proposed structures exceed the '/ waterbody distance or encroach into the Corp 80' setback. There is no dredging required or proposed. There is no development with the 575' AEC and there is no upland development proposed with this application. The site is currently contains one single family residence and amenities partially located in the AEC. Vegetation on the tract includes native trees, shrubs, and grasses.
