Please reference your March 15, 2007 request for after-the-fact Department of Army
authorization for the discharge of fill material into 0.272 acres of Section 404 wetlands adjacent
to Aberdeen Creek, for the purpose of installing a septic line in the Glen Laurel residential
subdivision, located in Aberdeen, Moore County, North Carolina. This request has remained
incomplete pursuant to the submittal and approval of a wetland restoration plan for the 0.298
acre of unauthorized wetland impacts associated with lots 63, 64, and 65 on Magnolia Drive.
Please reference the Wetland Restoration Plan, Glen Laurel Subdivision, Lots 63 and 64
(submitted August 2, 2007) and Wetland Restoration Plan, Glen Laurel Subdivision, Lot 65
(submitted March 7, 2008) developed by Hal Owen & Associates, Inc., copies enclosed for your
reference. Upon review of these documents, and the ensuing administrative record, we have
determined that your proposal to address the unauthorized activity is satisfactory, with the
following special conditions:
1) In accordance with Part 1 (Restoration) of the Wetland Restoration Plan, you must
install and maintain the proper sediment and erosion control measures, such as silt
fencing, at the downslope edge of your restoration area until the area is permanently
stabilized with vegetation.
2) You must complete all fill removal and vegetation plantings within 60 days of receipt
of this letter. In addition, you must conduct monitoring (visual) of the area for
vegetation success and erosion control for a minimum of three years or until deemed
successful by the Corps of Engineers, Wilmington District. You shall provide annual
monitoring reports to the Corps by June 1St of each year.

Within 30 days of restoration completion, please provide as-built surveys for lots 63-65,
including the sewer line easement adjacent to these lots, to indicate that these areas have been
restored back to their original grade, and include a vegetation planting plan.
With this approval of the Wetland Restoration Plans for lots 63-65, we have also enclosed an
a$er-the-fact Verification to utilize Nationwide Permit 12 for impacts to 0.27 acre of jurisdictional
wetland for four existing sewer line impacts. Please be careful to read the Special Conditions
regarding mitigation attached.
If you fail to perform the above, the Corps may refer your case to the U.S. Attorney with a
recommendation for civil prosecution. Please be aware that any further unauthorized work in
waters or wetlands will be considered an intentional violation of federal law.
