The NCDWQ 401 Water Quality Certification was received on March 17, 2008. Permanent impacts permitted for Phases I and II included 0.36 ac of wetlands, 69 linear feet of stream channel, and 13,616 sgft of riparian buffers (USAGE NWP #39, Action ID. 200521326; NCDWQ WQC #3402, DWQ EXP # OS-1393). In order to mitigate for these impacts and to protect the remaining wetland azeas within the eazly phases, 9 acres of wetlands were placed in restrictive covenants. Impacts for Phase III included a road crossing with impacts to 0.1.3 ac of wetlands, 80 linear feet of stream channel, and 6,090 sgft of Neuse riparian buffer. An underground water line will be run along an existing soil path from the neighboring subdivision (Rowland Pond) to the lots in Phase III. Compensatory mitigation for proposed permanent impacts will be provided through the preservation of 12.6 acres wetlands, 1,223 linear feet streams, and 2.8 acres buffers within Phase III. To date no request for additional information or permit approval has been received from the USAGE. Since the 45 day review time period expired in February 2008, we ask your concurrence that the proposed Sutton Springs development may proceed with construction as described in the December 18, 2007 PCN application.
