Sullins, Director Division of Water Quality April 17, 2008 DWQ# 08-0162 Wilkes County CERTIFIED MAIL: 7007 3020 0000 6279 7631 RETURN RECEIPT REQUESTED Mr. Ira Myers 1470 Country Club rd Wilkesboro, NC 28697 Re: Section 401 Water Quality Certification application Dear Mr. Myers: On March 13, 2008, the North Carolina Division of Water Quality (DWQ) received additional information for your application fora 401 General Water Quality Certification modification to impact 4321inear feet of stream to construct a commercial use building and parking area near Moravian Falls in Wilkes County. We have reviewed this information and additional information is still necessary in order that we may determine your project's compliance with 15A NCAC 2H .0500. The DWQ will require this information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, we will place this project on hold as incomplete until we receive this additional information, and if we do not receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506. Please provide the following information so that we may continue to review your project. The volume of the forebay has not been designed in accordance with the Division's Stormwater BMP manual. Please redesign so that the forebay volume is adequately sized as 20% of the total volume. 2. Please provide a complete sectional view of the stormwater pond including across-section of the entire pond. Please note that the interior slopes of the pond above the vegetative shelf must be designed (and called out on the plans) at 3:1 slopes. This is not noted on the drawings that have been submitted. 3. Please provide a more detailed planting plan for the pond. Per the BMP manual "the planting plan should provide specifications for the selection of vegetation, its installation, and the post- installation care for the vegetated shelf, the 3:1 side slopes and the immediately surrounding areas. 4. Please provide a pond that is designed to have a length to width ration of 1.5:1 minimum as noted in the BMP manual. The average depth of the permanent pool is insufficient per the calculation worksheet submitted. Please note that this is average depth, not the maximum depth in a specific area. This depth should not include the 1 foot that should be provided at the bottom of the pond for sediment storage. 6. The average depth must be utilized to properly calculate the Surface Area to Drainage Area calculation using Tables 10-1 through 10-4. Please re-verify this calculation. 7. Please provide a complete construction sequence that clearly indicates all construction phases of this project with regards to the stormwater pond. This must include site grading, scheduling of the pond construction and protection of the pond during construction phases and/or use and restoration of the pond during construction. The required items checklist indicates this pond will not be used as a sediment and erosion control pond, however the plans submitted note that it will be used. You must determine this information accurately and then provide details regarding use or protection during site development. Please respond in writing within 30 calendar days of the date of this letter by sending a copy of this information to Sue Homewood at the address on this letterhead, and a copy to Ian McMillan N. C. Division of Water Quality, Wetlands/401 Certification Unit, 1650 Mail Service Center, Raleigh, NC 27699-1650. If you will not be able to provide the requested information within that timeframe, please provide written confirmation that you .intend to provide the requested information, and include a specific timetable delineating when the requested materials will be provided. If we do not hear from you in 30 calendar days, we will assume that you no longer want to pursue this project and we will consider the project as returned. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
