Dear Mr. Bowen:
On March 12, 2008, the Division of Water Quality (DWQ) received your application dated March 10, 2008, to
fill or otherwise impact 0.00709 acres of open waters below the normal pool lake level and 0.00236 acres
above the normal pool lake level , to construct the proposed bulkhead at the site. The DWQ has determined
that your application was incomplete and/or provided inaccurate information as discussed below.
1. On April 14, 2008, Lauren Witherspoon of the DWQ Raleigh Regional Office conducted a site visit to
determine whether erosion at the site warranted construction of a bulkhead at the site. After
evaluating the site, Ms. Witherspoon determined that a bulkhead was not necessary.
For this reason your permit application is hereby considered returned. Should conditions at the site change you
may reapply for DWQ approval. This includes submitting a complete application package with the appropriate
fee.
Please be aware that you have no authorization under Section 401 of the Clear Water Act for this activity and
any work done within waters of the state would be a violation of North Carolina General Statutes and
