Dear Mr. Morgan:
On April 4, 2008, the Division of Water Quality (DWQ) received your application dated April 4,
2008, to fill or otherwise impact 1,900 square feet of Zone 1 Neuse River basin protected
riparian buffers and 0.00 square feet of Zone 2 Neuse River basin protected riparian buffers to
construct the proposed greenway at the site.
On April 11, 2008, the DWQ requested the following information from you:
1. Please locate on your project boundaries on the most recent USGS topographic
quadrangle map and the most recent, published and bound Wake County soil survey.
2. Section VI, no. 1, states "The most obvious impact will be directing the flow of the creek
to the other side of the channel..." Please explain what you mean and intend with respect
to this statement.
For these reasons your permit application is hereby considered returned. Once you have
redesigned your project to address the problems and inadequacies with your application as it was
submitted, you will need to reapply for DWQ approval. This includes submitting a complete
application package.
Please be aware that you have no authorization under the Neuse Buffer Rules for this activity and
any work done within buffers would be a violation of North Carolina General Statutes and
