Sullins, Director Division of Water Quality April 18, 2008 DWQ Project # 08-0433 Wake County CERTIFIED MAIL: RETURN RECEIPT REQUESTED Mr. Jeff Furman Crosland, LLC 4000 Westchase Boulevard, Suite 390 Raleigh, NC 27607 Subject Property: Bradford Ut to Turkey Creek [030402, 27-33-2, C, NSW] REQUEST FOR MORE INFORMATION Dear Sir or Madam: On March 7, 2008, the Division of Water Quality (DWQ) received your application dated March 7, 2008, to fill or otherwise impact 0.001 acres of 404/wetland and 979 square feet of Zone 1 Neuse River basin protected riparian buffers, and 3,341 square feet of Zone 2 Neuse River basin protected riparian buffers to construct the proposed residential development. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive five copies of the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information.. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. The proposed BMPs must be designed to meet state requirements regardless of whether the stormwater review is being conducted by the Town or Cary or the DWQ. Please insure that the proposed BMPs include provisions for pretreatment, flowpath lengths, 3:1 side slopes and other required design elements listed in the DWQ BNIP Manual. 2. The level spreader must be relocated to a more level location. 3. Wet detention ponds may only be discharged into existing natural conveyances if those natural conveyances are adequate to handle the flows without any modifications such as riprap, turf reinforcement, regrading, etc. Please provide either engineering justification that the existing conveyances can handle the new flows or a properly designed level spreader at these locations. If you choose to provide one or ore level spreaders, then you must submit a completed Level Spreader Supplement Form (with all required items) for each proposed level spreader. Please submit this information within 30 calendar days of the date of this letter. If we do not receive this requested information within 30 calendar days of the date of this letter, your project will be withdrawn and you will need to reapply with a new application and a new fee. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
