There is a heavy cover of leaves and grass, but the entire area drains well. I have now had Durwood Baker Surveys to make a topographic map of two of the lots and it shows good drainage. I have a copy of the criteria that DENR has published for use in determining a ditch from an intermittent or perennial stream. I believe the feature on this property to be a drainage ditch. Klimek, Director Division of Water Quality DWQ # 02-1253 NBR.RRO.19 Wake County On-Site Determination for Applicability to the Neuse River Riparian Area Protection Rules (15A NCAC 2B .0233) Dear Mr. Edwards: On August 12, 2002, at your request I conducted an on-site determination to review a drainage feature (depicted as "creek" on the attached survey initialed by DWQ staff on. August 12, 2002) on the subject property for applicability to the Neuse Buffer Rules (15A NCAC 2B .0233). As a result of this on-site determination, the DWQ has determined that the drainage feature contains an ephemeral stream not subject to the Neuse Buffer Rules. The feature was not reviewed south of the N&S Railroad. The DWQ has conducted on-site determinations of this stream on two previous occasions. The first on-site determination was conducted by Mr. Danny Smith (then of the DWQ Raleigh Regional Office (RRO)) on May 13, 1998 (see attached letter). Mr. Smith determined that the stream was subject to the buffer rules. The second on-site determination was conducted by Mr. Steve Mitchell of the RRO on April 9, 2002 (see attached letter). Mr. Mitchell determined that the stream was not subject to the buffer rules. Mr. Mitchell was unaware that Mr. Smith had previously been to the site. It is our understanding (based on conversations with you) that the local municipality would like confirmation that the stream is not subject since Mr. Smith originally determined that it was. This resulted in your request that I review the stream. During my review I evaluated the stream using the "NC DWQ Stream Classification Form". I calculated a score of 17.5 using this form (intermittent streams usually have a score of 19 points or greater). I used this information, the fact that Mr. Mitchell's determination was conducted during a "wetter" time of year (i.e., April) and your statement that the stream has no flow in it three days after a normal rain event to make my determination that the stream was ephemeral and not subject to the buffer rules. This letter only addresses the applicability to the buffer rules and does not approve any activity within the buffers. Nor does this letter approve any activity within Waters of the United States or Waters of the State. Wetlands or other Waters of the U.S. may exist on the property. You should contact the U.S. Army Corps of Engineers to ensure compliance with wetland regulations. This specific project is referenced by the Raleigh Regional Office as NBRRO 02-105. The feature is represented on the Wake Soils map and on the USGS Wendell Topographic Quad map. On May 3, 2002, I completed a site visit and determined that there are no features present on this property that would be subject to the Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A:02B.02.33 (NCAC 0233) .
