Fourth Street, Suite 1 Bay Shore, NY 11706 Subject Property: Ready Mix Concrete Plant Ut to Marks Creek [030402, 27-38, C, NSW] REQUEST FOR MORE INFORMATION Dear Mr. Lochren: On March 14, 2008, the Division of Water Quality (DWQ) received your application dated February 15, 2008, to fill or otherwise impact 475 linear feet of perennial stream to construct the proposed concrete plant at the site. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and 15A NCAC 2B.0233 will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: On April 9, 2008, DWQ personnel determined the stream shown as "1A" on your plans to be perennial. Therefore, 475 linear feet of compensatory stream mitigation is required for this project. Please provide a compensatory mitigation plan. The plan must conform to the requirements of 15A NCAC 2H .0500 and must be appropriate to the type of impacts proposed. Additionally, please revise your site plans to reflect this new information and resubmit your revised plans to the DWQ. 2. Please revise the impact table in your PCN application and maps to reflect the above information and resubmit your PCN application and maps to the DWQ. Please submit this information within 30 calendar days of the date of this letter. Please contact me in writing and Lauren Witherspoon of the DWQ Raleigh Regional Office.
