Natural Resources Water Quality Regional Supervisor 127 Cardinal Drive Extension Wilmington, North Carolina 28405 RE: Middle Sound Sewer Project (Appeal) Project #010093 Dear Riclc: I am in receipt of your July 19, 2002 letter. ~. ! , ~~ AUG - 82002 , _,. .~.., i~ ~ ~ C -~~~ ~~~ t CERTIFIED In response, we will proceed with the portion of the project outside your jurisdiction while we wait for our timely .appeal for a variance from the conditions in your letter (anti-seepage de-ices, 25' set back, ferrous pipe). In addition to the logical conclusions I stated in my June 10, 2002 letter, I would like to add the following in considering the expeditious approval of my variance request. 1) If the sewer main and rock bed will drain the creek and surrounding area, exactly where will the ground water go? Also, what particular projects in coastal North Carolina, installed below sea level, has this phenomena happened? 2) I offer that short term impacts, as outlined in my June 10, 2002 letter, do not justify long term cost in regards to the unsubstantiated set back. r - -_. ___._ _..__. __..__._ ....._ __---_. ._. August 6, 2002 Page Two 3) Ferrous pipe is not "better" than PVC with identical joint standards when buried at the planned depths. Also, by today's material standards, "0" infiltration is permitted, per specification. Any flow would be into and not out of the gravity sewer pipe, under normal operation, when considering the pressure differential between the ground surface water and the gravity sewer pipe. , The linear. stream foatage a~ ~d proposals to minimize impact was addressed in Tony Boahn's McKim &. Creed, June 12, 2002 and my aforementioned June 10, 2002 letters. Cost is always an issue when not fully justified, especially when using the public's money. In closing, I would like you to respond and address my variance request within a legitimate time frame to be set up by you within the next three weeks.
