The purpose of this letter is to request the use of Nationwide Permits 39-0M TZV, 9_'Q1
Water Quality Certification, and concurrence with compliance of the project with the
Neuse River Buffer Regulations for the construction of the proposed Hasentree
Subdivision located northeast of the intersection of NC Highway 98 and Stony Hill Road
(S.R. 1917) (see site vicinity map). (UTM Coordinates; Zone 17, 3985200 N, 716300 E).
Proposed impacts to waters for the construction of the residential subdivision using the
combined requested Nationwide Permit 39 and 14 will total 0.07787 acres (i.e. less than
1/2 acre) (0.0281 acres NWP 14 and 0.04977 acres NWP 39) and 357 LE (105 If
unimportant channel) (252 If NWP 14 and 1051.f. NWP 39) for the construction of
roads to gain access to home lots. The crossings utilizing Nationwide Permit 39 are not in _-:0 r-ri
the mapped floodway. Crossings 1 and 2 also are believed to cross at points with flow c7
m
less than lcfs (37.4 acres are drained at Crossing 1 and 13.8 acres at Crossing 2). .
Construction of the subdivision will comply with the general conditions stated within o
Nationwide Permits 39 and 14. 'i
S&EC, Inc. believes that no mitigation will be required for this project. Proposed impacts
totaling 0.060 acres and 306 linear feet will utilize Nationwide Permit 14 it, order to
connect the existing Frank Bailey Road (S.R. 1920) to NC 98. The remaining proposed
impacts of 0.019 acres and 135 linear feet will utilize Nationwide Permit 39 for the
purpose of constructing a road in order to gain access to an otherwise isolated area of
land. The U.S. Army Corps of Engineers has not evaluated the site at this time, however
the NC Division of Water Quality has verified the Neuse Buffers. If for some unexpected
reason wetland mitigation were to be required, our client proposes payment into the North
Carolina Wetland Restoration Fund.
Neuse Buffers are being completely avoided where possible and are being included in
larger areas of open spaces. The proposed road crossings avoided impacting wetlands
where possible. For example, crossing #2 impacts the smallest wetland area along the
channel in that location. Open space for the proposed Hasentree Subdivision southwest of
the existing Frank Bailey Road totals 66.75 acres.

The surface waters subject to the Neuse River Buffer regulations (15A NCAC 2B .0233)
have been verified by Mr. Bob Zarzecki of the DWQ. The DWQ Project # 00-0781 and
NBRRO Project # 00-156 reference Mr. Zarzecki's findings.
S&EC, Inc. believes that no buffer mitigation will be required for this project. The
proposed impacts are allowed under the current Neuse River Buffer regulations without
requiring a variance from the Environmental Management Commission (i.e. all of the road
crossing buffer impacts are under 1/3 acre). The tributary of Pierce Creek that Crossing 3
impacts drains 85.3 acres at its intersection with Pierce Creek. Pierce Creek drains 96.2
acres at its intersection with the Crossing 3 tributary. For this reason it is not believed that
Crossing 3 and Crossing 4 impact the same channel and therefore no buffer mitigation is
required. If for some unexpected reason buffer mitigation were to be required, our client
proposes payment into the North Carolina Wetland Restoration Fund.
