The project Impact Maps (6 Sheets) and Stormwater Management Plan (SMP) (3 sheets) have been revised to include the additional information and are attached. A revised mitigation acceptance letter from the NC Ecosystem Enhancement Program is also attached. Each item requested in the aforementioned letter is specifically addressed below. 1. Wet Pond 1 a. Sheet SMP 1 has been revised to include a detail of the retaining wall showing the additional measures to enhance the structural integrity of the proposed sectional retaining wall. 2. Wet Pond 2 a. Attached is a letter from developer is a written commitment to construct a fence around the pond. b. Sheet SMP2 has been revised to show permanent reinforced matting below the emergency spillway as requested. Ms. Lia Myott May 1, 2008 Page 2 of 2 c. We are still waiting for written approval from Progress Energy for the installation of the level spreader in the power easement. 3. Wet Pond 3 a. Channel capacity and lining design calculations for the bypass swale (Pipe 67 as shown on Impact Map Sheet 4 of 6) are provided on Impact Map Sheet 2 of 6. b. Sheet SMP3 has been revised to include filter fabric underneath the riprap in the bypass swale. White St. Wake Forest, NC 27587 Expiration of Acceptance: October 15, 2008 Project: Drayton Estates County: Wake The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NCEEP) is willing to accept payment for impacts associated with the above referenced project. Please note that this decision does not assure that the payment will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact these agencies to determine if payment to the NCEEP will be approved. This acceptance is valid for six months from the date of this letter and is not transferable. If we have not received a copy of the issued 404 Permit/401 Certification/CAMA permit within this time frame, this acceptance will expire. It is the applicant's responsibility to send copies of the permits to NCEEP. Once NCEEP receives a copy of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the In Lieu Fee to be paid to NCEEP by an applicant is calculated based upon the Fee Schedule and policies listed at www.nceep.net. If the regulatory agencies require mitigation credits greater than indicated above, and the applicant wants NCEEP to be responsible for the additional mitigation, the applicant will need to submit a mitigation request to NCEEP for approval prior to permit issuance. The mitigation will be performed in accordance with the Memorandum of Understanding between the N. C. Department of Environment and Natural Resources and the U. S. No. 08-0322 Subj: Response to plan review comment Dear Mrs. Karoly, We are in receipt of plan review comments that were issued by your office for the storm water management plan for Drayton Reserve Subdivision. We have noted your recommendation stated under item 2a. for Wet Pond 2 and are writing to confirm that we do acknowledge the need for some form of "guard rail fence" between the pond and adjacent road. We do intend to provide such a barrier and hereby commit to you that such measures will be installed. We' have not included this on the current plan since our goal is to have the barrier incorporated into the overall landscaping plan for the project. This plan is still in progress and thus we are unable to provide a schematic at this time. We trust that this written commitment will satisfy your concern and be considered adherence to your recommendation. Please let us know if it does not or if there are any further questions.
